Book excerpt: Economic theory shows that mobility of the factors of production contributes to an efficient economy. The Framers of the Canadian Constitution provided for a common market and customs union in the British North America Act, 1867 (now the Constitution Act, 1867) and more particularly in section 121 of that Act. Their model does not fully meet the needs of the evolving Canadian federation. The failure of the federal and provincial governments to achieve an integrated economic association has been well documented. This study examines the constitutional structure upon which the mobility rights of Canadians are built and some of the existing impediments to the full exercise of those rights. It considers the arguments for and against enhanced mobility, explores the lessons provided by other jurisdictions and judicial interpretation of section 6 of the Canadian Charter of Rights and Freedoms.

Book excerpt: The mobility rights provisions under section 6 of the Canadian Charter of Rights and Freedoms, require the courts to adjudicate between the interests of the community at large and those of smaller provinces or regions. This article explores the constitutional background and political context in which section 6 was introduced; the treatment of mobility rights in Australia and the United States; the specific language of section 6; and its judicial reception to date. The article suggest that the long-term impact of section 6 will depend on how widely the right, and how narrowly the internal limitations on the right, are interpreted by the courts. The article concludes that assessing section 1 justifications for section 6 violations is an inherently political exercise; requiring the courts to balance competing evidence, opinions and values concerning the benefits of an economic union and of maintaining regional diversity and autonomy.

Book excerpt: The standard story in public policy and constitutional circles on the relationship between the Constitution and the Canadian Economic Union is a story of constitutional failure: that the Constitution has proven to be ineffective at furthering the integration of the Canadian economy. As a consequence, securing this goal requires either constitutional amendment or, in the face of the impossibility of large-scale constitutional change, the use of non-constitutional policy instruments such as the Agreement on Internal Trade (AIT), an intergovernmental agreement designed to remove barriers to interprovincial economic mobility. In this paper, I challenge this view. My argument is that constitutional litigation under the Canadian Charter of Rights and Freedom's mobility rights provisions can serve as an effective alternative to the various mechanisms (adjudication and negotiation) established under the AIT to further the integration of the Canadian economy. Moreover, I suggest how constitutional litigation can actually strengthen the AIT, rather than simply serve as an alternative to it.

Book excerpt: Federalism is about dividing and sharing government, often in complex ways that involve some tasks being done jointly. Are federal systems capable of effective joint policy-making? Is this possible in the fast-moving context of globalization? In Market Rules Douglas Brown examines these questions through a comparative study of Australia and Canada, looking at recent major reforms to the economic union in the two federations and comparing them with the evolving European Union (EU). Brown argues that internal barriers to trade and competition in these countries were significant obstacles to competition in the global economy and shows that the old market rules were rooted in longstanding political and regional compromises. He describes the process of detailed and difficult intergovernmental collaboration required for the EU, and now Canada and Australia, to produce new market rules. The resulting reforms created new regimes that provide deeper and broader national economic integration in Canada and Australia than in the EU. The new rules entrench neo-liberal values, retaining some room for diversity and flexibility for equity goals.
