Book Military Activities in the Exclusive Economic Zone Preventing Uncertainty and Defusing Conflict

Download or read book Military Activities in the Exclusive Economic Zone Preventing Uncertainty and Defusing Conflict written by and published by . This book was released on 2002 with total page 50 pages. Available in PDF, EPUB and Kindle. Book excerpt: This article examines the issue of military activities in the Exclusive Economic Zone from various perspectives: from the perspective of customary international law versus the United Nations Convention on the Law of the Sea; and from the perspective of coastal nations versus maritime nations. This article suggests that to depend only on the dispute resolution mechanisms of the Law of the Sea Convention is to invite ongoing strife as these mechanisms cannot adequately address military activities in the EEZ. It argues for continued international dialogue as a primary means to resolve these issues and suggests that the maritime nations, especially the United States, focus more intently on developing useful modalities to better establish that the balance of rights in the EEZ encompasses military activities in the EEZs of coastal States.

Book Exclusive Economic Zone EEZ Regime in East Asian Waters

Download or read book Exclusive Economic Zone EEZ Regime in East Asian Waters written by Fang Yang and published by . This book was released on 2010 with total page 24 pages. Available in PDF, EPUB and Kindle. Book excerpt: Military and intelligence-gathering activities, MSR and hydrographic surveys in an EEZ are problematic and controversial issues. There are at least two reasons for this situation. Firstly, the unresolved territorial and maritime boundary disputes mean that jurisdiction over an EEZ may be unclear. States may conduct all kinds of military operations and marine researcdh in areas that might be claimed by other states. Secondly, some of the key terms and key expressions to define and regulate these activities under the United Nations Convention on the Law of the Sea (UNCLOS) are ambiguous. This creates opportunities for countries to interpret UNCLOS for their own interest. In the past few years, some actual incidents have shown conflicts of interest between different countries. This paper discusses the nature of these conflicts and the main concerns of the opposing parties.

Book excerpt: The Free Sea offers a unique, single-volume analysis of incidents in American history that affected U.S. freedom of navigation at sea. The book spans more than 200 years, beginning in the Colonial era with the Quasi-War with France in 1798 and extending to contemporary Freedom of Navigation operations in the South China Sea. Through wars and numerous crises with North Korea, North Vietnam, Cambodia, Iran, Russia and China, freedom of navigation has been a persistent challenge for the United States, a nation reliant on open seas for economic prosperity, military security and global order. This volume focuses on the struggle to retain freedom of the seas. Challenges to U.S. warships and maritime commerce have pushed, and continue to challenge, the United States to vindicate its rights through diplomatic, legal, and military means, underscoring the need for the strategic resolve in the global maritime commons.

Book Unresolved Issues And New Challenges to the Law of the Sea

Download or read book Unresolved Issues And New Challenges to the Law of the Sea written by Anastasia Stratē and published by Martinus Nijhoff Publishers. This book was released on 2006 with total page 371 pages. Available in PDF, EPUB and Kindle. Book excerpt: This work analyzes the management of shared fish stocks; protection of the underwater cultural heritage; the possibilities of establishing marine protected areas and other means for safeguarding vulnerable marine ecosystems; the use of the high seas for intelligence as well as recent developments on interdiction of vessels on the high seas. Special emphasis is paid to the role of international courts and tribunals in the progressive development of the law of the sea as well as the ability of the UN Convention on the Law of the Sea to accommodate new uses and challenges, such as new concerns, new technological possibilities, in particular, new contexts and functions of established rules. The 1982 Convention seems capable of coping with most of them, although it remains useful to explore its possibilities and limits. This work, covering many aspects, will be useful to anyone interested in the law of the sea.
