Book excerpt: La investigación cubre algunos de los aspectos más sensibles de la tensa relación ente la protección del medio ambiente y la actividad minera, en el marco general de la obra Minería y desarrollo. El análisis comienza por reconocer los múltiples conflictos que dicha relación sugiere, y ahonda en el estudio de los instrumentos que el ordenamiento jurídico ha desarrollado ya sea para prevenir las consecuencias negativas derivadas del desarrollo de la actividad minera o para definir las consecuencias de la acción antijurídica. Del mismo modo, este texto estudia desde múltiples perspectivas la forma como se han transformado los instrumentos económicos, financieros, de mercado y fiscales ante la necesidad de salvaguardar el patrimonio natural. Así las cosas, el estudio de la actividad minera, como el lector podrá reconocer a lo largo de este texto, se realiza sobre la base de dos pilares fundamentales a saber: el medio ambiente y el desarrollo sostenible. El primero, entendido de conformidad con lo determinado por la Ley 23 de 1973 y por el Decreto ley 2811 de 1974, es decir, como un patrimonio común cuyo mejoramiento y conservación son actividades de utilidad pública e interés social que exigen la participación del Estado y de los particulares. El segundo, el desarrollo sostenible, es entendido desde la concepción basal propuesta por el informe "Nuestro Futuro Común" como aquel que permite la satisfacción de las necesidades presentes sin comprometer la de las futuras generaciones. Sobre estas bases desarrollaremos algunas reflexiones preliminares que permitirán comprender el contexto de la obra.

Vulnerable to a host of changing conditions in this global era, forests are in peril as never before. New markets in carbon and environmental services attract speculators. In the name of conservation, such speculators attempt to undermine local land control in these desirable areas. Moral Ecology of a Forest provides an ethnographic account of conservation politics, particularly the conflict between Western conservation and Mayan ontological ecology. The difficult interactions of the Maya of central Quintana Roo, Mexico, for example, or the Mayan communities of the Sain Ka’an Biosphere, demonstrate the clashing interests with Western biodiversity conservation initiatives. The conflicts within the forest of Quintana Roo represent the outcome of nature in this global era, where the forces of land grabbing, conservation promotion and organizations, and capitalism vie for control of forests and land. Forests pose living questions. In addition to the ever-thrilling biology of interdependent species, forests raise questions in the sphere of political economy, and thus raise cultural and moral questions. The economic aspects focus on the power dynamics and ideological perspectives over who controls, uses, exploits, or preserves those life forms and landscapes. The cultural and moral issues focus on the symbolic meanings, forms of knowledge, and obligations that people of different backgrounds, ethnicities, and classes have constructed in relation to their lands. The Maya Forest of Quintana Roo is a historically disputed place in which these three questions come together.
