Book excerpt: Marginalized Communities and Access to Justice is a comparative study, by leading researchers in the field of law and justice, of the imperatives and constraints of access to justice among a number of marginalized communities. A central feature of the rule of law is the equality of all before the law. As part of this equality, all persons have the right to the protection of their rights by the state, particularly the judiciary. Therefore equal access to the courts and other organs of the state concerned with the enforcement of the law is central. These studies – undertaken by internationally renowned scholars and practitioners – examine the role of courts and similar bodies in administering the laws that pertain to the entitlements of marginalized communities, and address individuals' and organisations' access to institutions of justice: primarily, but not exclusively, courts. They raise broad questions about the commitment of the state to law and human rights as the principal framework for policy and executive authority, as well as the impetus to law reform through litigation. Offering insights into the difficulties of enforcing, and indeed of the will to enforce, the law, this book thus engages fundamental questions about value of engagement with the formal legal system for marginalized communities.

Those disparities are caused not only by fundamental differences in health status across segments of the population, but also because of inequities in factors that impact health status, so-called determinants of health. Only part of an individual's health status depends on his or her behavior and choice; community-wide problems like poverty, unemployment, poor education, inadequate housing, poor public transportation, interpersonal violence, and decaying neighborhoods also contribute to health inequities, as well as the historic and ongoing interplay of structures, policies, and norms that shape lives. When these factors are not optimal in a community, it does not mean they are intractable: such inequities can be mitigated by social policies that can shape health in powerful ways. Communities in Action: Pathways to Health Equity seeks to delineate the causes of and the solutions to health inequities in the United States. This report focuses on what communities can do to promote health equity, what actions are needed by the many and varied stakeholders that are part of communities or support them, as well as the root causes and structural barriers that need to be overcome.

Book excerpt: Access to justice is a human right. It is a human right that is not experienced equally to all and often does not reach the most marginalized groups of people within society. One resource that is used to increase access to justice for marginalized people is the service of Legal Aid. Legal aid services are catered to those who do not have the financial means to afford a private lawyer. These services are provided for significantly reduced amount or pro bono. Legal aid lawyers are advocates on behalf of their clients by representing them in court, providing them with knowledge of their rights and advocating for these rights. Unfortunately, many legal aid clients are viewed by society through a stereotypical lens which is embedded with negative biases. This affects low-income people within the justice system and also within their daily lives. A possible solution to break down stereotypes, is an additional type of advocacy aside from the type offered through Legal aid lawyers. This second type of advocacy is widespread and reaches a far greater audience than a courtroom. This advocacy would best be accomplished through knowledge translation. Knowledge translation can provide an educational, impactful and empathizing experience on behalf of legal aid clients and work to break down stereotypes and stigmatization. Legal aid clients are human, and all humans should be able to live freely with dignity, without discrimination or bias, and be able to claim their human rights.

Book excerpt: In international law, as in any other legal system, respect and protection of human rights can be guaranteed only by the availability of effective judicial remedies. When a right is violated or damage is caused, access to justice is of fundamental importance for the injured individual and it is an essential component of the rule of law. Yet, access to justice as a human right remains problematic in international law. First, because individual access to international justice remains exceptional and based on specific treaty arrangements, rather than on general principles of international law; second, because even when such right is guaranteed as a matter of treaty obligation, other norms or doctrines of international law may effectively impede its exercise, as in the case of sovereign immunity or non reviewability of UN Security Council measures directly affecting individuals. Further, even access to domestic legal remedies is suffering because of the constraints put by security threats, such as terrorism, on the full protection of freedom and human rights. This collection of essays offers seven distinct perspectives on the present status of access to justice: its development in customary international law, the stress put on it in times of emergency, its problematic exercise in the case of violations of the law of war, its application to torture victims, its development in the case law of the UN Human Rights Committee and of the European Court of Human Rights, its application to the emerging field of environmental justice, and finally access to justice as part of fundamental rights in European law.

In its simplest trajectory, Multiple Marginality can be modeled as follows: place/status to street socialization to street subculture to street identity. It is the actions and reactions among them that we fathom. As we witness detrimental or absent family influence, we also observe weaker, underfunded schools that limit educators’ reach. At the same time, there has been an increase in the militarization of law enforcement to deal with the youth street populations, the heaviest hand is that of the police. There is a causal relationship between social marginalization factors and gang membership. A psychological analysis also entails how street socialization leads to a street identity. In a place and status group, the cascading effects of marginalization have certainly affected—and mostly thwarted—social control institutions.
