La alarma social ocasionada en los medios de comunicación por diversos episodios relativos a imágenes pornográficas, protagonizadas principalmente por niños o menores, ha suscitado un enconado debate a nivel político y social, que demandaba con urgencia una reforma del Código penal, cuya “eficacia” había sido puesta en tela de juicio por la opinión mayoritaria, sobre todo en lo relativo a la protección de las víctimas más desvalidas en el ámbito de la delincuencia sexual. En un trazado histórico, merece subrayarse la LO 3/1989, que representó una revolución en el ámbito de los delitos sexuales, al abandonar la anacrónica rúbrica de “Delitos contra la honestidad” por la de “Delitos contra la libertad sexual”, considerando a esta última como bien jurídico digno de tutela penal. Posteriormente, la reforma por LO 11/1999 significó una ampliación del epígrafe Título VIII, tutelando junto a la libertad sexual, la indemnidad sexual, para los casos de atentados sexuales que afectasen a menores e incapaces. Asimismo, se trata un nuevo límite para la mayoría de edad sexual, elevándose desde los doce a los trece años, para los abusos y agresiones sexuales. En esta evolución legislativa, la LO 15//2003, comportó notablemente una mejora técnica, cubriendo algunos vacíos legales, a la par de un endurecimiento punitivo, extendiendo la tipicidad al delito de corrupción de menores. De otro lado, la redacción otorgada a los delitos de abusos sexuales con menores, a partir de la LO 5/2010, 22 de junio, supuso un giro político-criminal trascendente, rompiendo con la estructura técnica de las diversas infracciones sexuales, cuya distinción se había cifrado en la modalidad de ataque a la libertad e indemnidad sexuales (violencia o intimidación).Y desde luego, si bien es cierto que la reciente modificación por LO 1/2015, acaecida en el ámbito de los delitos de pornografía infantil se debe, por un lado, a la alarma social y a la repugnancia que estos frecuentes episodios han suscitado en nuestro país, no es menos cierto que su principal justificación se fundamenta en la armonización europea, o por decirlo de otro modo, en la necesidad de atender a los compromisos internacionales suscritos por España, principalmente la transposición de la Directiva 2011/93/UE, relativa a la lucha contra los abusos sexuales y la explotación sexual de los menores y la pornografía infantil. La obra que se presenta al lector pretende dar respuesta a estos y otros interrogantes desde la perspectiva de un Derecho penal, abordando un exhaustivo estudio del delito contenido en el artículo 189 CP, comenzando con unas reflexiones político-criminales en torno a la pornografía infantil, planteándose la aguda controversia sobre la necesidad o no de su criminalización, principalmente, con relación a la pornografía simulada o virtual, desde un marco legal internacional, examinando no sólo el ámbito de las organizaciones internacionales, sino además el de la Unión Europea. En este contexto, delimita y define el concepto de pornografía infantil, tomando como referente el Derecho comparado de los Ordenamientos Italiano, brasileño, Australiano y Estadounidense.
