Con i primi due articoli del decreto-legge c.d. sbloccacantieri (18 aprile 2019, n. 32) si è intervenuto in via d’urgenza su alcuni temi nevralgici: dalla generalizzazione del criterio del prezzo più basso per gli affidamenti sotto soglia comunitaria all’esclusione automatica delle offerte anomale con un nuovo metodo di calcolo, dai motivi di esclusione alla percentuale di affidamento del subappalto, dall’eliminazione del rito superveloce al ritorno al c.d. regolamento unico. All’esito di un tormentato percorso parlamentare, la legge di conversione (14 giugno 2019, n. 55) ha tuttavia modificato in più punti il testo del decreto-legge, a partire dalle ripartizione delle soglie intermedie per gli affidamenti dei contratti sotto il limite europeo, prevedendo addirittura ipotesi di sospensione a tempo di alcuni istituti. La presenza di un così imponente e innovativo materiale normativo impone una nuova edizione del Codice dei contratti pubblici, la quale, oltre alla consueta ricchezza dell’apparato di richiami, di leggi complementari e di indici, comprende, per una più chiara sinossi dei testi, sia quello del codice integrato in fase di conversione, sia – nella sua veste originaria – quello del decreto-legge che, per essere stato vigente quasi due mesi, continua a costituire una fonte rilevante per le procedure avviate sotto il suo vigore.
