Download or read book Michigan Evidence Courtroom Manual written by Lawrence A. Dubin and published by LexisNexis. This book was released on 2021-06-18 with total page 728 pages. Available in PDF, EPUB and Kindle. Book excerpt: Designed specifically for trial use, Michigan Evidence Courtroom Manual's purpose is to provide fast, concise, and authoritative answers to most of the evidentiary questions which arise in the course of trials and hearings, as well as in trial preparation. It accomplishes this through a unique combination of trial-tested features, including: • Rules: The complete rules are collected at the beginning of the book. Individual rules are also at the beginning of the chapter in which the rule is discussed. • Commentary: Perhaps the most important part of this book, the author's Commentary provides a quick overview of the rule under discussion, guidance in interpreting the rule, and helpful pointers for applying the rule in actual practice. In many chapters the Commentary contains special features such as Illustrations, Constitutional Considerations, and Current Trends. • Authority: Following each chapter's Commentary, additional authorities are cited. These give the user a starting point for additional research. • Comparison to Federal Rule: A brief comparison of the Michigan and federal rules in each chapter provides additional insight. • Cases: Recent significant cases are summarized at the end of each chapter. These provide support for argument and decisions required during the course of proceedings.

Book excerpt: Laughing Whitefish is an engrossing trail drama of ethnic hostility and the legal defense of Indian treaties. Young Lawyer William (Willy) Poe puts out a shingle in Marquette, Michigan, in 1873, hoping to meet a woman who will take him seriously. His first client, the alluring Charlotte Kawbawgam, known as Laughing Whitefish, offers an enticing challenge—a compelling case of injustice at the hands of powerful mining interests. Years earlier, Charlotte's father led the Jackson Mining Company to a lucrative iron ore strike, and he was then granted a small share in the mine, which the new owners refuse to honor. Willy is now Charlotte's sole recourse for justice. Laughing Whitefish is a gripping account of barriers between Indian people and their legal rights. These poignant conflicts are delicately wrought by the pre-eminent master of the trial thriller, the best-selling author of Anatomy of a Murder. This new edition includes a foreword by Matthew L.M. Fletcher, Director of the Indigenous Law and Policy Center at Michigan State University, that contextualizes the novel and actual decisions of the Michigan Supreme Court ruling in favor of Charlotte.

Book The Supreme Court and the NCAA

  • Author : Brian Porto
  • Publisher : University of Michigan Press
  • Release : 2012-01-03
  • ISBN : 047202809X
  • Pages : 378 pages

Download or read book The Supreme Court and the NCAA written by Brian Porto and published by University of Michigan Press. This book was released on 2012-01-03 with total page 378 pages. Available in PDF, EPUB and Kindle. Book excerpt: Two Supreme Court decisions, NCAA v. Board of Regents (1984) and NCAA v. Tarkanian (1988), have shaped college sports by permitting the emergence of a supercharged commercial enterprise with high financial stakes for institutions and individuals, while failing to guarantee adequate procedural protections for persons charged with wrongdoing within that enterprise. Brian L. Porto examines the conditions that led to the cases, the reasoning behind the justices' rulings, and the consequences of those rulings. Arguing that commercialized college sports should be compatible with the goals of higher education and fair to all participants, Porto suggests that the remedy is a federal statute. His proposed College Sports Legal Reform Act would grant the NCAA a limited "educational exemption" from the antitrust laws, enabling it to enhance academic opportunities for athletes. The Act would also afford greater procedural protections to accused parties in NCAA disciplinary proceedings. Porto's prescription for reform in college sports makes a significant contribution to the debate about how best to address perennial problems in college sports such as cost containment, access to a meaningful education for athletes, and fairness in rule enforcement.
