Book The Roles of Psychology in International Arbitration

Download or read book The Roles of Psychology in International Arbitration written by Tony Cole and published by Kluwer Law International B.V.. This book was released on 2017-03-15 with total page 496 pages. Available in PDF, EPUB and Kindle. Book excerpt: The system of international arbitration is built on private contractual relations, yet has been endorsed by governments around the world as a fair and reliable alternative to litigation in State courts. As a private process, however, its authority and legitimacy derive entirely from the views and actions of those involved in the arbitral process, whether arbitrators, counsel, or parties. It is, though increasingly clear that psychological factors complicate, and in some cases radically change, every arbitral proceeding. In this context, psychological insights are crucial for understanding how international arbitration genuinely operates, and whether the legal framework currently applied to it is well-suited to achieving the aims of ensuring a fair and reliable dispute resolution procedure. This is the first book to focus on this important issue: the insights into international arbitration that can be gained from contemporary psychology. With contributions from nineteen internationally known figures in their fields – arbitrators, mediators, lawyers, law professors, psychology professors, psychologists – and drawing from a longer term project on the role of psychology in arbitration, this ground-breaking volume addresses a range of topics, including the following: - the decision-making processes of arbitrators; - the ability of arbitration to serve as a genuine dispute resolution mechanism; - the impact of particular procedures on the arbitral process; - bias, self-deception and vested interests in judgment and decision-making; - the role of arbitrators in managing the arbitral process; - cultural differences in the evaluation of arguments; - psychological influences on witness testimony; - the impact of tribunal composition on arbitral decision-making; - the influence of arbitration’s professional context on arbitrators and legal counsel; and - methods for arbitrators and legal counsel to more effectively manage the arbitral process. Informed by the behavioural insights in these essays, counsel and arbitrators will be enabled to think critically about the underlying assumptions and the potential behavioural effects of a prospective arbitration, while individuals researching arbitration will gain a greater understanding of the psychological context in which every arbitration occurs. This book meets the increasingly recognized need for understanding the role of psychology in arbitral proceedings, and forms an indispensable foundation for subsequent work in this area. Its innovative and forward-thinking analysis will be of immeasurable value to the international arbitration community, as well as to institutions supporting arbitration and to academics in the field.

Book Game Theory and the Humanities

Download or read book Game Theory and the Humanities written by Steven J. Brams and published by MIT Press. This book was released on 2011 with total page 334 pages. Available in PDF, EPUB and Kindle. Book excerpt: Game theory models are ubiquitous in economics, common in political science, and increasingly used in psychology and sociology; in evolutionary biology, they offer compelling explanations for competition in nature. But game theory has been only sporadically applied to the humanities; indeed, we almost never associate mathematical calculations of strategic choice with the worlds of literature, history, and philosophy. And yet, as Steven Brams shows, game theory can illuminate the rational choices made by characters in texts ranging from the Bible to Joseph Heller's Catch-22 and can explicate strategic questions in law, history, and philosophy. - Brams's strategic exegesis of texts helps the reader relate characters' goals to their choices and the consequences of those choices. Much of his analysis is based on the theory of moves (TOM), which is grounded in game theory, and which he develops gradually and applies systematically throughout. TOM illuminates the dynamics of player choices, including their misperceptions, deceptions, and uses of different kinds of power.

Download or read book Mathematics and Democracy written by Steven J. Brams and published by Princeton University Press. This book was released on 2009-12-02 with total page 390 pages. Available in PDF, EPUB and Kindle. Book excerpt: Voters today often desert a preferred candidate for a more viable second choice to avoid wasting their vote. Likewise, parties to a dispute often find themselves unable to agree on a fair division of contested goods. In Mathematics and Democracy, Steven Brams, a leading authority in the use of mathematics to design decision-making processes, shows how social-choice and game theory could make political and social institutions more democratic. Using mathematical analysis, he develops rigorous new procedures that enable voters to better express themselves and that allow disputants to divide goods more fairly. One of the procedures that Brams proposes is "approval voting," which allows voters to vote for as many candidates as they like or consider acceptable. There is no ranking, and the candidate with the most votes wins. The voter no longer has to consider whether a vote for a preferred but less popular candidate might be wasted. In the same vein, Brams puts forward new, more equitable procedures for resolving disputes over divisible and indivisible goods.

Book And Then I Danced

Download or read book And Then I Danced written by Mark Segal and published by Akashic Books. This book was released on 2015-09-14 with total page 319 pages. Available in PDF, EPUB and Kindle. Book excerpt: A gay-rights pioneer shares his stories, from Stonewall to dancing with his husband at the White House, in a memoir full of “funny anecdotes and heart” (Publishers Weekly). On December 11, 1973, Mark Segal disrupted a live broadcast of the CBS Evening News when he sat on the desk directly between the camera and news anchor Walter Cronkite, yelling, “Gays protest CBS prejudice!” He was wrestled to the studio floor by the stagehands on live national television, thus ending LGBT invisibility. But this one victory left many more battles to fight, and creativity was required to find a way to challenge stereotypes. Mark Segal's job, as he saw it, was to show the nation who gay people are: our sons, daughters, fathers, and mothers. This is a memoir of one man’s role in modern LGBT history, from being on the scene of the Stonewall riots, to getting kicked off a 1970s TV show for dancing with another man—and then, decades later, dancing with his husband at a White House event for Gay Pride. “[Segal] vividly describes his firsthand experience as a teenager inside the Stonewall bar during the historic riots, his participation with the Gay Liberation Front, and amusing encounters with Elton John and Patti LaBelle....A jovial yet passionately delivered self-portrait inspiring awareness about LGBT history from one of the movement's true pioneers.”—Kirkus Reviews “The stories are interesting, unexpected, and witty.”—Library Journal “Much this book focuses on his work, but the more telling pages are filled with love gained and lost, raising other people’s children, finding himself, and aging in the gay community. A must-read.”—The Advocate
