Porque junto a los conflictos pendientes, que había antes de la pandemia, y que, mientras esta duró, habían quedado suspendidos en la mayoría de países (en que la Administración de Justicia vio cerrada sus puertas, casi a cal y canto), se han venido a sumar nuevos conflictos provocados por la crisis social y económica que después de la pandemia se han generado, así como por la propia tensión provocada por tan largo y severo confinamiento que la mayoría de los países impusieron a fin de evitar una mayor propagación del Covid-19; conflictos tales: como reclamaciones de ayudas a los Estados o impugnaciones de multas impuestas por incumplimiento del confinamiento, conflictos laborales por despidos encubiertos o por impago de salarios, conflictos penales por maltratos familiares o domésticos, conflictos fiscales por impago de impuestos, diversos conflictos civiles por impago de alquileres y préstamos, o por incumplimiento de otros contratos (muchos de ellos amparados en la —tan manida durante aquellos días— cláusula rebus sic stantibus —que con tanto pretendido uso parecía recordar al bálsamo de Fierabrás, que todo lo cura—), pero también por nuevos divorcios y separaciones, por un incremento en el número de concursos de acreedores". Credit Nation examines how the drive to expand credit shaped property laws and legal institutions in the colonial and founding eras of the republic. In this major new history of early America, Claire Priest describes how the British Parliament departed from the customary ways that English law protected land and inheritance, enacting laws for the colonies that privileged creditors by defining land and slaves as commodities available to satisfy debts. Colonial governments, in turn, created local legal institutions that enabled people to further leverage their assets to obtain credit. Priest shows how loans backed with slaves as property fueled slavery from the colonial era through the Civil War, and that increased access to credit was key to the explosive growth of capitalism in nineteenth-century America. Credit Nation presents a new vision of American economic history, one where credit markets and liquidity were prioritized from the outset, where property rights and slaves became commodities for creditors' claims, and where legal institutions played a critical role in the Stamp Act crisis and other political episodes of the founding period.

At its centre is a rejection of the death penalty as excessive, unnecessary, and pointless. Beccaria is deservedly regarded as the founding father of modern criminal-law reform, yet he was not the first to argue for the abolition of the death penalty. Against the Death Penalty presents the first English translation of the Florentine aristocrat Giuseppe Pelli's critique of capital punishment, written three years before Beccaria's treatise, but lost for more than two centuries in the Pelli family archives. Peter Garnsey examines the contrasting arguments of the two abolitionists, who drew from different intellectual traditions. Pelli was a devout Catholic influenced by the writings of natural jurists such as Hugo Grotius, whereas Beccaria was inspired by the French Enlightenment philosophers. While Beccaria attacked the criminal justice system as a whole, Pelli focused on the death penalty, composing a critique of considerable depth and sophistication. Garnsey explores how Beccaria's alternative penalty of forced labour, and its conceptualisation as servitude, were embraced in Britain and America, and delves into Pelli's voluminous diaries, shedding light on Pelli's intellectual development and painting a vivid portrait of an Enlightenment man of letters and of conscience.
