Book Handbook of European Environmental and Climate Law

Download or read book Handbook of European Environmental and Climate Law written by Patrick Thieffry and published by Bruylant. This book was released on 2021-05-06 with total page 528 pages. Available in PDF, EPUB and Kindle. Book excerpt: This Handbook of European Environment and Climate Law is the 2nd edition of the work previously titled Handbook of European Environment Law. It is associated with the Traité de droit européen de l’environnement et du climat and the Manuel de droit européen de l’environnement et du climat, both in the French language and published in the same collection, and with which it shares a same structure. The Traité provides a more in-depth approach, with further historic, policy and caselaw considerations, and more complete references. The introduction in the book’s title of the climate dimension, while it was already quite present in the previous edition, is testimony to its growing importance absent a dedicated EU policy and corresponding legislative basis. Climate law is covered in its many occurrences along the work, its specificities noted, and their consequences recognized, especially with respect to the international background which brings about novel legal interventions, an upheaval of classical approaches, through the creation of a new governance for the implementation of the Paris Agreement and of the resulting EU legislation. The recurring changes in the many and diverse environmental legislations are also of course presented in context, including in light of the growing importance of circular economy and the proposal of a European Green Deal. The growing interference of fundamental rights is henceforth considered: Charter of Fundamental Rights of the Union, Convention for the Protection of Human Rights and Fundamental Freedoms, etc. More broadly, the development of environmental and climate disputes settlement is accounted for beyond the traditional recourse to the EU judges, in the national courts including through transnational private litigation, and in international arbitration.

Available in PDF, EPUB and Kindle. Book excerpt: ASA Special Series ‘We must measure what we value, not just value what is simple to measure.’ This statement from the US White House encapsulates the global trend dubbed ESG – an insistence on attending to the natural environment, social values, and responsible governance in business affairs. A salient aspect of this trend is the ‘explosion’ of human rights and environment-related disputes that have come to the fore on the international legal landscape. In this timely and crucially important volume, distinguished jurists, representatives of governments and NGOs, and in-house counsel identify and analyse the sources of ESG-related litigation and arbitration, providing an extensive treatment of the nature of ESG disputes and their resolution across both commercial and investment fora. The contributions are based on papers presented at a conference organized by the Swiss Arbitration Association in February 2023. Among the issues and topics raised, many of them relatively new to legal theory and practice, are the following: emergence of nature-related assets and markets dealing in nature-related products; intensification of ESG-related regulation; which disputes could trigger which type of arbitrations; ESG-specific arbitration clauses as risk mitigation measures; controversial role of the Energy Charter Treaty; ESG-compliant supply chains; ESG scoring; rights of nature – recognizing ecosystems as subjects with rights; and the criminal act of ecocide. Of immediate interest is a discussion focused on concrete ways in which each and every arbitration practitioner can contribute to a more environmentally friendly and socially responsible arbitration practice. In its recognition that ESG is profoundly linking environmental and social protection values with the monetary aspects in the life of both corporations and states, the book identifies key drivers for future ESG-related disputes and enables stakeholders to position themselves in an emerging field. It will prove of inestimable value to all practitioners, policymakers, and other professionals dedicated to the protection of natural resources and of human life itself.

Available in PDF, EPUB and Kindle. Book excerpt: This book sheds new light on the growing issue of using liability as a tool for both preventing and compensating for the damage caused by climate change. Michael Faure and Marjan Peeters have brought together a selection of expert contributors who explore a variety of both national and European perspectives on the topic. Climate change liability is no longer only a theoretical idea since climate changelitigation has become so hotly debated and this book examines to what extent it can be used for mitigation and adaptation issues. Chapters discuss the potential role of liability within various legal systems, like the national systems of the USA and The Netherlands, but also EU and ECHR law. Liability is outlined in a broad perspective since not only compensation for damage suffered by plaintiffs isdiscussed, but also the need for prevention in order to obtain a reduction of greenhouse gases.

Book Judicial Review of Administration in Europe

Download or read book Judicial Review of Administration in Europe written by Giacinto della Cananea and published by Oxford University Press. This book was released on 2021-08-23 with total page 400 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book is about judicial review of public administration. Many have regarded this to divide European legal orders, with judicial review of administrative action in the general courts or specialized administrative courts, or with different distance from the executive. There has been considerably less of comparison of the basic procedural and substantive principles. The comparative study in this book of procedural fairness and propriety in the courts reveals not only differences but also some common and connecting elements, in a 'common core' perspective. The book is divided into four parts. The first explains the nature and purpose of a comparison to understand the relevance and significance of commonality and diversity between the legal systems of Europe, and which considers other legal systems which are distant and distinct from Europe, such as China and Latin America. The second part contains an overview of the systems of judicial review in these legal orders. The third part, which is the heart of the 'common core' method, contains both a set of hypothetical cases and the solutions, according to the experts of the legal systems selected for our comparison, to the cases. The fourth part serves to examine the answers in comparative terms to ascertain not so much whether a 'common core' exists, but how it is shaped and evolves, also in response to the influence of supranational legal orders as the European Union and the Council of Europe.

This book was released on 2014-01-01 with total page 214 pages. Available in PDF, EPUB and Kindle.

Available in PDF, EPUB and Kindle. Book excerpt: The need for specific legal arrangements governing ships in distress and places of refuge is one of the most topical problems in both public and private maritime law. The headline grabbing shipping disasters involving the loss of the Erika (1999) and the Prestige (2002) attracted the attention of the IMO, the Comité Maritime International, the European Union, national maritime authorities around the globe and the maritime industry in general. Ultimately the impact of pollution on local economies and the environment was enough to arouse the concern of a broad swathe of public opinion. Places of Refuge provides clarity on: • The scope of the right of access • The conditions under which coastal authorities may deny access • The liability of authorities granting or denying access • The basis and the conditions of financial securities • The obligation to establish contingency plans

Book Environment in Key Words

Download or read book Environment in Key Words written by Isaac Paenson and published by Elsevier. This book was released on 2016-06-28 with total page 978 pages. Available in PDF, EPUB and Kindle. Book excerpt: Environmental problems ignore international boundaries. Toxic wastes travel by water and air, sometimes displacing the effects of an environmental disaster entirely outside of its country of origin. It is now understood that to overcome the problems that face us international co-operation is required. This important work is designed to assist in that process, by helping to break down the language barriers that stand between countries. The manual, written in parallel English, German, French and Russian texts, provides the basic tools of communication in the specialized fields of environmental sciences between speakers of these languages. Each chapter has been revised in each separate language by specialists in the field to guarantee the authenticity of the information presented. The author is unique in his approach, presenting the key-words in context, as opposed to simple glossary entries, allowing the reader to fully understand the complex relations between the word and the concepts involved. A comprehensive index written in all four languages guides the reader through the text, providing references to the words as they are used in different disciplines.

This volume contains: - Souverainete territoriale et globalisation des marches: le domaine d'application des lois contre les restrictions de la concurrence, par J. BASEDOW, professeur a l'Universite libre de Berlin. The number of national laws that protect competition against private restrictions are constantly increasing. Their application to trans-boundary situations poses difficult problems for both private international law and public international law. The course deals with both, either with respect to application of the "lex fori" or with respect to application of foreign laws. - Enforcement in the International Context by K.D. KERAMEUS, Professor at the University of Athens. In recent years, enforcement proceedings have gone through a comprehensive reform in many countries. Furthermore, modern enforcement increasingly relies on foreign judgements. The course focuses on three subjects: the comparative element in recent codifications and case-law developments in the area of enforcement: salient and converging trends in the enforcement of foreign judgments on the basis of domestic law or international conventions: and the delimitation of "lex fori"and foreign law during the enforcement proceedings. Book Environmental Principles

    Book Details:
  • Author : Nicolas de Sadeleer
  • Publisher : Oxford University Press
  • Release : 2020-10-30
  • ISBN : 0192582674
  • Pages : 593 pages

Download or read book Environmental Principles written by Nicolas de Sadeleer and published by Oxford University Press. This book was released on 2020-10-30 with total page 593 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book traces the evolution of environmental principles from their origins as vague political slogans reflecting fears about environmental hazards to their embodiment in enforceable laws. Environmental law has always responded to risks posed by industrial society but the new generation of risks have required a new set of environmental principles, emerging from a combination of public fears, science, ethics, and established legal practice. This book shows how three of the most important principles of modern environmental law grew out of this new age of ecological risk: the polluter pays principle, the preventive principle, and the precautionary principle. Since the first edition was published, the principles of polluter-pays, prevention, and precaution have been encapsulated in a swathe of legislation at domestic and international level. Courts have been invoking environmental law principles in a broad range of cases, on issues including GMOs, conservation, investment, waste, and climate change. As a result, more States are paying heed to these principles as catalysts for improving their environmental laws and regulations. This edition will integrate to a greater extent the relationship between environmental principles and human rights. The book analyses new developments including the EU Charter of Fundamental Rights, the case law of the European Court of Human Rights, which has continuously carved out environmental duties from a number of rights enshrined in the European Convention of Human Rights, and the implementation of the UNECE Convention on Access to Information.

Book Integrated Water Management in Canada

Download or read book Integrated Water Management in Canada written by Dan Shrubsole and published by Routledge. This book was released on 2018-12-07 with total page 182 pages. Available in PDF, EPUB and Kindle. Book excerpt: This volume provides readers with an opportunity to learn from front line water managers of watershed-based agencies across Canada about integrated water management (or integrated water resource management). In common with practice in much of the world, the responsibility for implementing integrated watershed management in Canada is fragmented. Each province and territory in Canada has developed unique approaches or governance models to guide decision making in that regard. Thus, this edited volume enables readers from around the world to gain insight on the best practices in Canada for achieving success and addressing barriers to implement IWM. Although there remains non consensus about how to "best" approach river basin management, some of the main observations include: There is a need to balance a focus on "the big picture", with scoping the scale and scope of planning activities in order that feasible and effective solutions can be implemented Three types of integration are popular among the agencies included in the book: (i) among environment, economy and society, (ii) interactions between people and the environment and (iii) integration (or coordination) of administrative activities. Much more attention is required to achieving effective engagement from Indigenous communities The chapters were originally published in a special issue of the International Journal of Water Resources Development.
