Download or read book Same Sex Couples before National Supranational and International Jurisdictions written by Daniele Gallo and published by Springer Science & Business Media. This book was released on 2013-12-02 with total page 581 pages. Available in PDF, EPUB and Kindle. Book excerpt: The present volume focuses on the jurisprudence of national, supranational and international jurisdictions (and quasi-juridictions) as regards the legal status of same-sex couples. Its aim is to explore the content, rationale, functioning and potential of the different jurisdictions’ reasonings and their contribution to the strengthening of LGBTI rights (and duties). As a consequence, the book tries to convey the complexities and controversies that derive from the judicial recognition of same-sex couples across the world, taking always into account the relationship of the judiciary with the executive and the legislature and the related problems of legitimacy and democracy. The volume deals with this issue and considers it as a crucial test for modern democracies and contemporary societies.
Download or read book Same Sex Couples Comparative Insights on Marriage and Cohabitation written by Macarena Sáez and published by Springer. This book was released on 2015-05-06 with total page 215 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book shows six different realities of same-sex families. They range from full recognition of same-sex marriage to full invisibility of gay and lesbian individuals and their families. The broad spectrum of experiences presented in this book share some commonalities: in all of them legal scholars and civil society are moving legal boundaries or thinking of spaces within rigid legal systems for same-sex families to function. In all of them there have been legal claims to recognize the existence of same-sex families. The difference between them lies in the response of courts. Regardless of the type of legal system, when courts have viewed claims of same-sex couples and their families as problems of individual rights, they have responded with a constitutional narrative protecting same-sex couples and their families. When courts respond to these claims with rigid concepts of what a family is and what marriage is as if legal concepts where unmodifiable, same-sex couples have remained outside the protection of the law. Until forty years ago marriage was the only union considered legitimate to form a family. Today more than 30 countries have granted rights to same sex couples, including several that have opened up marriage to couples of the same sex. Every day there is a new bill being discussed or a new claim being brought to courts seeking formal recognition of same sex couples. Not all countries are open to changing their legal structures to accommodate same-sex couples, but even those with no visible changes are witnessing new voices in their communities challenging the status quo and envisioning more flexible legal systems.

Download or read book Otherness in Hispanic Culture written by Teresa Fernandez Ulloa and published by Cambridge Scholars Publishing. This book was released on 2014-06-26 with total page 615 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book addresses contemporary discourses on a wide variety of topics related to the ideological and epistemological changes of the 19th, 20th and 21st centuries, and the ways in which they have shaped the Spanish language and cultural manifestations in both Spain and Hispanic America. The majority of the chapters are concerned with ‘otherness’ in its various dimensions; the alien Other – foreign, immigrant, ethnically different, disempowered, female or minor – as well as the Other of different sexual orientation and/or ideology. Following Octavio Paz, otherness is expressed as the attempt to find the lost object of desire, the frustrating endeavour of the androgynous Plato wishing to embrace the other half of Zeus, who in his wrath, tore off from him. Otherness compels human beings to search for the complement from which they were severed. Thus a male joins a female, his other half, the only half that not only fills him but which allows him to return to the unity and reconciliation which is restored in its own perfection, formerly altered by divine will. As a result of this transformation, one can annul the distance that keeps us away from that which, not being our own, turns into a source of anguish. The clashing diversity of all things requires the human predisposition to accept that which is different. Such a predisposition is an expression of epistemological, ethical and political aperture. The disposition to co-exist with the different is imagined in the de-anthropocentricization of the bonds with all living realms. And otherness is, in some way, the reflection of sameness (mismidad). The other is closely related to the self, because the vision of the other implies a reflection about the self; it implies, consciously or not, a relationship with the self. These topics are addressed in this book from an interdisciplinary perspective, encompassing arts, humanities and social sciences.

Download or read book Seeing in Spanish written by Ryan Prout and published by Cambridge Scholars Publishing. This book was released on 2011-05-25 with total page 363 pages. Available in PDF, EPUB and Kindle. Book excerpt: Seeing in Spanish brings together 22 chapters which share a focus on aspects of visual cultures from the Spanish speaking world. Together these chapters address film, photography, cover art, body art, posters, television, architecture, ekphrasis, biography, murals, graffiti, and digital photo-montage. Between Don Quixote and Daddy Yankee, the essays move from the seventeenth century to the present and traverse Europe, the Americas, and cyberspace. The book is divided into five sections. The first of these, on Spain, includes chapters on the representation of women on LP covers in Spain in the 60s and 70s; portrayals in Spanish cinema of Saint Teresa; Luis Buñuel’s adaptation of Tristana; urban and rural space in recent Spanish documentary film; Catalan television; fine art in Don Quixote; and visions of adoption in three narratives by Spanish writers and filmmakers. The second section, on Mexico and Peru, includes chapters on the fragmentary body in images of Mexico; the art of Abraham Ángel; Jesús Ruiz Durand’s agrarian reform posters; Diego Rivera’s murals; and the role of artistic production in staging the 2006 Oaxaca conflict. The third section, on Cuba, looks at the portrayal of women and of children in recent cinema from the island. It also examines Nancy Morejón’s celebration of the life and art of exiled Cuban artist Ana Mendieta. Section four includes chapters on Chile and Argentina. It addresses street art and graffiti; new forms of publishing; Chilean cinema after Pinochet; and Violeta Parra’s appliqué and collage works. Section five embraces Colombia, Bolivia, and virtual spaces. The contributions to this last section of the book examine childhood in Colombian cinema; the online creativity of pro- and anti-fans of reggaeton; and the photographic diaries of T. Ifor Rees, the UK’s first ambassador to Bolivia. In addition to the geo-political structure which underpins the book’s five sections, the introduction suggests pathways through the contributions focussed on public art and graffiti, women, children, cyberspace and diplomacy, and reconstruction and disintegration. Seeing in Spanish includes 50 illustrations—stills from films, photographs, reproductions of paintings, and screen grabs from the internet—which complement the chapters’ analyses of aspects of Hispanic visual cultures. To aid accessibility, footnotes throughout the book provide English translations of all references from texts in other languages. Taken together, the book’s 22 chapters make a valuable contribution to the existing literature on figures like Don Quixote and Saint Teresa. They also break new ground in approaches to novel areas of scholarship such as sleeve design, artisanal book production, and digital image manipulation. The book will appeal to students and scholars of Spain and Latin America as well as to a general readership with an interest in the visual cultures of the Spanish speaking world.
Download or read book Trans Rights and Wrongs written by Isabel C. Jaramillo and published by Springer Nature. This book was released on 2021-06-23 with total page 552 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book maps various national legal responses to gender mobility, including sex and name registration, access to gender modification interventions, and anti-discrimination protection (or lack thereof) and regulations. The importance of the underlying legislation and history is underlined in order to understand the law’s functions concerning discrimination, exclusion, and violence, as well as the problematic nature of introducing biology into the regulation of human relations, and using it to justify pain and suffering. The respective chapters also highlight how various governmental authorities, as well as civil society, have been integral in fostering or impeding the welfare of trans persons, from judges and legislators, to medical commissions and law students. A collective effort of scholars scattered around the globe, this book recognizes the international trend toward self-determination in sex classification and a generous guarantee of rights for individuals expressing diverse gender identities. The book advocates the dissemination of a model for the protection of rights that not only focuses on formal equality, but also addresses the administrative obstacles that trans persons face in their daily lives. In addition, it underscores the importance of courts in either advancing or obstructing the realization of individual rights.
Download or read book Homofobia en los Balcanes written by Miguel Rodríguez Andreu and published by Editorial UOC. This book was released on 2015-06-19 with total page 84 pages. Available in PDF, EPUB and Kindle.

Download or read book Aurora Bertrana written by Silvia Roig and published by Boydell & Brewer. This book was released on 2016 with total page 367 pages. Available in PDF, EPUB and Kindle. Book excerpt: Silvia Roig explores the narrative of Aurora Bertrana (1892-1974), an unknown writer today, but a successful and recognized female author in Catalonia and Spain during the 20th century. Aurora Bertrana's works are almost never mentioned in manuals of literature. Her rich, intellectual work has not received the attention it deserves, relegated almost to absolute oblivion. The author reviews and studies twenty-four of Bertrana's novels written in Catalan andSpanish, including: Ariatea (1960), El pomell de les violes (MS), L'inefable Philip (MS), La aldea sin hombres (mn.), La madrecita de los cerdos (MS), Entre dos silencis (1958), La ninfa d'argila (1959), Fracàs (1966) and La ciutat dels joves: reportatge fantasia (1971). She studies her work, published and unpublished, from a feminist approach, taking into account the intellectual history of Spain and Catalonia. Bertana's strong commitment to social issues reveals her association with the Modernist and Noucentists trends of her time. Bertrana's novels reveal a unique interest in non-Western cultures and lifestyles and her work undertakes controversial topics and socio-cultural issues, while she observes and draws special attention to the situation of women in different circumstances and cultural geographies. This book is therefore anchored on interpretive and theoretical parameters that intersect with consideration of gender, such as travel-and-gender and war-and-gender. Roig uses the work of feminists such as Simone De Beauvoir, Shulamith Firestone, Jelke Boesten, Margaret and Patrice Higonnet, Michelle Zimbalist Rosaldo and Julia Kristeva to help assess Bertrana's engagement with gender and socio-political issues. This approach is particularly well suited for a writer like Bertrana, a Catalan and Republican intellectual woman forced into self-exile during the Spanish Civil War and the dictatorship of Francisco Franco. Silvia Roig is a Faculty Member, BMCC Department of Modern Languages, The City University of New York.
