Book excerpt: This study was conducted within the CIRIEC International Scientific Commission 'Public Services/Public Enterprises' project on Local services of general economic interest. Compared to other sectors, the process of Europeanization has distinct features in the water field. At EU level, water policy is rather founded on the respect of common ambitious quality standards based on public health and environmental protection norms than the creation of an 'internal market'. Therefore, the evolution of different models of governance, organization and supply have undergone specific changes. This study focuses on local and national diversity of water services and the broad outlines of current challenges and developments. It concludes that a key challenge is to guarantee the competent public authorities' freedom of choice of management modes.

Book excerpt: This book provides a comprehensive examination of the interaction between Services of General Economic Interest (SGEI) and EU competition law, covering in particular Article 106 of the Treaty on the Functioning of the European Union (TFEU) and state aid rules. It also takes the telecommunications, postal service and transport sectors as case studies, taking into account the technological, economic and political backgrounds to these sectors. The area of SGEI has undergone fundamental developments over the past three decades and the most recent changes in the Lisbon Treaty, recognizing SGEI as a shared value and granting explicit competence to the EU, mark its constitutional significance. The key issue is how to balance economic values underlying competitive markets and non-economic public service values such as universal access to essential services. The essence of the question is the relationship between the market and the state. This controversial issue is addressed through a critical analysis of a number of landmark EU Court judgments and Commission decisions over the decades. Offering a clear appreciation of the evolution of the EU regulatory framework on SGEI that lays out the limits and boundaries within which the Member States define, organize and fund SGEI, the book is particularly aimed at academics with a research interest in the interaction between public services and EU competition law, but as it also demonstrates clearly how the application of EU competition law has transformed the public utilities sectors, it will be of interest to law makers, legal professionals and policy makers as well. Dr. Lei Zhu is a Research Associate at the Institute of International Law at Wuhan University in Wuhan, China. Analyses are also provided on how the EU legislator engages in the Europeanisation of social services through EU procurement and state aid rules that have an ambiguous relationship to the Treaty framework on SGEI. Some explanation to this ambiguity is proposed by studying how the application of EU state aid rules could hinder the development of Swedish systems of choice liberalizing publicly-funded elderly care and school education. However, the Member States are increasingly modernizing social services and social (welfare) protection, attempting to make social services more efficient by increasingly looking to the market for the provision of such services. This policy move brings social services into the radar of EU law. The EU response to this sensitive issue has resulted in a piecemeal and fragmented approach towards the treatment of a new policy area of Social Services of General Interest (SSGI) in EU law and policy. This book is a first contribution towards charting how SSGI have emerged as a special category of SGI in the EU, the reaction of the Member States and stake-holders and how policy is being made through new governance processes, carve-outs and safe havens in legislation and soft law, especially in the light of the new values of the EU introduced by the Treaty of Lisbon 2009. Moreover, climatic differences between North and South contribute to widen the divide. This disparity has notable consequences of socio-economic character, some of which, in turn, feed back into the environmental conditions of Italian regions: pollution, floods, landslides and droughts are among the problems affecting the country. There are numerous features of water use and consumption that distinguish Italy from other comparable countries, such as the significant role played by agriculture (a water-intensive activity), a lead position in the consumption of bottled water, lower-than-average prices of water and a far-from-optimal efficiency of waterworks. All such aspects, and many others, make Italy an essential case study.
