Book excerpt: International commercial gas sale agreements are often characterised by a duration of twenty years or more. Consequently, when unforeseen events alter market conditions the contractual equilibrium originally found by the parties is disrupted, giving rise to the necessity to renegotiate and adapt the agreement. If negotiation fails, the parties in most cases submit the matter to arbitration. This comprehensive analysis of what can happen under such circumstances proceeds from an in-depth consideration of the power of arbitrators to intervene on the agreement in the light of arbitrability and procedural law. The author fully explains the complex special nature of gas pricing and contract clauses, and takes into account such features as the following, especially in the wake of the 2009 crisis as it affected the gas sector: - take or pay clauses; - mechanisms for gas price calculation; - price review and price re-opener clauses; - hardship provisions; - problems arising from the absence of a specific clause providing for adaptation/adjustment; - effect on contracts of the emergence and development of spot or traded gas markets; and - trend toward introducing spot-market elements into an oil-indexed price formula. The analysis draws on interviews with lawyers and arbitrators who have been involved in recent proceedings regarding gas sale contract adaptations, and also considers court decisions issued in setting aside or enforcing arbitration awards handed down in energy disputes. A central discussion throughout this book is the possible responses to the question of whether it is possible to determine a principle of law justifying the arbitrator’s power to intervene in contract adaptation. All professionals involved in the production, wholesaling, or distribution of gas will find this book indispensable. Extensive genetic variation exists between varieties/breeds in a species and amongst individuals within breeds. This variation has developed over very long periods of time. A major ongoing challenge is how to best utilize this variation to meet short-term demands whilst also conserving it for longer-term possible use. Many animal breeding programs have led to increased performance for production traits but this has often been accompanied by reduced fitness. In addition, the global use of genetic resources prompts the question whether introduced genotypes are adapted to local production systems. Understanding the genetic nature of fitness and adaptation will enable us to better manage genetic resources allowing us to make efficient and sustainable decisions for the improvement or breeding of these resources. This book had an ambitious goal in bringing together a sample of the world’s leading scientists in animal breeding and evolutionary genetics to exchange knowledge to advance our understanding of these vital issues.

This research agenda is relevant for governments and institutions that wish to support developing countries in adapting to climate change. The workshop brought together experts from developing and industrialized countries, non-governmental organizations, and multilateral and bilateral donor organizations to discuss a number of important topics related to adaptation, adaptive capacity and sustainable development. A dozen papers were commissioned to cover these topics, both from a theoretical perspective and in the form of national case studies. Frank Porporino and I arrived at the starting point for our work together by very different routes. Originally trained as an experimental psychologist, I had become in creasingly restive within the confines of the laboratory, and spent a sab batical year in the equivalent of a clinical internship. I then spent some time as a part-time consultant in a local penitentiary. Most of my time in the institution was spent with inmates with a variety of problems, probably about 50 individuals over the course of a year. Although this was far fewer than a full-time psychologist in the system might encounter, it served as a quick cram course on problem prisoners and prisoner problems. Very quickly my stereotypes about convicts were shown to be virtually useless. I learned that the criminal classes included all levels of society, and that the behavior of prisoners was the same as that of other human beings in a difficult environment.

The opening section discusses the possible ways of generating circannual cycle in constant condition and the historical progress in understanding the mechanism of shallow, daily torpor and its distribution in various families predominantly from the marsupial, insectivore, and rodent orders. The application of simple economic models to biological systems to illustrate the principles of torpor in non-mammalian organisms and temperature regulation is also described in this text. Section II examines the central nervous structures involved in thermoregulation in hibernators and compares these data with the results of corresponding experiments in non-hibernators. Topics on the influence of serotonergic pathways in the brain on hypothalamic hormonal factor release and the maintenance and regulation of hibernation through a parasympathetic response are discussed in this section. Section III deals with the cellular and biochemical adaptations in natural torpidity, with an emphasis on the metabolic and endocrine changes in hibernation. Section IV tackles postulated mechanisms for nonshivering thermogenesis and the neurohumoral factors regulating these mechanisms in mammals exposed to short-term as well as to prolonged periods of cold. A discussion on significance and possible central mechanisms of thermoregulatory threshold deviations in the course of thermal adaptation is also provided.
