Book Canon 1096 on Ignorance with Application to Tribunal and Pastoral Practice

Download or read book Canon 1096 on Ignorance with Application to Tribunal and Pastoral Practice written by Girard M. Sherba and published by Universal-Publishers. This book was released on 2001 with total page 190 pages. Available in PDF, EPUB and Kindle. Book excerpt: Before Vatican II, marriage was often considered, or at least popularly expressed, as a union of bodies; that is to say, marriage was an exclusive contract by which a man and a woman mutually handed over their bodies for the purpose of acts which led to the procreation of children. Matrimonial jurisprudence was primarily focused on this marital contract. With the advent of Vatican II and its emphasis on the personalist notion of marriage, a new age dawned whereby canonists, especially auditors of the Roman Rota, were henceforth to view marriage as a union of persons. "Person" is more than a "body"; rather, a person is an individual consisting of wants, needs, desires, impulses, hopes and dreams, whose life experience has been shaped by the milieu "cultural, familial, religious" from which he or she comes. "Union" is not only simply understood as a "contract", but also is now once again recognized as a "covenant", a concept which, at least in the Latin Church, was prevalent until the 12th century. One of the canons of the 1983 CIC, although almost identical in wording to its predecessor in the 1917 CIC, but which now must be understood and interpreted in light of the teachings of Vatican II, is canon 1096 which pertains to the effect of ignorance on matrimonial consent. Given the current appreciation of marriage founded in the teachings of Vatican II, especially in Gaudium et spes, reiterated by Popes Paul VI and John Paul II and described in the Catechism of the Catholic Church, complicated by today's western society's stress on individualism and permeated by a divorce mentality, what is the impact of this canon on matrimonial consent? How can its meaning, once understood as being wider than merely the sexual act itself, be better utilized by those in tribunal ministry? This is the major thrust of the present work. The research of the history and development of the concept of ignorance in canonical writings, how its understanding broadened especially after Vatican II and our conclusions on how to apply its richness to marriage nullity led us to expand the use of this canon: how it can aid in the development of pre-marital preparation programs which would not only possibly help prevent couples from being ignorant of the essence of marriage but also help them to appreciate this richness more deeply in their own lives so that marriage truly can become, as we read in canon 1055, "a partnership of the whole of life which is ordered by its nature to the good of the spouses and the procreation and education of offspring". It is our sincere hope that this study, with its extensive footnotes and up-to-date bibliography will not only be of benefit to all who read it but also will serve as a spring board for further discussion and use of this canon as a ground for nullity and other pastoral uses.

Book Unframing and Reframing Mediterranean Spaces and Identities

Download or read book Unframing and Reframing Mediterranean Spaces and Identities written by and published by BRILL. This book was released on 2023-10-30 with total page 250 pages. Available in PDF, EPUB and Kindle. Book excerpt: Reconsidering the Mediterranean, appreciating and demarginalizing the peoples and cultures of this vast region, while considering the affinities and differences, is a valuable part of the process of unframing and reframing the concept of the Mediterranean. The authors of this volume follow Franco Cassano’s refusal of a sort of prêt-à-porter reality of cohabitation of cultures, introducing instead un’alternativa mediterranea, a world of multiple cultures that entails an ongoing learning and experiencing. The volume’s contributors use an interdisciplinary approach that mirrors the hybridity of the area and of the discipline, that is much more introspective and humanistic, more contemporary and inclusive.

Book excerpt: One of the main demands of Vatican II Council with respect to Canon Law was to always focus on the mystery of the Church. This clear and distinct position led to a renewal of the methodology applied to the discipline of Canon Law in almost all post-conciliar "schools". The canonistic demand however, similarly to change the didactic tools, the teaching material, in this new context has proved to be less significant. Knowing the importance and the urgency of this initiative has been a strong source of motivation to the author. The leading and inspiring idea behind this initiative is the conviction that the formal principles of Canon Law, both as the inner structure of the Church community as well as a proper scientific method, are the three fundamental elements of the constitution of the Church: the Word, the Sacrament and Charisma.

Available in PDF, EPUB and Kindle. Book excerpt: A New Statesman Book of the Year Winner of the Helen and Howard R. Marraro Prize Winner of the Aldo and Jeanne Scaglione Prize for Italian Studies “Extraordinary...I could not put it down.” —Margaret MacMillan “Reveals how ideology corrupts the truth, how untrammeled ambition destroys the soul, and how the vanity of white male supremacy distorts emotion, making even love a matter of state.” —Sonia Purnell, author of A Woman of No Importance When Attilio Teruzzi, a decorated military officer and early convert to the Fascist cause, married a rising American opera star, his good fortune seemed settled. The wedding was blessed by Mussolini himself. Yet only three years later, Teruzzi, now commander of the Black Shirts, renounced his wife. Lilliana was Jewish, and fascist Italy would soon introduce its first race laws. The Perfect Fascist pivots from the intimate story of a tempestuous courtship and inconvenient marriage to the operatic spectacle of Mussolini’s rise and fall. It invites us to see in the vain, unscrupulous, fanatically loyal Attilio Teruzzi an exemplar of fascism’s New Man. Victoria De Grazia’s landmark history shows how the personal was always political in the fascist quest for manhood and power. In his self-serving pieties and intimate betrayals, his violence and opportunism, Teruzzi is a forefather of the illiberal politicians of today. “The brilliance of de Grazia’s book lies in the way that she has made a page-turner of Teruzzi’s chaotic life, while providing a scholarly and engrossing portrait of the two decades of Fascist rule.” —Caroline Moorhead, Wall Street Journal “Original and important...A probing analysis of the fascist ‘strong man.’ De Grazia’s attention to Teruzzi’s private life, his behavior as suitor and husband, deepens and enriches our understanding of the nature of leadership in Mussolini’s regime and of masculinity, virility, and honor in Italian fascist culture.” —Robert O. Paxton, author of The Anatomy of Fascism “This is a perfect book!...Its two entwined narratives—one political and public, the other personal and private—help us understand why the personal is political for those who insist on reshaping people and society.” —Azar Nafisi, author of Reading Lolita in Tehran

Book La doctrine canonique m di val

Download or read book La doctrine canonique m di val written by Jean Gaudemet and published by Taylor & Francis. This book was released on 2024-10-28 with total page 288 pages. Available in PDF, EPUB and Kindle. Book excerpt: The question these articles seek to respond to, in this fifth collection by Jean Gaudemet to be published by Variorum, is how the intellectual elite of the medieval Church perceived the institutions among which they lived - how they portrayed them, and how they sought to influence them. Whether dealing with the papacy and its place in the Church and the world, with the role of the people in government, or with the position of the individual in society, he would argue that this is the essential question. In their response, this elite drew on the Bible and custom, on Roman law and papal letters, in order that the law could encompass all human experience. To achieve this, these jurists needed to create categories and work out principles, hence the recourse to theology and the necessity for a logical structure, a ’systematization’.

Book Discerniendo Vocaciones al Matrimonio Celibato y Solter a

Download or read book Discerniendo Vocaciones al Matrimonio Celibato y Solter a written by Elias Chacour and published by Xlibris Corporation. This book was released on 2010-03-25 with total page 223 pages. Available in PDF, EPUB and Kindle.
