It also shows that such laws are a direct threat to the American interest of advancing democracy and human rights, that the United States lacks a policy for dealing with the spread of extreme shari'a, and concludes with policy recommendations for the United States regarding specific countries confronting extreme shari'a.

Ce sont des conclusions beaucoup plus mitigées que tirent Olivier Blanchard et Jean Tirole dans leur rapport, qui se penche sur les institutions et règles de la protection de l’emploi en France. Les contraintes administratives et légales ainsi que les indemnités et paiements versés lors de licenciements semblent en effet accroître la durée du chômage et rendre le marché du travail moins réactif, mais l’effet net sur le taux de chômage serait, lui, incertain. La généralisation des contrats à durée déterminée introduit cependant un marché du travail dual peu efficace, d’autant plus que la législation actuelle incite à ne pas transformer ces contrats en emplois plus stables. Olivier Blanchard et Jean Tirole s’interrogent sur la rationalité de la politique française d’indemnisation du chômage et de contrôle des licenciements. Le système actuel dans lequel l’entreprise ne paie rien à la caisse d’assurance chômage en cas de licenciement implique une double incitation à licencier. Ils défendent l’idée que, comme toute externalité, les coûts sociaux liés aux pertes d’emploi doivent être « internalisés » et qu’il conviendrait donc d’instaurer un principe revenant à taxer les licenciements. Ils donnent divers arguments justifiant que cette taxe ne devrait pas financer intégralement le montant des assurances chômage versées, mais des systèmes de responsabilisation des entreprises, sur le modèle de ceux existant dans de nombreux États américains, pourraient être introduits. La contrepartie devrait en être une moindre ingérence des juges dans les procédures de licenciement. Les diverses propositions faites par Olivier Blanchard et Jean Tirole sont discutées par Fiorella Kostoris Padoa Schioppa, et par Jacques Freyssinet, qui ne partagent pas toutes les conclusions dur rapport. Jacques Freyssinet, en particulier, se montre sceptique quant à la remise en cause radicale des compromis successifs qui ont construit le système français d’indemnisation du chômage. Substituer à un régime paritaire mutualisé un régime de taxes payées par chaque entreprise à une agence indépendante relève, selon lui, d’une vision réductrice des problèmes sociaux liés aux licenciements.
