Download or read book Sale of Land written by Donald William McMorland and published by . This book was released on 2011 with total page 673 pages. Available in PDF, EPUB and Kindle. Book excerpt: The aim of the book is to provide an account of the law of New Zealand relating to the sale of land. Such a contract is governed by the general law of contract, as is any other contract whatever its subject matter. The author has endeavoured to state the law in this book within a reasonable compass while including some discussion of the major subject areas which commonly arise. This is a matter of balance and individual judgment and others may disagree with the decisions I have made. Some areas of contract law, though applicable, arise infrequently in the present context and the law which applies is both no different from that applicable to any other form of contract and is fully discussed elsewhere in the New Zealand literature. On that basis, this book does not discuss areas such as illegality or mistake. Other matters, though also of general application, arise more frequently; in those cases, though there is full discussion elsewhere, the author thought it desirable to set out, albeit briefly, the principal tenets of the area. This accounts for the treatment of such matters as agency, misrepresentation, contract formation, and aspects of remedies. Other matters, such as title or settlement, are particular to this form of contact and require full discussion.

Book A Practical Guide to the Land Transfer ACT

Download or read book A Practical Guide to the Land Transfer ACT written by Thomas Gibbons and published by . This book was released on 2017-12 with total page pages. Available in PDF, EPUB and Kindle. Book excerpt: The Land Transfer Act is at the heart of conveyancing law and practice, a field in which many lawyers - both specialist and generalist - work. This book is a rapid-response, practical guide to the important changes to New Zealand property law coming in with the new Land Transfer Act. The Land Transfer Act also deals with a range of more complex issues, such as mortgages, easements, covenants, and subdivisions. It is essential that practitioners have a strong understanding of Land Transfer legislation. A Practical Guide to the Land Transfer Act is the first text on the Act, which marks a big and important change to the land transfer system in New Zealand, and will include a precis of the legislation, as well as commentary on key issues. As such, it will be a first port of call for practitioners and students wanting to understand the legislation, and grapple with its principles, contents, and wording. It is an essential text for lawyers, legal executives, LINZ officers, and for students and academics.

Book Property and Human Flourishing

  • Author : Gregory S. Alexander
  • Publisher : Oxford University Press
  • Release : 2018
  • ISBN : 019086074X
  • Pages : 393 pages

Download or read book Property and Human Flourishing written by Gregory S. Alexander and published by Oxford University Press. This book was released on 2018 with total page 393 pages. Available in PDF, EPUB and Kindle. Book excerpt: Many people assume that what morally justifies private ownership of property is either individual freedom or social welfare, defined in terms of maximizing personal preference-satisfaction. This book offers an alternative way of understanding the moral underpinning of private ownership of property. Rather than identifying any single moral value, this book argues that human flourishing, understood as morally pluralistic and objective, is property's moral foundation. The book goes on to develop a theory that connects ownership and human flourishing with obligations. Owners have obligations to members of the communities that enabled the owners to live flourishing lives by cultivating in their community members certain capabilities that are essential to leading a well-lived life. These obligations are rooted in the interdependence that exists between owners and their community members, and inherent in the human condition. Obligations have always been inherent in ownership. Owners are not free to inflict nuisances upon their neighbors, for example, by operating piggeries in residential neighborhoods. The human flourishing theory explains why owners at times have obligations that enable their fellow community members to develop certain necessary capabilities, such as health care and security. This is why, for example, farm owners may be required to allow providers of health care and legal assistance to enter their property to assist employees who are migrant workers. Moving from the abstract and theoretical to the practical, this book considers implications for a wide variety of property issues of importance both in the literature and in modern society. These include questions such as: When is a government's expropriation of property legitimated for the reason it is for public use? May the owner of a historic or architecturally significant house destroy it without restriction? Do institutions that owned African slaves or otherwise profited from the slave trade owe any obligations to members of the African-American community? What insights may be gained from the human flourishing concept into resolving current housing problems like homelessness, eviction, and mortgage foreclosure?

Book The Structure of Conflict

Download or read book The Structure of Conflict written by Clyde H. Coombs and published by Psychology Press. This book was released on 2013-05-13 with total page 247 pages. Available in PDF, EPUB and Kindle. Book excerpt: A theory that attempts to bring order to the chaotic variety of conflict usually begins by distinguishing types of conflict and formulating general explanatory principles that relate and integrate them. In contrast to traditional methods, this book describes and explores the structural aspects of different types of conflicts, and discusses the important implications involved for both choosing and achieving methods for resolving conflict. Two important facets of conflict structure are recognized: the individuals involved and the behavioral principles that govern them; and the existence of options and their structural relation. This monograph will be of interest to researchers and practitioners of conflict resolution, such as mediators, lawyers, diplomats, counselors and psychologists, and students in experimental and social psychology, labor relations, poilitical science and law.

Book Property And Persuasion

Download or read book Property And Persuasion written by Carol M Rose and published by Routledge. This book was released on 2019-09-05 with total page 289 pages. Available in PDF, EPUB and Kindle. Book excerpt: With socialism largely discredited in recent years, the moral and legal status of private property has become an increasingly important area for discussion in contemporary political and social thought. Offering a contribution to legal theory, and to political and social philosophy, this work examines the two currently dominant traditions - those of neo-conservative utilitarianism and liberal communitarianism - emphasizing the strengths of both approaches and laying the groundwork for a theory to bridge the gap between them.
