Book excerpt: Because marine mammals (MM), such as whales and dolphins, often inhabit waters where commercial fishing occurs, they can become entangled in fishing gear, which may injure or kill them -- this is referred to as "incidental take." The MM Protection Act (MMPA) requires the Nat. Marine Fish. Serv. (NMFS) to establish take reduction teams for certain MM to develop measures to reduce their incidental takes. This report determines the extent to which NMFS: (1) can identify the MM stocks that meet the MMPA's requirements for establishing such teams; (2) has established teams for those stocks that meet the requirements; (3) has met the MMPA's deadlines for the teams subject to them; and (4) evaluates the effectiveness of take reduction regulations.

The 1994 amendments to the Marine Mammal Protection Act (MMPA) require the National Marine Fisheries Service (NMFS) to establish take reduction teams for certain marine mammals to develop measures to reduce their incidental takes. GAO was asked to determine the extent to which NMFS (1) can accurately identify the marine mammal stocks-generally a population of animals of the same species located in a common area-that meet the MMPA's requirements for establishing such teams, (2) has established teams for those stocks that meet the requirements, (3) has met the MMPA's deadlines for the teams subject to them, and (4) evaluates the effectiveness of take reduction regulations. GAO reviewed the MMPA, and NMFS data on marine mammals, and take reduction team documents and obtained the views of NMFS officials, scientists, and take reduction team members. Updated as of May 29, 2018 We, NMFS, issue the final False Killer Whale Take Reduction Plan (FKWTRP), and regulatory measures and non-regulatory measures and recommendations to reduce mortalities and serious injuries of false killer whales in Hawaii-based longline fisheries. Regulatory measures include gear requirements, longline prohibited areas, training and certification in marine mammal handling and release, captains' supervision of marine mammal handling and release, and posting of NMFS-approved placards on longline vessels. In this rule, NMFS also recommends research and data collection programs. This final rule also revises the boundaries of the longline prohibited area around the main Hawaiian Islands to be consistent with the prohibited area established under the FKWTRP regulations. The FKWTRP is based on consensus recommendations submitted to NMFS by the False Killer Whale Take Reduction Team (Team), with certain modifications described herein that were determined to be necessary to meet the requirements of the MMPA. This final rule is necessary because current mortality and serious injury levels of the Hawaii Pelagic and Hawaii Insular stocks of false killer whales incidental to the Hawaii-based pelagic longline fisheries are above the stocks' potential biological removal (PBR) levels, and are therefore inconsistent with the short- and long-term goals of the Marine Mammal Protection Act (MMPA). The FKWTRP is intended to meet the requirements of the MMPA. Because whales continued to die after the ALWTF plan went into effect, NMFS proposed revisions in 2005. The author of this book discusses these issues, as well as the Marine Mammal Protection Act (MMPA), which requires the NMFS to establish take reductions teams for certain marine mammals to develop measures to reduce their incidental takes. Other bills that specifically address marine mammal regulatory and management issues are examined as well.
