However, many recalled vehicles are never fixed, posing a risk to vehicle operators, other drivers, and pedestrians. After the recent recalls of Toyota vehicles, Congress raised questions about the auto safety defect recall process, including the sufficiency of NHTSA's oversight authorities and whether vehicle owners are being effectively motivated to comply with recalls. This report reviewed laws and documents and interviewed NHTSA and stakeholders about the (1) extent of NHTSA's role in the recall process, and how its authorities compare to selected federal and foreign agencies that oversee recalls; (2) benefits and challenges of the recall process for NHTSA and manufacturers; and (3) options for improving the recall process. The National Highway Traffic Safety Administration (NHTSA), which administers the program, conducts defect investigations of approximately 50 to 70 percent of the recalled motor vehicles, and the motor vehicle industry voluntarily initiates investigations of the remaining recalls. Since 1966, about 128 million motor vehicles, tires, and other related replacement items have been recalled because of safety defects. GAO reviewed the recall program to determine if: (1) NHTSA could hasten its safety defect identification process; and (2) the number of owners responding to recalls could be increased. GAO found that NHTSA investigations often take years to complete, while vehicles continue to be exposed to possible safety deficiencies. The average time for each case in the NHTSA Office of Chief Counsel is approximately 14 months. As a result of delays, information to support some case findings often has to be updated. GAO also found that about 50 percent of the owners notified of potential safety defects do not take their vehicles in for inspection and/or correction. A 1980 survey indicated that some owners do not respond to recalls because they do not perceive the defect as a problem or do not believe the recall is important. GAO believes that the reason behind those perceptions and beliefs could be that the recall letters are too difficult for many owners to understand.

Vehicle safety and reliability is considered to be better than it has ever been, yet the National Highway Traffic Safety Administration (NHTSA) continues to issue as many as 30 million vehicle recalls per year. A paradox perhaps. This book discusses the history of the recall process and the reasons NHTSA devotes a high percentage of its attention to this matter, with more vehicles recalled than sold each year. Yet it administers this program in a costly and rather ineffective manner for all parties involved. First of all, compliance is difficult to enforce since up to a quarter of the recall notices, on vehicles, are not attended to by the owners. Second, the cost of recalls is very high in terms of cost per vehicle. NHTSA estimates that recalls cost automakers about $100 per vehicle per recall. But that's only part of the costs, namely, parts and labor. This estimate fails to consider costs such as engineering, tooling, and producing the replacement parts. Worse, it ignores indirect costs, which dwarf direct costs and include the loss of market capitalization, market share, and brand damage as a result of a recall. Third, there is a cost to those who do take their vehicles in to fix the recall. Having to fix the recall causes extra risk of accidents due to additional travel, loss of time and productivity due to bringing the vehicle to the dealer, and cost of fuel needed to make the additional trips. It is possible that the recalls may risk more lives than they save. It is estimated that the additional travel, caused by owners fixing the recalls, causes three to four deaths a year, let alone many injury and non-injury causing accidents. The program is expensive in more ways than just monetarily, and the question of whether or not the safety benefits of the recall program outweigh the costs has been asked, but remains unanswered. The Federal Government refuses to study the issue and claims that the small number of actual facts and the large number of unknown factors make it next to impossible to evaluate the program. With this book Dr. Kevin McDonald evaluates the recall process and starts a discussion on how it might be changed for the better. He discusses the three components of traffic safety in order of importance and how they contribute to automobile accidents: driver safety, roadway safety, and vehicle safety. He also discusses automobile regulation and the three steps that must occur for regulation to take place: public awareness and demand for action, legislation, and continuing administration. He unravels the legislation and litigation that started in 1966 with the creation of NHTSA and continues today, including an exhaustive analysis of the TREAD Act, passed in the wake of the Ford-Firestone recall. Separate chapters are devoted to how the courts have handled recall orders and the recent trend to have courts, not NHTSA, order recalls and how they affect the recall process. Dr. McDonald then compares the current American recall process and its history with the recall processes of several foreign countries with excellent auto safety histories. He gives suggestions for improvement that will allow the recall process to save money and better serve the American public. The book is clear and to the point and will serve as a descriptive resource for all parties, from judges and lawyers to auto designers and mechanics to concerned citizens, interested in traffic safety in America and the auto recall process.

Book excerpt: This dissertation consists of two parts and three essays, the first part (two essays) studies the effects of the National Highway Traffic Safety Administration's (NHTSA) start of a regulatory investigation on the manufacturer's defect investigation and the subsequent automobile recall process of potentially defective automobiles. The first chapter, "Does a Regulator's Investigation Help or Hurt the Manufacturer's Defect Investigation and Recall Outcomes?" documented that, contrary to the general intuition, a regulatory investigation by the NHTSA delays-instead of expedites-the manufacturer's defect investigation and the subsequent recall process. Such observation is inconsistent with the attention-based view of the manufacturing firm, which suggests that a regulatory investigation may divert the manufacturer's attention and delay the latter's investigation. The second chapter is titled "Firm Knowledge Acquisition During a Product Defect Investigation: Determinants and Outcomes." This chapter explores further into the manufacturer's defect investigation, using detailed textual data and novel tools from computational linguistics, explains further why NHTSA's regulatory investigation hurts the manufacturer's defect investigation and recall outcomes. First, we collected the textual data from the auto manufacturer's defect investigation reports, measured each report's lexical diversity, and used this measure to proxy for the degree of the firm's knowledge acquisition during the defect investigation. Second, we show that a manufacturer's knowledge acquisition decreases as the regulatory influence during the investigation increases. And since the acquired knowledge increases the speed of the manufacturer to repair the defective automobiles. Therefore, the higher the regulatory influence, the slower the manufacturer completes the recall. Lastly, the cumulative knowledge acquired over several investigations in a year improves a manufacturer's learning, as manifests in fewer recalls in the following year. Finally, the second part consists of one essay as the last chapter of this dissertation. This chapter explores the properties of a type of non-linear time series econometrics models, based on an extension of the regime-switching model developed by Chang, Choi, and Park (2017), which can be viewed as a general framework that encompasses the two most widely used non-linear models-the threshold model and the regime-switching model. Under this framework, econometricians are able to test which setup of the nonlinear model is more relevant to specific time-series data.
