Book excerpt: Some seventy-five years after the boundaries of the British Mandate for Palestine were set, the State of Israel still lacks a defined territory and agreed-upon boundaries, except for its boundary with Egypt. This book examines this unusual situation, concentrating especially on the perceptions of territory and boundaries within the Zionist movement. Galnoor discusses the period from the first territorial decision in 1919 up to the establishment of the State of Israel in 1948, placing special emphasis on the relatively unknown Zionist, Palestinian, and Arab positions regarding territorial partition in 1937. And he argues that although dramatic changes have occurred in the international and regional arena, the partners to the conflict, the security considerations, and the international dilemmas, the 1937 decision contained the parameters of the choices that have confronted Arab and Israeli leaders ever since. His findings are of direct relevance to the ongoing Arab-Israeli peace negotiations, which once again revolve around the trade-off between national goals and territorial aspirations.

Book excerpt: In 1947, Arabs made up two-thirds of the population of Palestine, and they owned most of its cultivable land. Why then, did they "lose" their homes and land to a relatively small Jewish community just emerging from the shocks of World War II? Did the Palestinians "lose" their homeland because they were backward, primitive, and reactionary? Or was Israel the product of persistent victimization of Palestinian Arabs by an imperialist power which supported Zionist colonization? Did the Palestinians sell each other out? Or were they helpless sufferers in the face of a sophisticated enemy with endless resources? Too often discussions of Palestine are couched in such rhetorical language, based on the assumption that either Jews or Arabs are morally to blame for historical realities. This study seeks to go beyond attributions of responsibility to investigate the concrete conditions which determined and limited Palestinian Arab actions between 1920 and 1948. It was during that period, while Great Britain governed the area under a League of Nations mandate, that Palestine both emerged and disappeared as a modern political entity. Many studies of Palestinian Arab nationalism have looked to Zionism as the primary agent of change in the region. Miller assumes the impact of Jewish settlement but goes beyond these earlier studies to explore the way in which policies of the Palestine government affected the daily lives of villagers—the majority of the population—and their understanding of the changes occurring around them. In this way, what emerges is a detailed analysis of the influence, for good or ill, that government policy had on village community life. Based largely on archival sources never before used, this work allows the reader to gain a deeper appreciation of the internal life of the rural community, which had previously received relatively little attention. Understanding the experiences of Palestinians before 1948 helps us to comprehend immeasurably better the continuity of movements for Palestinian statehood as well as the continuing tensions and problems on the West Bank today.

Book excerpt: In this book, Martin Bunton focuses on the way in which the Palestine Mandate was part of a broader British imperial administration - a fact often masked by Jewish immigration and land purchase in Palestine. His meticulous research reveals clear links to colonial practice in India, Sudan, and Cyprus amongst other places. He argues that land officials' views on sound land management were derived from their own experiences of rural England, and that this was far more influential on the shaping of land policies than the promise of a Jewish National Home. Bunton reveals how the British were intent on preserving the status quo of Ottoman land law, which (when few Britons could read Ottoman or were well grounded in its legal codes) led to a series of translations, interpretations, and hence new applications of land law. The sense of importance the British attributed to their work surveying and registering properties and transactions, is captured in the efforts of British officials to microfilm all of their records at the height of the Second World War. Despite this however, land policies remained in flux.

Accordingly, the legal origin of Palestinian nationality lies in this nearly thirty-year period as the status of Palestinians has never been settled since. Hence, any legal consideration on the future status of individuals who once held Palestinian nationality should start from the point at which the British rule over Palestine was terminated. This work provides a legal basis for future settlement of the status of Palestinians of all categories that emerged in some sixty years following the end of the Palestine Mandate: Israeli citizens, inhabitants of the occupied territory, and Palestinian refugees. In conclusion, nationality as regulated by Britain in Palestine represents an international status that cannot be legally altered except in accordance with international law.
