Book excerpt: In this study, Calum Carmichael offers a new assessment of the Joseph story from the perspective of the biblical laws in Leviticus 1-10. These sacrificial laws, he argues, respond to the many problems in the first Israelite family. Understanding how ancient lawgivers thought about Joseph's and his brothers' troubling behavior leads to a greater appreciation of this complicated tale. The study of the laws in Leviticus 1-10 in relation to the Joseph story provides evidence that all biblical laws, over 400, constitute commentary on issues in the biblical narratives. They do not, as commonly thought, directly reflect the societal concerns in ancient Israelite times. Through close reading and analysis, Carmichael reveals how biblical narrators and lawgivers found distinctive and subtle ways of evaluating a single development in a narrative from multiple perspectives. Thus, the sacrificial laws addressing idolatry, keeping silent about a known offense, confessing wrongdoing, and seeking forgiveness become readily understandable when reviewed as responses to the events in the Joseph story.

Book excerpt: This book offers a new theory of property and distributive justice derived from Talmudic law, illustrated by a case study involving the sale of organs for transplant. Although organ donation did not exist in late antiquity, this book posits a new way, drawn from the Talmud, to conceive of this modern means of giving to others. Our common understanding of organ transfers as either a gift or sale is trapped in a dichotomy that is conceptually and philosophically limiting. Drawing on Maussian gift theory, this book suggests a different legal and cultural meaning for this property transfer. It introduces the concept of the "divine lien," an obligation to others in need built into the definition of all property ownership. Rather than a gift or sale, organ transfer is shown to exemplify an owner's voluntary recognition and fulfillment of this latent property obligation.

David Daube's life spanned almost the entire 20th century and he was witness to its history. Born a Jew in Germany in 1909, he spent World War II and its aftermath in Britain on the faculties of Cambridge, Aberdeen, and Oxford. He came to the United States in the '60s-to the University of California at Berkeley where he reveled in what he called the "unmanicured, unclubbable, countercultural attitudes." Naturally, having escaped from Hitler's clutches myself, I am a bit more alive to the whole business than the average guy." The books's editor, Calum Carmichael, Professor of Comparative Literature and Adjunct Professor of Law at Cornell, has degrees in science, historical theology, and law from the Universities of Glasgow, Edinburgh, and Oxford. He teaches biblical and cognate (Near Eastern and Talmudic) literature as well as courses on law and literature in antiquity. He is the author of nine books that focus primarily on biblical law; the editor of a six volume series devoted to the work of David Daube who was his teacher at Oxford; and the author of a memoir, "Ideas and the Man: Remembering David Daube.
