Book excerpt: While BSE has not been found in the United States, federal actions do not sufficiently ensure that all BSE-infected animals or products are kept out or that if BSE were found, it would be detected promptly and not spread to other cattle through animal feed or enter the human food supply. With regard to imports, the United States had imported about 125 million pounds of beef (0.35 percent of total imported) and about 1,000 cattle (0.003 percent of total imported) from countries that later discovered BSE during the period when BSE would have been incubating. In addition, weaknesses in USDA's and FDA's import controls, such as inspection capacity that has not kept pace with the growth in imports, may allow BSE-infected products to enter the country. With regard to animal testing to detect BSE, although USDA has steadily increased the number of animals it tests, it does not include many animals that die on farms. Experts consider these animals a high-risk population. Concerning the feed ban, FDA has not acted promptly to compel firms to keep prohibited proteins out of cattle feed and to label animal feed that cannot be fed to cattle. We identified some noncompliant firms that had not been reinspected for 2 or more years and instances when no enforcement action had occurred even though the firms had been found noncompliant on multiple inspections. Moreover, FDA s data on inspections are severely flawed and, as a result, FDA does not know the full extent of industry compliance. FDA acknowledges that it has not yet identified and inspected all firms subject to the ban. In terms of the public health risk, consumers do not always know when foods and other products they use may contain central nervous system tissue, which, according to scientific experts, could pose a health risk if taken from diseased animals.

Book excerpt: Most countries banned U.S. beef after the December 2003 report of BSE (bovine spongiform encephalopathy, or mad cow disease) in a Canadian-born cow found in Washington state. Several of these markets have partially reopened. However, Japan and Korea, which together had purchased about 60% of all U.S. beef exports in 2003, remain closed. Further progress was clouded by reports of BSE in the first U.S. native-born cow, initially tested in November 2004 but not confirmed until June 2005. Japan says it is working to finalize its rules to admit U.S. beef, following an October 2004 framework agreement to restart trade. However, Administration and industry officials, and many members of the House and Senate, have expressed frustration with the pace of Japanese rulemaking to date. Bills (S. 1922/H.R. 4179) are pending which would impose $3.14 billion in retaliatory tariffs on Japanese imports if Japan does not lift the beef ban by December 15, 2005. USDA said that total U.S. beef exports in 2004 reached only 17% of their 2003 level of about 2.5 billion pounds; 2006 exports are expected to be 639 million pounds. However, strong domestic demand and tight cattle supplies kept U.S. cattle prices relatively high throughout 2004 and much of 2005. Canadaâ€TMs own first native BSE case was reported in May 2003. So far, a total of five native cases have been found in North America (one U.S.-born and four Canadian-born cattle). BSE-contaminated feed is considered the likely cause of infection in all cases. Some Canadian beef has been permitted into the United States since August 2003. USDA published a final rule, on January 4, 2005, that is also now allowing younger live cattle and additional Canadian ruminant products to enter. A U.S. judgeâ€TMs March 2, 2005, preliminary injunction to block the rule was reversed by an appeals court on July 14, 2005. In Congress, the Senate on March 3, 2005, passed a joint resolution (S.J.Res. 4) to overturn the Canada rule. However, a resolution must pass the House (where similar H.J.Res. 23 was introduced) and be signed by the President, which most observers believe is unlikely. Several other BSE-related measures have been introduced, including H.R. 187, H.R. 384, H.R. 1254, H.R. 1256, H.R. 2068, H.R. 3170, H.R. 3931, S. 73, S. 108, S. 294, S. 1300, S. 1331, S. 1333, and S. 1779. USDA and other experts contend that the risk to human health from a few U.S. BSE cases is minimal. Nonetheless, closer scrutiny has been paid to the effectiveness of BSE safeguards, which now include import restrictions on countries with BSE; a ban on downer (nonambulatory) cattle from human food; keeping from the food supply additional higher-risk animal parts; a prohibition on feeding most mammalian protein to cattle; and extensive testing and research, among other things. After 74 weeks, more than 510,000 cattle had been tested, all but one negative for BSE, under an expanded surveillance program. The Food and Drug Administration (FDA) on October 6, 2005, proposed long-awaited rules to further restrict the cattle parts which may be used in all animal feeds.

Book excerpt: The positive identification of bovine spongiform encephalopathy or BSE, commonly known as "mad cow disease," in a Washington State cow in December of 2003 sparked a number of reactions from the federal government, the meat industry, and close to forty countries world-wide. The U.S. Department of Agriculture (USDA), for example, launched an extensive BSE sampling and surveillance program designed to test more high-risk cattle with the assistance of designated state and university diagnostic laboratories across the country. USDA implemented the new program in June of 2004, and uses USDA-approved "rapid" immunologic test kits. Most countries, however, quickly banned the importation of United States beef following the announcement. In an effort to meet new consumer demand, some private slaughterers propose to test 100% of their cattle using USDA approved "rapid test" kits. For example, Creekstone Farms Premium Beef, a private specialty producer and processor of Black Angus Beef, sought approval from the USDA to conduct voluntary BSE rapid testing for all the cattle it processes in order to promote sales, especially exports. The USDA, however, rejected Creekstone's request primarily because the test had only been licensed for animal health "surveillance" purposes and "the test as proposed by Creekstone would have implied a consumer safety aspect that is not scientifically warranted." The USDA's rejection of Creekstone's request to privately test all of its cattle for BSE ignited a significant amount of debate and resulted in the filing of a lawsuit by Creekstone on March 23, 2006, against the USDA. At issue is whether the USDA's decision to reject Creekstone's request to test all of its animals for BSE was a valid agency action. This report examines the legal authority of the USDA's Animal and Plant Health Protection Service to regulate all testing for BSE, particularly the voluntary testing of 100% of a private company's animals with rapid test kits and the USDA's recent rejection of Creekstone's application to test all of the cattle it processes for BSE. This analysis encompasses some of the legal arguments that have or might be presented in the Creekstone lawsuit. This report does not discuss the possible role that the Food and Drug Administration may play in the regulation of BSE testing and surveillance.
