Download or read book Minority Rights in Kosovo under International Rule written by Clive Baldwin and published by Minority Rights Group. This book was released on 2006-07-06 with total page 40 pages. Available in PDF, EPUB and Kindle. Book excerpt: After seven years of international administration – the longest and most expensive since the creation of the UN – Kosovo remains one of the most segregated places in Europe, with thousands of displaced persons still in camps, and many ‘ethnically pure’ towns and villages. The report discusses the failure on the part of the international protectorate to learn lessons from the past and to draw on the minority rights expertise available within the UN and other bodies. It shows how decision-makers have been unaccountable, and how the Constitutional Framework they have produced treats minority rights in a way that encourages segregation rather than integration. As the future status of Kosovo is negotiated, the report calls for radical change away from the acceptance of patterns of segregation that lead to ethnic cleansing and towards minority rights guaranteed by the rule of law. The report is essential reading for all those interested in understanding Kosovo and how to create a more hopeful future there, while its analysis also holds lessons for those working for the effective implementation of minority rights in other contexts.

This book was released on 2000-10-19 with total page 380 pages. Available in PDF, EPUB and Kindle. Book excerpt: The war in Kosovo was a turning point: NATO deployed its armed forces in war for the first time, and placed the controversial doctrine of 'humanitarian intervention' squarely in the world's eye. It was an armed intervention for the purpose of implementing Security Council resolutions-but without Security Council authorization. This report tries to answer a number of burning questions, such as why the international community was unable to act earlier and prevent the escalation of the conflict, as well as focusing on the capacity of the United Nations to act as global peacekeeper. The Commission recommends a new status for Kosovo, 'conditional independence', with the goal of lasting peace and security for Kosovo-and for the Balkan region in general. But many of the conslusions may be beneficially applied to conflicts the world-over.

Download or read book Filling the Vacuum written by Georgina Stevens and published by Minority Rights Group. This book was released on 2009-05-26 with total page 44 pages. Available in PDF, EPUB and Kindle. Book excerpt: Since Kosovo’s declaration of independence on 17 February 2008, there has been a vacuum in effective international protection for minorities in Kosovo. A lack of certainty over the status of the territory has limited the practical application of international human rights law. There is a danger that the new international organizations operating in Kosovo will compound the failure of the United Nations’ Mission in Kosovo to ensure a tolerant, multi-ethnic society in which equality, non-discrimination and the rights of minority groups are protected. Under an international protectorate since 1999, Kosovo has suffered engrained hostility between ethnic Albanian and Serb communities and continued segregation. Restriction of movement and political, social and economic exclusion are particularly experienced by the smaller minority groups, as well as by Serbs and Albanians living outside the main areas of population of their respective communities. A lack of political will among majority Albanians and poor investment in protection mechanisms have resulted in minority rights being eroded or compromised. Smaller minority communities have yet to see resolution or redress for oppression and human rights violations faced due to events since the late 1990s. This report discusses the various minority groups in Kosovo, and each group’s current major issues of concern. It gives an account of pre-independence legal remedies for minorities and looks at how best to protect the rights of Kosovo’s minorities in the current transition period, including the role of the new EU Rule of Law Mission and the International Civilian Representative. Finally, the report offers a set of concrete recommendations to improve realization of minority rights in Kosovo.

Download or read book State of the World s Minorities and Indigenous Peoples 2016 written by Peter Grant and published by Minority Rights Group. This book was released on 2016-07-12 with total page 112 pages. Available in PDF, EPUB and Kindle. Book excerpt: The unique cultures of minorities and indigenous peoples worldwide – spanning a wide variety of customs and practices – are under threat. This year’s edition of State of the World’s Minorities and Indigenous Peoples highlights the impact of land dispossession, forced assimilation and other forms of discrimination on the most fundamental aspects of their identity, including language, art, traditional knowledge and spirituality. But while the effects of this attrition can be devastating, minority and indigenous cultures have also been critical in strengthening communities and providing activists with a platform to fight for their rights. As this volume illustrates, ensuring that the cultural freedoms of minorities and indigenous peoples are protected is essential if their other rights are also to be respected.

Book excerpt: The protection of national minorities is a core issue for the Council of Europe, and one of the major achievements in this field is the Framework Convention for the Protection of National Minorities. The entry into force of the Framework Convention on 1 February 1998 was indeed an event of universal stature, for it is the first ever legally binding multilateral instrument devoted to the protection of national minorities in general. Its importance is widely acknowledged, and the number of ratifications has grown rapidly. Simultaneously, an emphasis is being placed on the implementation and on the efficient functioning of the monitoring mechanism of the Framework Convention. This collection provides all those interested in the protection of national minorities a user-friendly compilation of the basic texts concerning the Framework Convention. In addition to the Framework Convention and its explanatory memorandum, the collection contains texts pertaining to the monitoring mechanism in general and the Advisory Committee in particular. It further provides the state of signatures and ratifications as well as declarations and reservations. It also contains a list of State Reports received and Opinions of the Advisory Committee adopted under both the first and second cycles of monitoring.

Download or read book Protecting Minority Rights in African Countries written by John M. Mbaku and published by Edward Elgar Publishing. This book was released on 2018-01-26 with total page 419 pages. Available in PDF, EPUB and Kindle. Book excerpt: In this enlightening book, John Mukum Mbaku analyses the main challenges of constitutional design and the construction of governance institutions in Africa today. He argues that the central issues are: providing each country with a constitutional order that is capable of successfully managing sectarian conflict and enhancing peaceful coexistence; protecting the rights of citizens ? including those of minorities; minimizing the monopolization of political space by the majority (to the detriment of minorities); and, effectively preventing government impunity. Mbaku offers a comprehensive analysis of various approaches to the management of diversity, and shows how these approaches can inform Africa?s struggle to promote peace and good governance. He explores in depth the existence of dysfunctional and anachronistic laws and institutions inherited from the colonial state, and the process through which laws and institutions are formulated or constructed, adopted, and amended. A close look at the constitutional experiences of the American Republic provides important lessons for constitutional design and constitutionalism in Africa. Additionally, comparative politics and comparative constitutional law also provide important lessons for the management of diversity in African countries. Mbaku recommends state reconstruction through constitutional design as a way for each African country to provide itself with laws and institutions that reflect the realities of each country, including the necessary mechanisms and tools for the protection of the rights of minorities. From students and scholars to NGOs, lawyers and policymakers, this unique and judicious book is an essential tool for all those seeking to understand and improve governance and development in Africa.
Download or read book Equality of Opportunity for Sexual and Gender Minorities written by John Arzinos and published by World Bank Publications. This book was released on 2021-12-02 with total page 182 pages. Available in PDF, EPUB and Kindle. Book excerpt: Despite legal and social advances in the past two decades, sexual and gender minorities continue to face widespread discrimination and violence in many countries. This discrimination and violence lead to exclusion, which adversely impacts their lives, as well as the communities and economies in which they live. A major barrier to addressing this stigma and sexual orientation and gender identity(SOGI)-based exclusion is the lack of SOGI-specific data. Robust, quantitative data on di‚fferential development experiences and outcomes of sexual and gender minorities--especially those in developing countries--is extremely thin. This paucity of data jeopardizes the achievement of the Sustainable Development Goals and countries' commitment to the principle of 'leaving no one behind' in the eff‚ort to end poverty and inequality. 'Equality of Opportunity for Sexual and Gender Minorities' assesses the unique challenges that sexual and gender minorities face in six important areas: (i) Criminalization and SOGI (ii) Access to education (iii) Access to the labor market (iv) Access to public services and social protection (v) Civil and political inclusion (vi) Protection from hate crimes. This report cov‚ers numerous policy recommendations to prevent and eliminate discriminatory practices in all of the areas covered. It also seeks to inflŽuence legislative changes and support research on institutions and regulations that can ultimately lead to poverty reduction and shared prosperity. At the same time, it acknowledges that the mere existence of inclusive laws and regulations does not ensure that sexual and gender minorities are free from discrimination--the enforcement of those laws is crucial. This publication, the first in a series of studies, will be expanded from the 16 countries included here to a wider set of countries for more in-depth quantitative analysis and to identify possible correlations with socioeconomic outcomes. It will seek to deepen knowledge, facilitate peer learning of good practices, and encourage reforms to increase the inclusion of sexual and gender minorities.
Download or read book Kosovo Divided written by Marius-Ionut Calu and published by Bloomsbury Publishing. This book was released on 2020-04-02 with total page 265 pages. Available in PDF, EPUB and Kindle. Book excerpt: Given the recent revival of nationalism in many parts of the world in tandem with new conflicts and forms of interventionism, this book uses the case of Kosovo to discuss some of key problems around contemporary practices of state-building. Based on exhaustive research and fieldwork, Marius Calu investigates how the management of plurality is a fundamental element of contemporary state-building seeking to build social cohesion, while for the new-born Kosovo it stands as vital symbol for its domestic sovereignty and legitimisation. With the aim of understanding why and in what ways the management of diversity has become a central element of state-building in post-conflict Kosovo, this study juxtaposes the de jure multi-ethnic liberal democratic form of governance with the de facto results and consequences of Kosovo's task to protect, accommodate and integrate its ethnic minorities.
