Book Challenges to Religious Liberty in the Twenty First Century

Download or read book Challenges to Religious Liberty in the Twenty First Century written by Gerard V. Bradley and published by Cambridge University Press. This book was released on 2012-03-12 with total page 231 pages. Available in PDF, EPUB and Kindle. Book excerpt: Almost everyone today affirms the importance and merit of religious liberty. But religious liberty is being challenged by new questions (for example, use of the niqab or church adoption services for same-sex couples) and new forces (such as globalization and Islamism). Combined, these make the meaning of religious liberty in the twenty-first century uncertain. This collection of essays by ten of the world's leading scholars on religious liberty takes aim at these issues. The book is arranged around five specific challenges to religious liberty today: the state's responsibility to prevent coercion and intimidation of believers by others within the same faith community; the US's basic moral responsibilities to promote religious liberty abroad; how to understand and apply the traditional right of conscientious objection in today's circumstances; the distinctive problems presented by globalization; and the viability today of an 'originalist' interpretation of the First Amendment religion clauses.

Book Beyond Establishment

    Book Details:
  • Author : Jonathan Chaplin
  • Publisher : SCM Press
  • Release : 2022-05-31
  • ISBN : 033406175X
  • Pages : 137 pages

Download or read book Beyond Establishment written by Jonathan Chaplin and published by SCM Press. This book was released on 2022-05-31 with total page 137 pages. Available in PDF, EPUB and Kindle. Book excerpt: The Church of England finds itself colliding with society at large on regular occasion. Has the time come, therefore, where the advantages of being the established church are at last outweighed by the disadvantages? Is there a case for disestablishment, and if so, what might a fresh vision of the church’s relationship with wider society be? Separating the question of establishment, from the question of presence in the community, Jonathan Chaplin argues that the time has come for the ending of privileged constitutional ties between the Church of England the British state. Rather than offering a smaller place for the Church of England within society, he suggests, such a separation would in fact enhance its ability to maintain an embedded presence in local parishes, and allow it the room to speak out about the deeper, bigger challenges which face society today.

Book The Hollow Core of Constitutional Theory

Download or read book The Hollow Core of Constitutional Theory written by Donald L. Drakeman and published by Cambridge University Press. This book was released on 2021-04-08 with total page 247 pages. Available in PDF, EPUB and Kindle. Book excerpt: The Hollow Core of Constitutional Theory is the first major defense of the central role of the Framers' intentions in constitutional interpretation to appear in years. This book starts with a reminder that, for virtually all of Western legal history, when judges interpreted legal texts, their goal was to identify the lawmaker's will. However, for the past fifty years, constitutional theory has increasingly shifted its focus away from the Framers. Contemporary constitutional theorists, who often disagree with each other about virtually everything else, have come to share the view that the Framers' understandings are unknowable and irrelevant. This book shows why constitutional interpretation needs to return to its historical core inquiry, which is a search for the Framers' intentions. Doing so is practically feasible, theoretically defensible, and equally important not only for discovering the original meaning, but also for deciding how to apply the Constitution today.
