Contemporary prescriptions for police reform hold that the public would better trust the police and feel a greater obligation to comply and cooperate if police-citizen interactions were marked by higher levels of procedural justice by police. In this book, Robert E. Worden and Sarah J. McLean argue that the procedural justice model of reform is a mirage. From a distance, procedural justice seemingly offers a relief from strained police-community relations. But a closer look at police organizations and police-citizen interactions shows that the relief offered by such reform is, in fact, illusory.

Book excerpt: An empirical study of police shows how value conflicts of democratic society create conditions that undermine the capacity of police to respond to the rule of law. Data for the study were drawn from an examination of criminal law officials in a city of approximately 400,000 with a nonwhite population of about 30 percent. The gathering of data began in the summer of 1962 and extended into the summer of 1963. The city involved is reputed to have an exemplary criminal justice structure. Through a questionnaire and direct observation, patterns of police behavior were examined in a variety of areas of law enforcement, including traffic violations, prostitution, and narcotics. A sketch of the policeman's "working personality" is presented, along with a description of his operational environment and use of discretion. His use of informers is also treated. Police attitudes toward criminal law and views of the exclusionary rule are examined. Facts presented in the study were deemed accurate by all individuals questioned and observed, although there was not always agreement on interpretations given to the data. It is concluded that the tension between the operational goals of order, efficiency, and initiative on the one hand and the protection of the legal rights of individual citizens on the other constitutes the principle problem of police as a democratic legal organization. The appendix includes a brief survey of the character of the city studied, comparative data on the police, a history and organization of the offices of public defender and district attorney in La Loma County, California, and the questionnaire given to the police.

Book excerpt: This report of the President's Commission on Law Enforcement and Administration of Justice -- established by President Lyndon Johnson on July 23, 1965 -- addresses the causes of crime and delinquency and recommends how to prevent crime and delinquency and improve law enforcement and the administration of criminal justice. In developing its findings and recommendations, the Commission held three national conferences, conducted five national surveys, held hundreds of meetings, and interviewed tens of thousands of individuals. Separate chapters of this report discuss crime in America, juvenile delinquency, the police, the courts, corrections, organized crime, narcotics and drug abuse, drunkenness offenses, gun control, science and technology, and research as an instrument for reform. Significant data were generated by the Commission's National Survey of Criminal Victims, the first of its kind conducted on such a scope. The survey found that not only do Americans experience far more crime than they report to the police, but they talk about crime and the reports of crime engender such fear among citizens that the basic quality of life of many Americans has eroded. The core conclusion of the Commission, however, is that a significant reduction in crime can be achieved if the Commission's recommendations (some 200) are implemented. The recommendations call for a cooperative attack on crime by the Federal Government, the States, the counties, the cities, civic organizations, religious institutions, business groups, and individual citizens. They propose basic changes in the operations of police, schools, prosecutors, employment agencies, defenders, social workers, prisons, housing authorities, and probation and parole officers.

On Dec. 7, 2015, Attorney General Lynch announced the investigation into the CPD and the city's Independent Police Review Authority (IPRA). The investigation focused on CPD's use of force, including racial, ethnic and other disparities in use of force, and its systems of accountability.In the course of its pattern or practice investigation, the department interviewed and met with city leaders, current and former police officials, and numerous officers throughout all ranks of CPD. The department also accompanied line officers on over 60 ride-alongs in every police district; heard from over 1,000 community members and more than 90 community organizations; reviewed thousands of pages of police documents, including all relevant policies, procedures, training and materials; and analyzed a randomized, representative sample of force reports and the investigative files for incidents that occurred between January 2011 and April 2016, including over 170 officer-involved shooting investigations and documents related to over 400 additional force incidents.The department found that CPD's pattern or practice of unconstitutional force is largely attributable to deficiencies in its accountability systems and in how it investigates uses of force, responds to allegations of misconduct, trains and supervises officers, and collects and reports data on officer use of force. The department also found that the lack of effective community-oriented policing strategies and insufficient support for officer wellness and safety contributed to the pattern or practice of unconstitutional force.In addition, the department also identified serious concerns about the prevalence of racially discriminatory conduct by some CPD officers and the degree to which that conduct is tolerated and in some respects caused by deficiencies in CPD's systems of training, supervision and accountability. The department's findings further note that the impact of CPD's pattern or practice of unreasonable force falls heaviest on predominantly black and Latino neighborhoods, such that restoring police-community trust will require remedies addressing both discriminatory conduct and the disproportionality of illegal and unconstitutional patterns of force on minority communities.Similar to recent Justice Department reports into police brutality and misconduct in Ferguson, Missouri, and Baltimore, Maryland, this book traces the long history of police abuse (and failures of leadership, for decades) to the present day, in an attempt to make sense of the outbreak of violence--and to explain the basis for new, enforceable actions the police department must take in order to change.

Book excerpt: Injury and death from use of excessive force by police officers remain a common concern in countries across the globe. Despite local, national, and international attempts to legislate and provide guidance for police use of force, there continue to be global accounts of excessive force by law enforcement. Reports of officer-involved killings, injuries to citizens, and attempts to control protests and demonstrations with chemical irritants, rubber bullets, and sometimes shooting into crowds with live ammunition frequently appear in the press worldwide. However, reliable data on and accounting for these incidents are both lacking. A large network of international and regional organizations, bilateral donors, international financial institutions, and civil society organizations aim to work with governments to improve policing practices and reduce police use of excessive force. As a part of that network, the U.S. Department of State, through its Bureau of International Narcotics and Law Enforcement Affairs (INL), provides foreign assistance to and supports capacity building for criminal justice systems and police organizations in approximately 90 countries. Like many donors, it strives to direct its resources to the most effective approaches to achieve its mission. Policies and Practices to Minimize Police Use of Force Internationally, the third in a series of five reports produced for the INL, addresses what policies and practices for police use of force are effective in promoting the rule of law and protecting the population (including the officers themselves). This report looks at what is known about effective practices and their implementation and identifies promising actions to be taken by international donors in their efforts to strengthen the effectiveness of law enforcement agencies.
