The current extremely rapid and dynamic development of modern technologies and the unprecedented degree of their integration into the everyday life of every person are radically changing the previous modus vivendi in the society. The emergence of the Internet and the continuous development of digital technologies have brought into fore a number of new legal problems and issues that require a timely solution and proper and effective legal regulation by the EU as one of the leading regulators of the digital world. The technological developments have opened a new “window” to the borderless world of the Internet, giving a person an opportunity to exercise his/her fundamental rights at a new and unprecedented level. This unique book thus presents the key information and solves the related problems concerning the legal regulation of the usage of modern technologies in everyday life. This team is representing the countries with the highest level of integration of modern technologies (Estonia, Germany, Czech Republic, Slovakia) or has a unique experience with provision of cyber security in the extreme conditions. The book creates a main output from the research project with the title “The EU and the Challenges of Modern Society (legal issues of digitalization, robotization, cyber security and prevention of hybrid threats)” granted by the EACEA in the category of Jean Monnet network. The publication of the book is supported by the financial subsidy in the amount of 3 000 Euro, sent by Palacky University to the Publisher (Intersentia). Book Identity Community and Sexuality in Slash Fan Fiction

Download or read book Identity Community and Sexuality in Slash Fan Fiction written by Anne Kustritz and published by Taylor & Francis. This book was released on 2023-12-12 with total page 332 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book explores slash fan fiction communities during the pivotal years of the late 1990s and early 2000s as the practice transitioned from print to digital circulation. Delving into over ten years of online and in-person ethnography, the book offers an in-depth examination of slash fan fiction – original stories written by and circulated within female-centered communities about same-sex characters borrowed from previously published sources – to document the history of a feminist, queer media subculture whose infrastructure, creativity, and ways of life are often obscured in dominant histories of the internet’s development and by the contemporary focus on industry-friendly but often misogynist digital fan subcultures. Arguing that online slash communities created an alternate public space that provided opportunities for unanticipated encounters with a wide range of complex sexual, relational, and political practices, the book contends that slash thereby added to readers’ tools for experiencing and thinking about pleasure and ways of living by forming a “pocket public,” that is a digital space public enough to be found and protected enough to shield participants from harassment and censorship. This insightful and comprehensive study will interest students and scholars working in the areas of media studies, literary studies, anthropology, new media, audience communities, convergence culture, fan studies, women’s studies, and queer studies.

Book EU Competition Law Data Protection and Online Platforms Data as Essential Facility

Download or read book EU Competition Law Data Protection and Online Platforms Data as Essential Facility written by Inge Graef and published by Kluwer Law International B.V.. This book was released on 2016-10-17 with total page 342 pages. Available in PDF, EPUB and Kindle. Book excerpt: All are agreed that the digital economy contributes to a dynamic evolution of markets and competition. Nonetheless, concerns are increasingly raised about the market dominance of a few key players. Because these companies hold the power to drive rivals out of business, regulators have begun to seek scope for competition enforcement in cases where companies claim that withholding data is needed to satisfy customers and cut costs. This book is the first focus on how competition law enforcement tools can be applied to refusals of dominant firms to give access data on online platforms such as search engines, social networks, and e-commerce platforms – commonly referred to as the ‘gatekeepers’ of the Internet. The question arises whether the denial of a dominant firm to grant competitors access to its data could constitute a ‘refusal to deal’ and lead to competition law liability under the so-called ‘essential facilities doctrine', according to which firms need access to shared knowledge in order to be able to compete. A possible duty to share data with rivals also brings to the forefront the interaction of competition law with data protection legislation considering that the required information may include personal data of individuals. Building on the refusal to deal concept, and using a multidisciplinary approach, the analysis covers such issues and topics as the following: – data portability; – interoperability; – data as a competitive advantage or entry barrier in digital markets; – market definition and dominance with respect to data; – disruptive versus sustaining innovation; – role of intellectual property regimes; – economic trade-off in essential facilities cases; – relationship of competition enforcement with data protection law and – data-related competition concerns in merger cases. The author draws on a wealth of relevant material, including EU and US decision-making practice, case law, and policy documents, as well as economic and empirical literature on the link between competition and innovation. The book concludes with a proposed framework for the application of the essential facilities doctrine to potential forms of abuse of dominance relating to data. In addition, it makes suggestions as to how data protection interests can be integrated into competition policy. An invaluable contribution to ongoing academic and policy discussions about how data-related competition concerns should be addressed under competition law, the analysis clearly demonstrates how existing competition tools for market definition and assessment of dominance can be applied to online platforms. It will be of immeasurable value to the many jurists, business persons, and academics concerned with this very timely subject.

Book The Subtle Logics of Knowledge Conflicts in China s Foreign Enterprises

Download or read book The Subtle Logics of Knowledge Conflicts in China s Foreign Enterprises written by Constanze Wang and published by Springer. This book was released on 2016-05-04 with total page 312 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book investigates knowledge interactions in China’s foreign enterprises. It reveals that cultural differences strongly account for knowledge-related obstacles, namely knowledge leakage and insufficient knowledge sharing. Contrary to conventional wisdom, however, widespread cultural arguments such as Confucianism or collectivism hardly apply to Chinese employees’ handling of knowledge. In fact, more subtle cultural logics are relevant in daily work, which are connected to the perceived stability of the enterprise itself. But these usually go unnoticed. Thus, rather than being distracted by a national “Chinese culture”, managers can take real action to solve knowledge conflicts in their particular enterprise.

Book Intellectual Property

Download or read book Intellectual Property written by Roger D. Blair and published by Cambridge University Press. This book was released on 2005-05-02 with total page 316 pages. Available in PDF, EPUB and Kindle. Book excerpt: Intellectual property refers to exclusive rights in, among other things, inventions (patents), works of authorship (copyright), and source-identifying symbols (trademarks). Intellectual property law is generally viewed as a means for inducing the optimal supply of inventions, works, and symbols. Economics provides some useful tools for determining whether the legal rules at issue are more or less likely to achieve this goal. This book in particular addresses the law and economics of a variety of topics that have been underanalyzed in the existing literature, including remedies such as injunctions and damages, the relevance of the defendant's mental state, and matters relating to the enforcement of intellectual property rights in court proceedings.

Book The New International Telecommunication Regulations and the Internet

Download or read book The New International Telecommunication Regulations and the Internet written by Richard Hill and published by Springer Science & Business Media. This book was released on 2014-03-25 with total page 192 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book provides a clear and thorough account of the process leading up to the revision of the International Telecommunication Regulations (ITRs) one of the four treaties administered by the ITU. The author’s inside view of the events and his legal analysis of the new ITRs, are different from that what has been aired in most other accounts to date. His systematic approach shows how much of the criticism of the WCIT-12 process and of the ITRs themselves, is unjustified. This book provides the most accurate view to date of what the ITRs really mean and of what really happened at WCIT-12, which was undoubtedly a key event in the history of telecommunication policy and which is likely to have significant long-term effects. The book covers in some detail the events leading to the non-signature of the treaty by a significant number of states, outlines possible consequences of that split between states, and offers possible ways forward. The book includes a detailed article-by-article analysis of the new ITRs, explaining their implications and concludes with recommendations for national authorities. It concludes with an analysis of events from the point of view of dispute resolution theory, offering suggestions for how to avoid divisive outcomes in the future. "This is an excellent book, and quite rich and comprehensive. The topic is important and the book will surely be of interest to regulators, diplomats, policy experts, and all those who participated in WCIT. The author is uniquely qualified to write an analysis of the new ITRs and an account of the Conference. This book will be a good reference for the next Plenipotentiary Conference to be held in 2014 which is going to discuss follow-up to WCIT-12." Naser al-Rashedi, United Arab Emirates. "This is an authoritative expert account of a moment of high significance for vital issues with respect to international networks." Professor Dan Schiller, University of Illinois. "This is an excellent and timely work." Professor Ian Walden, Queen Mary, University of London. "Interested persons, businesses and governments can draw their policies from the assessments of a telecommunications insider as presented in this book. The manifold arguments enlightening the interpretation of the provisions of the ITRs might become an invaluable guidance for those who apply the ITRs in the future." Professor Dr. Rolf H. Weber, University of Zurich.

Book Under Observation The Interplay Between eHealth and Surveillance

Download or read book Under Observation The Interplay Between eHealth and Surveillance written by Samantha Adams and published by Springer. This book was released on 2016-12-31 with total page 215 pages. Available in PDF, EPUB and Kindle. Book excerpt: The essays in this book clarify the technical, legal, ethical, and social aspects of the interaction between eHealth technologies and surveillance practices. The book starts out by presenting a theoretical framework on eHealth and surveillance, followed by an introduction to the various ideas on eHealth and surveillance explored in the subsequent chapters. Issues addressed in the chapters include privacy and data protection, social acceptance of eHealth, cost-effective and innovative healthcare, as well as the privacy aspects of employee wellness programs using eHealth, the use of mobile health app data by insurance companies, advertising industry and law enforcement, and the ethics of Big Data use in healthcare. A closing chapter draws on the previous content to explore the notion that people are ‘under observation’, bringing together two hitherto unrelated streams of scholarship interested in observation: eHealth and surveillance studies. In short, the book represents a first essential step towards cross-fertilization and offers new insights into the legal, ethical and social significance of being ‘under observation’.
