At the same time, the failure of provinces to correct health care problems acts a serious irritant in intergovernmental relations, creating a vicious cycle where deficiencies in intergovernmental fiscal relations make health care reform difficult while failures to effect health care reform increase conflict between the provinces and the federal government. This collection of essays analyses key issues in federal-provincial health care relations, particularly the fiscal component. The authors look at why there is a role for the federal government in health care and consider the critical issues in recent intergovernmental political battles over this role. The issues of whether the vertical federal-provincial fiscal imbalance is myth or reality, how much the federal government does and should contribute financially to provincial health care programs, and methods for settling disputes, such as those over user fees, are discussed. The authors also provide concrete proposals for reconstructing the federal-provincial partnership. A public hospital insurance scheme was first achieved in Saskatchewan in 1947 and nationally in 1957. Universal accessibility without fear of the financial consequences of hospitalization reflected concern for both the medical health of Canadians unable to pay for hospital care, and the economic health of the paying 'patient of moderate means' threatened with medical pauperization. It also provided the resources necessary to address the modern epidemic of lifestyle diseases and to accommodate the demands of the post-war therapeutic revolution. Employing the historical records of selected individual hospitals, reports and data from all levels of government, a wide range of professional medical, nursing, hospital, and public health journals, and the international historiography of hospital history, David and Rosemary Gagan describe and account for the invention, rise, decline, and rebirth of the modern Canadian hospital between 1890 and 1950. They pay particular attention to the evolving interdependence of doctors and hospitals in the struggle to legitimate the social and cultural authority of scientific medicine, the evolution of hospital-based nursing, and the experiences of patients.

Book excerpt: In New Zealand, as well as in Australia, Canada and other comparable jurisdictions, Indigenous peoples comprise a significantly disproportionate percentage of the prison population. For example, Maori, who comprise 15% of New Zealand’s population, make up 50% of its prisoners. For Maori women, the figure is 60%. These statistics have, moreover, remained more or less the same for at least the past thirty years. With New Zealand as its focus, this book explores how the fact that Indigenous peoples are more likely than any other ethnic group to be apprehended, arrested, prosecuted, convicted and incarcerated, might be alleviated. Taking seriously the rights to culture and to self-determination contained in the Treaty of Waitangi, in many comparable jurisdictions (including Australia, Canada, the United States of America), and also in the United Nations Declaration on the Rights of Indigenous Peoples, the book make the case for an Indigenous court founded on Indigenous conceptions of proper conduct, punishment, and behavior. More specifically, the book draws on contemporary notions of ‘therapeutic jurisprudence’ and ‘restorative justice’ in order to argue that such a court would offer an effective way to ameliorate the disproportionate incarceration of Indigenous peoples.
