Book Damage Done The Status of NEPA after Winter v NRDC and Answers to Lingering Questions Left Open by the Court

Download or read book Damage Done The Status of NEPA after Winter v NRDC and Answers to Lingering Questions Left Open by the Court written by William S. Eubanks and published by . This book was released on 2009 with total page 22 pages. Available in PDF, EPUB and Kindle. Book excerpt: In November 2008, the United States Supreme Court decided Winter v. Natural Resources Defense Council, 555 U.S. (2008). At issue in the case were many questions regarding the use of naval sonar and the impacts of that use on marine mammals such as whales and dolphins. The environmental plaintiffs alleged that the Navy violated the National Environmental Policy Act (NEPA) by conducting training exercises without first fully considering the environmental impact of the exercises as required by NEPA. The Court issued an expedited opinion, deciding the case very narrowly on equitable balancing grounds under the unique facts of the case. This narrow decision by the Court left many important legal questions unanswered. This article provides post-Winter guidance to federal courts addressing issues under NEPA where the Supreme Court has not definitively spoken. Specifically, the first portion of this article dissects the Court's irreparable harm analysis in Winter and predicts the effect this standard will have in future NEPA cases. The second portion of this article answers three critical NEPA questions left open by the Winter Court's narrow decision. This section thoroughly analyzes court decisions and other relevant information to provide rational and detailed resolution to these questions in an effort to assist courts confronted with these issues in the future.

Orr, Oberlin College What has been achieved since the National Environmental Policy Act was passed in 1969? Book The National Environmental Policy Act

Download or read book The National Environmental Policy Act written by Matthew J. Ph. D. Lindstrom and published by Texas A&M University Press. This book was released on 2008-04-11 with total page 212 pages. Available in PDF, EPUB and Kindle. Book excerpt: Environmental degradation and the compromised integrity of the earth's ecological system were growing public concerns in the mid to late 1960s. These issues spurred Congress to pass the National Environmental Policy Act of 1969 (NEPA), the first law to focus such environmental concerns into a comprehensive national policy. The new legislation encompassed an array of environmental values and ethics, as well as administrative tools to achieve the ecological goals of the nation while taking into account other important societal needs. Though NEPA has had a positive effect on U.S. environmental policy and the national quality of life, this challenging new book shows how federal courts and agencies have failed to implement many of the values and goals fundamental to the success of NEPA. To explain this divergence, authors Matthew J. Lindstrom and Zachary A. Smith examine NEPA's origins, address how NEPA has been implemented and enforced, and highlight the shortcomings of its practice. Lindstrom and Smith strongly argue that if NEPA were fully and properly implemented, it would prove to be a valuable and realistic tool for balancing the needs of the world population and the protection of the earth's environment. They offer a new, hopeful look at how the law's structure can be properly utilized in order to give future generations hope of living on a sustainable planet. This book is well suited for audiences interested in public policy formation and implementation, especially environmental policy administrators, environmental historians, and those involved in environmental law, its policy, and its politics.
