Book excerpt: Le contrat de mandat est un instrument juridique ancien qui fut, pendant un temps, davantage regardé comme un service d'ami que comme un contrat d'affaire. Depuis longtemps déjà, il s'est cependant éloigné de son rôle liminaire pour devenir un outil indispensable du monde des affaires. Ce phénomène de professionnalisation revêt une telle importance qu'il n'a pu se réaliser sans entraîner des changements cruciaux sur le régime général du mandat. C'est cet impact sur les obligations du mandant que nous avons tenté de retranscrire au travers de cette étude. Le mandant est ainsi désormais tenu de payer l'exécution de la mission. Les juges ont en effet progressivement favorisé la rémunération du mandataire. Dans le même sens, l'obligation d'indemnisation des pertes dun mandataire s'est naturellement intensifiée. Au-delà de ces obligations purement pécuniaires, le mandant est désormais également tenu de collaborer à l'éxécution de la mission. Le respect du devoir de bonne foi a permis l'élaboration d'une obligation mise à la charge du mandant de ne pas nuire à l'éxécution de la mission. La notion de bonne foi ne permet cependant pas de combler l'ensemble des exigences professionnelles. Dans le but d'imposer au mandant de participer activement à l'éxécution de la mission, la doctrine et les juges se sont ainsi tacitement appuyés sur les règles spécifiques de l'agence commerciale. L'évolution du contrat de mandat s'est donc réalisée progressivement par la "contamination" du régime général par les normes professionnelles. Les obligations d'assistance et d'information lors de l'exécution du contrat en sont le reflet. La légitimité de cette transposition nous a cependant interpellé. L'analyse des différents concepts mis en jeu nous a finalement permis de relever que ce phénomène n'est envisageable que sous le couvert du respect du devoir de coopération
