Book excerpt: Every day, in courtrooms around the United States, thousands of criminal defendants are represented by public defenders--lawyers provided by the government for those who cannot afford private counsel. Though often taken for granted, the modern American public defender has a surprisingly contentious history--one that offers insights not only about the "carceral state," but also about the contours and compromises of twentieth-century liberalism. First gaining appeal amidst the Progressive Era fervor for court reform, the public defender idea was swiftly quashed by elite corporate lawyers who believed the legal profession should remain independent from the state. Public defenders took hold in some localities but not yet as a nationwide standard. By the 1960s, views had shifted. Gideon v. Wainwright enshrined the right to counsel into law and the legal profession mobilized to expand the ranks of public defenders nationwide. Yet within a few years, lawyers had already diagnosed a "crisis" of underfunded, overworked defenders providing inadequate representation--a crisis that persists today. This book shows how these conditions, often attributed to recent fiscal emergencies, have deep roots, and it chronicles the intertwined histories of constitutional doctrine, big philanthropy, professional in-fighting, and Cold War culture that made public defenders ubiquitous but embattled figures in American courtrooms.

This book was released on 2018-05-17 with total page 68 pages. Available in PDF, EPUB and Kindle. Book excerpt: The tribal gaming industry has changed significantly since President Reagan signed the Indian Gaming Regulatory Act into law. The National Indian Gaming Commission recently announced that tribal gaming brought in $31.2 billion in gross gaming revenue for 2016, the largest amount in the history of Indian gaming. As Chairman Forsman of the Suquamish Tribe will testify, the revenue flowing from gaming activities not only creates jobs and stimulates tribal economy, but also goes a long way to supplement the massive shortfalls left by the Federal Government's failure to appropriate adequate funding to meet Indian Country's needs. Unlike commercial casinos that generate revenue for shareholders, gaming revenue provides essential government services for tribal citizens, services like housing, health care, education, public safety and general social services. The benefits of Indian gaming also go beyond reservation boundaries. According to the National Indian Gaming Association, tribal gaming has created nearly 700,000 jobs and generated more than $10 billion in revenue for Federal, State and local governments in 2015 alone. While the benefits of gaming revenue to tribal governments are significant and have been the key to revitalizing some tribal economies, it is not the panacea for all. There is still much work to be done to truly achieve tribal self determination and sufficiency.

Book Legislative Drafter s Deskbook

Download or read book Legislative Drafter s Deskbook written by Tobias A. Dorsey and published by TheCapitol.Net Inc. This book was released on 2006 with total page 106 pages. Available in PDF, EPUB and Kindle. Book excerpt: The Legislative Drafter's Deskbook offers practical advice and insight for those engaged in legislative drafting, those more interested in policy than drafting itself, or those interested in reading and interpreting the law. The Legislative Drafter's Deskbook helps anyone understand why laws are drafted the way they are. This book explains why laws are drafted the way they are. Legislative drafting is - to the extent it is writing at all - the form of writing used for legislative measures, a category that covers original bills and resolutions as well as amendments. Ultimately, legislative drafting is the form of writing used for enacted law. The focus of this book is on legislative drafting for the Congress of the United States, but many, if not most, of the principles described here apply just as well to drafting for other legislatures. As forms of writing go, drafting is not freewheeling like poetry, nor showy like rhetoric, nor personal like a novel. Drafting is disciplined, rigorous, and analytical. Done well, drafting can also be creative, elegant, and clever. (Unfortunately, drafting is not always done well.) The purpose of this book is to provide practical advice on drafting to anyone who does, or may, engage in drafting, and indirectly to provide insight into the drafting process to other interested people. For example, this book is for people who are more interested in policy than in drafting, but want to understand why drafters operate the way they do. It is also for people who are more interested in reading and interpreting the law than in drafting, but want to understand why laws are drafted the way they are. It is hoped that this book will be accessible to beginners while remaining valuable to veterans. The traditional method of training drafters is to train them on the job; the consensus is that drafting is best learned holistically, on a case-by-case basis. For that reason this book is best used as a resource, not a course. It is a supplement to, not a substitute for, the learning that comes from experience. The author designed this book to answer the variety of questions about drafting that arise daily in the work of individuals with a professional interest in how bills, resolutions, and laws are drafted. The approach used here is pragmatic: You will find no linguistic theories or esoteric conundrums discussed here. What you will find is solid advice for everyday drafting projects. "A masterful work. It is comprehensive and exceptionally well written. It is an essential tool for anyone who drafts legislation or interprets the law." -- William K. Suter, Clerk of the United States Supreme Court "An essential and indispensable book, both as a reference work and as a thorough introduction to Federal legislative drafting." -- Frank Burk, Legislative Counsel of the United States Senate 1991-1998 "The succinct and thorough assessment of good legislative drafting techniques provides a set of 'best practices' for drafters at all levels of government." -- Elizabeth Garrett, Sydney M. Irmas Professor of Public Interest Law, University of Southern California "State legislative drafters will also greatly appreciate this work." -- Bruce Feustel, Senior Fellow, NCSL Summary of Contents 1. Book From Georgia Tragedy to Oklahoma Frontier

Download or read book From Georgia Tragedy to Oklahoma Frontier written by Billie Jane McIntosh and published by . This book was released on 2008 with total page 185 pages. Available in PDF, EPUB and Kindle. Book excerpt: Many of the early 18th and 19th century Scots settlers of the Southeastern United States intermarried and formed partnerships with Native Americans. These mixed-blood relationships produced talented Indian leaders who negotiated and translated during peace treaties, maintained traditional values, and formed valuable alliances. Chilly McIntosh, son of legendary Creek Chief William McIntosh, Jr., was one of these leaders. With roots in both ancient Scotland and the Creek Wind Clan, he was an amalgam of both cultures. As elected Chief of his tribal township, he made efforts to straddle the divide between both the traditional and progressive factions, while at the same time performing duties as Clerk of the Creek Tribal Council. Accepting the fact that his people were being displaced from their lands, he made efforts to see that they were treated fairly during their journey west. From his youth in the Indian towns to his relocation to the Oklahoma lands that were to be his final home, we explore the many facets of his long and varied life. We learn of the controversial death of his father, Chilly¿s participation in the recording of the Laws of the Creek Tribe, his visit with General Lafayette, the role he assumed while leading his people west, his life as a Civil War Colonel, and his service as a Baptist minister. This chronicle of Chilly McIntosh is the ultimate story of triumph in the face of adversity, one to be cherished and savored by those who admire the strength of the human spirit.
