Order (MO) authorizing trial by mil. commission (MC) of certain non-citizens suspected of participating in the war against terrorism. The Supreme Court struck down MC established pursuant to the MO. To permit MC to go forward, Congress approved the MC Act of 2006 (MCA). After taking office, Pres. Obama took action to suspend the operation of MC pending a review of all Guantanamo detentions for the purpose of assessing options for the lawful disposition of each detainee. This report provides a background and analysis of MC rules under the MCA. It reviews the history of the implementation of MC in the ¿global war on terrorism¿ and provides an overview of the procedural safeguards provided in the MCA.

[...] The Military Commissions Act of 2006 In response to the Hamdan decision, Congress enacted the Military Commissions Act of 2006 ("MCA") to grant the President express authority to convene military commissions to prosecute those fitting the definition under the MCA of "alien unlawful enemy combatants.". [...] Procedures for assigning military judges as well as the particulars regarding the duties they are to perform are left to the Secretary of Defense to prescribe, except that the military judge may not be permitted to consult with members of the panel outside of the presence of the accused and counsel except as prescribed in 10 U.S. [...] The military judge has the authority to decide matters related to the admissibility of evidence, including the treatment of classified information, but has no authority to compel the government to produce classified information.

Military commissions pursuant to the M.O. began in November 2004 against four persons declared eligible for trial, but the Supreme Court in Hamdan v. Rumsfeld invalidated the military commissions as improper under the Uniform Code of Military Justice (UCMJ). To permit military commissions to go forward, Congress approved the Military Commissions Act of 2006 (MCA), conferring authority to promulgate rules that depart from the strictures of the UCMJ and possibly U.S. international obligations. Military commissions proceedings were reinstated and resulted in three convictions under the Bush Administration.

Book excerpt: Today, the Secretary of Defense is submitting to Congress a comprehensive Manual for the full and fair prosecution of alien unlawful enemy combatants by military commissions, in accordance with the Military Commissions Act of 2006. The Manual is made up of four separate sections: The Preamble, The Rules for Military Commissions, the Military Commission Rules of Evidence, and the Crimes and Elements. The Rules for Military Commissions set forth the procedural rules for Military Commissions. The Military Commission Rules of Evidence provide evidentiary rules to govern the admissibility of evidence at trial. The Crimes and Elements section lays out the crimes punishable by Military Commission and the elements of those crimes. This Manual is the product of a tremendous interagency effort. Principally military judge advocates and attorneys from the Departments of Defense and Justice, using the Manual for Courts-Martial as a guide, undertook the initial drafting. Drafts were then coordinated with other relevant agencies to ensure that specific rules and procedures reflect careful consideration of our nation's intelligence activities, as called for in the MCA. The overriding considerations reflected in the Manual for Military Commissions are fairness and fidelity to the Military Commissions Act of 2006. It is intended to ensure that alien unlawful enemy combatants who are suspected of war crimes and certain other offenses are prosecuted before regularly constituted courts affording all the judicial guarantees which are recognized as indispensable by civilized people. This Manual will have an historic impact for our military and our country.

These include the various bill versions, the congressional debate over its habeas corpus provisions and hearings held by the Senate Judiciary Committee and the House and Senate Armed Services Committee, and President Bush's messages to Congress relating to the military commissions, all of which reflect the heated debate over national security and constitutional rights.
