The law’s dependency on language, at least for the usual communication purposes, not only makes legal interpretation the main task performed by those whose work involves the law, but also an unavoidable step in the process of resolving a legal case. This task of decoding the words and sentences used by normative authorities while enacting norms, carried out in compliance with the principles and rules of the natural language adopted, is prone to all of the difficulties stemming from the uncertainty intrinsic to all linguistic conventions. In this context, seeking to determine whether legal interpretation can be scientific or, in other words, can comply with the requirements for scientific knowledge, becomes a central question. In fact, the coherent application of the law depends on a knowledge regarding the meaning of normative sentences that can be classified (at least) as being structured, systematically organized and tendentially objective. Accordingly, this book focuses on analyzing precisely these problems; its respective contributions offer a range of revealing perspectives on both the problems and their ramifications.

Three v- umes will follow: Two are devoted to the philosophy of law in the 20th c- tury, and the third one will be the index for the entire Treatise, which will 1 therefore ultimately comprise thirteen volumes. This Volume 9 runs parallel to Volume 8, A History of the Philosophy of Law in the Common Law World, 1600–1900, by Michael Lobban, published in 2007. Volume 10, for its part, takes up where Volume 6 left off: which appeared under the title A History of the Philosophy of Law from the Ancient Greeks to the Scholastics (edited by Fred Miller Jr. in association with Carrie-Ann Biondi, likewise published in 2007), and which is mainly a history of the p- losophers’ philosophy of law (let us refer to this philosophy as A).

Book excerpt: This volume addresses an important historiographical gap by assessing the respective contributions of tradition and foreign influences to the 19th century codification of criminal law. More specifically, it focuses on the extent of French influence – among others – in European and American civil law jurisdictions. In this regard, the book seeks to dispel a number of myths concerning the French model’s actual influence on European and Latin American criminal codes. The impact of the Napoleonic criminal code on other jurisdictions was real, but the scope and extent of its influence were significantly less than has sometimes been claimed. The overemphasis on French influence on other civil law jurisdictions is partly due to a fundamental assumption that modern criminal codes constituted a break with the past. The question as to whether they truly broke with the past or were merely a degree of reform touches on a difficult issue, namely, the dichotomy between tradition and foreign influences in the codification of criminal law. Scholarship has unfairly ignored this important subject, an oversight that this book remedies.

Book excerpt: The cultural history of heredity: scholars from a range of disciplines discuss the evolution of the concept of heredity, from the Early Modern understanding of the act of "generation" to its later nineteenth-century definition as the transmission of characteristics across generations. Until the middle of the eighteenth century, the biological makeup of an organism was ascribed to an individual instance of "generation"--involving conception, pregnancy, embryonic development, parturition, lactation, and even astral influences and maternal mood--rather than the biological transmission of traits and characteristics. Discussions of heredity and inheritance took place largely in the legal and political sphere. In Heredity Produced, scholars from a broad range of disciplines explore the development of the concept of heredity from the early modern period to the era of Darwin and Mendel. The contributors examine the evolution of the concept in disparate cultural realms--including law, medicine, and natural history--and show that it did not coalesce into a more general understanding of heredity until the mid-nineteenth century. They consider inheritance and kinship in a legal context; the classification of certain diseases as hereditary; the study of botany; animal and plant breeding and hybridization for desirable characteristics; theories of generation and evolution; and anthropology and its study of physical differences among humans, particularly skin color. The editors argue that only when people, animals, and plants became more mobile--and were separated from their natural habitats through exploration, colonialism, and other causes--could scientists distinguish between inherited and environmentally induced traits and develop a coherent theory of heredity. Book excerpt: This book examines the historical process that led to the foundation of the Italian Republic and its constitution, viewed through the personal experiences and political reflections of Adriano Olivetti (between 1919 and 1960), general manager and president of the well-known typewriter manufacturer “Ing. C. Olivetti & C.” An unbroken line of reasoning linked his maturing political reflections during the two post-war periods. The historical context of the 1950s did not prove to be very propitious, but the guidelines dispersed throughout the Italian cultural and political world from the movement that Olivetti founded were certainly seminal – generating a legacy of ideas that has only in part been recognized. What makes this study distinctive is the original approach to reading the history of Italy through Adriano Olivetti’s eyes and thoughts, far from the more common Christian Democratic or Communist perspective of those years. It is simply another view of what the Italian Republic could be and was not.

While criminalization may be justified whenever an offender commits a sufficiently serious moral wrong requiring that he or she be called to account, the doctrine of fitness to plead calls this principle into question in the case of a person who lacks the capacity or ability to participate meaningfully in a criminal trial. In light of the emerging focus on capacity-based approaches to decision-making and the international human rights requirement that the law should treat defendants fairly, this volume offers a benchmark for the theory and practice of fitness to plead, providing readers with a unique opportunity to consider differing perspectives and debate on the future development and direction of a doctrine which has up till now been under-discussed and under-researched. The fitness to plead rules stand as an exception to notions of public accountability for criminal wrongdoing yet, despite the doctrine's long-standing function in criminal procedure, it has proven complex to apply in practice and has given rise to many varied legislative models and considerable litigation in different jurisdictions. Particularly troublesome is the question of what is to be done with someone who has been found unfit to stand trial. Here the law is required to balance the need to protect those defendants who are unable to participate effectively in their own trial, whether permanently or for a defined period, and the need to protect the public from people who may have caused serious social harm as a result of their antisocial behaviour. The challenge for law reformers, legislators, and judges, is to create rules that ensure that everyone who can properly be tried is tried, while seeking to preserve confidence in the fairness of the legal system by ensuring that people who cannot properly engage in the criminal trial process are not forced to endure it.
