Book excerpt: Increasing scarcity, conflict, and environmental damage are critical features of the global water crisis. As governments, international organizations, NGOs, and corporations have tried to respond, Chilean water law has seemed an attractive alternative to older legislative and regulatory approaches. Boldly introduced in 1981, the Chilean model is the worlds leading example of a free market approach to water law, water rights, and water resource management. Despite more than a decade of international debate, however, a comprehensive, balanced account of the Chilean experience has been unavailable. Siren Song is an interdisciplinary analysis combining law, political economy, and geography. Carl Bauer places the Chilean model of water law in international context by reviewing the contemporary debate about water economics and policy reform. He follows with an account of the Chilean experience, drawing on primary and secondary sources in Spanish and English, including interviews with key people in Chile. He presents the debate about reforming the law after Chile‘s 1990 return to democratic government, as well as emerging views about how water markets have worked in practice. The resulting book provides insights about law, economics, and public policy within Chile and lessons for the countries around the world that are wrestling with the challenges of water policy reform.

Murillo's analysis of the Latin American electricity and telecommunications sectors shows that different degrees of electoral competition and the partisan composition of the government were crucial in resolving policymakers' tension between the interests of voters and the economic incentives generated by international financial markets and private corporations in the context of capital scarcity. Electoral competition by credible challengers dissuaded politicians from adopting policies deemed necessary to attract capital inflows. When electoral competition was low, financial pressures prevailed, but the partisan orientation of reformers shaped the regulatory design of market-friendly reforms. In the post-reform period, moreover, electoral competition and policymakers' partisanship shaped regulatory redistribution between residential consumers, large users, and privatized providers.

How and when can democracies tax economic elites? This book develops a theoretical framework that refines and integrates the classic concepts of business's instrumental (political) power and structural (investment) power to explain the scope and fate of tax initiatives targeting economic elites in Latin America after economic liberalization. In Chile, business's multiple sources of instrumental power, including cohesion and ties to right parties, kept substantial tax increases off the agenda. In Argentina, weaker business power facilitated significant reform, although specific sectors, including finance and agriculture, occasionally had instrumental and/or structural power to defend their interests. In Bolivia, popular mobilization counterbalanced the power of economic elites, who were much stronger than in Argentina but weaker than in Chile. The book's in-depth, medium-N case analysis and close attention to policymaking processes contribute insights on business power and prospects for redistribution in unequal democracies.

Can these vast, complex entities, rife with inequalities and divisions, be governed effectively? For researchers, the answer has often been no. The approach developed in this work focuses on the material city and its institutions and shows that, without recourse to a big new theory, urban leaders have devised mechanisms of ordinary government. They have done so through the resolution of practical and essential problems: providing electricity, drinking water, sanitation, transportation. Three findings emerge from this book. Infrastructure networks help to structure cities and function as mechanisms of cohesion. Megacities become more governable if there is a legitimate authority capable of making choices. Finally, anarchic urbanisation has its roots in systems of land ownership, in inadequate urban planning and in the practices of developers and local actors. In the originality of its hypotheses and the precision of the analyses carried out in the four case study cities of Shanghai, Mumbai, Cape Town and Santiago de Chile, this work is addressed to all those interested in the life of cities: politicians, local and central government officials, executives in urban companies, researchers and students.
