Tal contexto ha dado lugar a la tipificación de la explotación sexual de animales en el Código penal español a través de la reforma operada por el legislador en 2015. No obstante, las preguntas que debemos hacernos son: ¿es suficiente?, ¿al fin se encuentran los animales verdaderamente protegidos frente a los abusos y las agresiones sexuales? Para contestar a estas preguntas, el presente libro analiza tanto el derecho penal español como el derecho penal francés para identificar los avances y las limitaciones de la legislación española, tanto individualmente como en comparación con la regulación existente en Francia, país que históricamente ha influenciado en gran medida el ordenamiento jurídico español.

Se han dictado sentencias de culpabilidad por maltratar animales, pero "si el maltratador no tiene antecedentes penales, se suele conmutar la pena de prisi?n por la sanci?n econ?mica que el juez estime oportuna". Las asociaciones protectoras de animales tambi?n piden que los jueces dicten sentencias ejemplares. "Este aspecto es necesario para castigar a los maltratadores de animales", las sentencias no siempre implican "una pena adecuada", sino que en ocasiones "pueden ser demasiado blandas". El C?digo Penal ya ha experimentado algunos cambios para proteger a los animales. En 2010, se elimin? la palabra "ensa?amiento" como condici?n para poder castigar el maltrato de perros y gatos. En 2004, se incluy? la posibilidad de castigar al maltratador con la inhabilitaci?n para la tenencia de animales. "Gracias a las leyes, es posible denunciar cualquier caso de maltrato hacia perros y gatos, aunque nos gustar?a que las leyes auton?micas fueran m?s duras", las normativas sobre protecci?n animal que castigan a los maltratadores de animales en otros pa?ses europeos, como Alemania y Reino Unido, cuentan con mecanismos m?s eficaces. El maltrato, f?sico o psicol?gico, deja secuelas en el perro que lo ha sufrido. El comportamiento de un animal que ha padecido abusos por parte de su due?o cambia, en especial si ?stos se prolongan durante meses o a?os. Un can desconfiado, con problemas para relacionarse con otros animales o personas de su entorno, e incluso ciertos tipos de agresividad, puede estar indicando que el perro ha sido maltratado y que, por lo tanto, que necesita ayuda. Un perro que ha sido maltratado puede mostrarse triste, depresivo o repetir de forma compulsiva determinados comportamientos, como el ladrar a todas horas. Los golpes, lesiones f?sicas y los gritos excesivos y el abandono del perro son solo algunos ejemplos de los da?inos y crueles abusos que puede llegar a experimentar una mascota. La falta de comida o de agua, permanecer atado en lugares hostiles (con fr?o, humedad o, por el contrario, bajo el sol) o la falta de atenci?n m?dica requerida, ampl?an la lista de conductas que pueden ser consideradas como maltrato animal. El abuso sobre los animales no es solo una conducta cruel y deplorablesino que deja, adem?s, importantes secuelas en el perro que lo sufre. En casos de maltratos, la mascota precisa una reeducaci?n espec?fica que le ayude a confiar en su nuevo due?o y que le proporcione la serenidad y la calidad de vida que todo perro merece. La paciencia y las repetidas demostraciones de cari?o ser?n clave para ayudar a la mascota maltratada a que conf?e en su nueva familia. Un perro que ha sufrido maltrato f?sico o psicol?gico puede padecer importantes trastornos en su comportamiento. La desconfianza hacia las personas o hacia otros perros, la tristeza, los s?ntomas de depresi?n e incluso determinados comportamientos agresivos pueden explicarse, en ocasiones, como consecuencia del maltrato sufrido. Un abuso repetido durante meses e incluso a?os suele agudizar el comportamiento an?malo de tristeza y depresi?n caracter?stico de un perro maltratado . El C?digo Penal protege a los perros frente al maltrato, y tipifica como delito las conductas abusivas contra los "animales dom?stico y amansados". Quienes abusen de un perro pueden ser castigados con entre tres meses y un a?o de c?rcel. This report specifically reviews the evidence on the potential mechanisms by which smoking causes diseases and considers whether a mechanism is likely to be operative in the production of human disease by tobacco smoke. This evidence is relevant to understanding how smoking causes disease, to identifying those who may be particularly susceptible, and to assessing the potential risks of tobacco products.
