Book New Financing for Distressed Businesses in the Context of Business Restructuring Law

Download or read book New Financing for Distressed Businesses in the Context of Business Restructuring Law written by Sanford U. Mba and published by Springer. This book was released on 2019-06-29 with total page 291 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book focuses on the restructuring of distressed businesses, emphasizing the need for new financing during the restructuring process as well as during relaunch, and examines the role of law in encouraging creditor confidence and incentivizing lending. It describes two broad approaches to encouraging new finance during restructuring: a prescriptive one that seeks to attract credit using expressly defined statutory incentives, and a market-based one that relies on the business judgment of lenders against the backdrop of transaction avoidance rules. Securing new financing for a distressed business is a critical part of successful restructuring. Without such financing, the business may be unable to meet interim liquidity constraints, or to implement its restructuring plans. This book addresses related questions concerning the place of new financing as an essential component of restructuring. In general terms, the book explores how statutory interventions and the courts can provide support with contentious issues that arise from the provision of new financing, whether through new financing agreements or through distressed debt investors, who are increasingly gaining prominence as sources of new financing for distressed businesses. It argues that courts play a key part in preventing or correcting the imbalances that can arise from the participation of distressed debt investors. In this context, it critically examines the distressed debt market in emerging markets like Nigeria and the opportunity presented by non-performing loans, arguing that the regulatory pattern of market entry may dis-incentivize distress debt investing in a market that is in dire need of financing. The book offers a fresh and comparative perspective on restructuring new financing for distressed businesses by comparing various approaches (primarily from the US, UK and Germany) and drawing lessons for frontier markets, with particular reference to Nigeria. It fills an important gap in international comparative scholarship and discusses a living problem with both empirical and policy aspects.

Book Law and the Economy in a Young Democracy

Download or read book Law and the Economy in a Young Democracy written by Tirthankar Roy and published by University of Chicago Press. This book was released on 2022-02-08 with total page 309 pages. Available in PDF, EPUB and Kindle. Book excerpt: "Tirthankar Roy and Anand V. Swamy trace India's economic growth since 1947 and the legal reforms that have allowed it to settle in, however unevenly and tenuously, in the shadow of the stagnating effects of colonial rule. Law and the Economy in a Young Democracy portrays a long shadow of Indian "path dependence"-the persistence of colonial-era legal practices and institutions-interrupted by a series of reactive, dramatic departures from colonial inertia aimed at achieving quick or corrective growth and regulation. Roy and Swamy address five principal questions: How have new laws emerged in India? Does the explanation lie with colonialism or with post-independence politics and economic change? How were laws shaped by egalitarian goals in the Indian democracy with its universal adult suffrage? When did laws constrain economic growth? And to what extent did case law and legislation affect the evolution of law, which was also shaped by politics and the quality of legal infrastructure? Each of these questions brings together different threads of India's economic transformation and social/political history, and the format allows the authors to go deep on the country's most important market sectors and their surrounding economic and political histories. These sections include: colonialist influences on laws governing land and natural resources; politics and labor; and the alternating stifling effects of the country's economic policies and legal systems. In Roy and Swamy's telling, inadequate legal infrastructure has often been the country's primary impediment to economic growth during the last century, and it remains a primary reason that India's future may not be as bright as advertised"--

Book Talbot Mundy Philosopher of Adventure

Download or read book Talbot Mundy Philosopher of Adventure written by Brian Taves and published by McFarland. This book was released on 2014-11-26 with total page 312 pages. Available in PDF, EPUB and Kindle. Book excerpt: This critical biography chronicles both the actual travels and the philosophical meanderings of Talbot Mundy, one of the pioneers of the fantasy and adventure genre. Less celebrated than his contemporaries Rudyard Kipling and Joseph Conrad, Mundy was no less gifted when it came to the literary portrayal of faraway lands. He was one of the first Western writers to show an appreciation of Eastern culture, and his writing became an outlet for his radical ideas on religion and philosophy. At the age of sixteen, Mundy left his native England to begin his life of adventure--a journey that took him from India to the Middle East to Tibet and finally to America, which became his adopted home. The American spirit of adventure matched Mundy's own, and it was here that he found a true audience for his work. This book explores Mundy's oeuvre--much of it set in exotic locales through which he himself had traveled--and considers both his novels and his lesser known writing, as well as his film and radio work. Books such as Rung Ho!, King-of the Khyber Rifles, Caves of Terror, Purple Pirate and Tros of Samothrace are discussed and placed within the framework of Mundy's life and philosophy. The final chapter evaluates the enduring value of his writings. Appendices include a comprehensive list of Mundy's works and a chronological listing by their original publication dates.
