Book excerpt: This book provides a thorough and rigorous discussion on the impact of trade liberalisation on economic development with a special focus on the African continent. The author presents the rationale for trade liberalisation, trade liberalisation frameworks, the trade liberalisation economic development nexus, impediments to trade, and contemporary issues of international trade. In this book, notwithstanding the benefits from trade liberalisation, the author shows that African trade as a share of global trade has remained flat at 3% as in 1975, while the continent’s exports have remained raw materials and its intra-regional trade at less than 15% of total trade, which is the lowest in the world (UNCTAD, 2020). With respect to key economic development indicators such as economic growth, poverty levels, and employment levels, this book shows that, ironically and in direct contrast with the conventional views that trade liberalisation alleviates poverty, trade liberalisation in Africa has resulted in high levels of unemployment and low economic growth which ultimately lead to increased poverty. In addition, this book provides a detailed analysis of why trade liberalisation has failed to yield meaningful benefits to Africa. The binding constraints and blockages which prevent positive spin-offs on trade liberalisation in Africa are discussed in detail in this book. In the same vein, the author provides practical strategies which must be adopted by African countries in order to gain from trade liberalisation, making this work a must-read for African governments, academia, trade experts, regional trading blocs, the World Trade Organization, and development partners. In view of this, and as part of the disruptive and structural transformation policies, the author discusses case studies and international experience contextualised to Africa as well as strategies for addressing the trade-related infrastructure gap, production capacities, export promotion, and aid for trade.

Regional trade blocs are formed by neighbouring countries or countries that are in close proximity to each other. The two key features of a trade bloc is that (1) it involves a cutback or abolition of obstacles to trade, and (2) the trade liberalisation that is attained through the trade bloc is discriminatory in purview of the fact that it is applicable only to the member states of the trade bloc and non-member countries are shown prejudice in their dealings with members of the trade bloc. The first aspect of trade blocs above is in line with the mission of the World trade Organisation (WTO) and its antecedent, the General Agreement on Tariffs and Trade (GATT). The principle of Non-discrimination under the GATT stipulates that no member state shall show prejudice between GATT members during the operations of world trade. In the same magnitude, the WTO offers an environment for negotiating agreements that are focused on reducing barriers to international trade and making sure that trade is carried out on a basis of openness, thus contributing to economic growth as well as development. Notably, although trade blocs have different structures, they are premised on the same objective, that is, to lessen trade barriers among member states. The second aspect of trade blocs however seems to be in conflict with the motive of the GATT/WTO system. The preamble of the GATT is very clear on promoting non-discrimination in international trade by reinforcing the need for reciprocal and equally advantageous arrangements focused on substantial cutbacks in tariffs and other obstacles to trade and to the abolition of discriminatory treatment in international trade. Equally, under the WTO as well as under its predecessor, the GATT, trade discrimination is promoted through the use of the principles of the Most-Favoured-Nation (MFN) that requires treatment of other people equally as pertains to trade and the principle of National Treatment which stipulates that foreigners and locals should be treated equally in trade matters. The above overview of regional trading blocs implies that different opinions can be stated regarding how trading blocs affect liberalisation of trade. [...]

Its ratification is expected in the near future and therefore the question arises in how far the creation of the free trade area will affect the patterns of intraregional trade. After an examination of the framework of preferential and free trade agreements in the region this study employs a customised methodology based on Viner's theory of customs unions in order to identify those areas of trade that will be affected by trade creation or trade diversion effects. I have examined the trade creation and trade diversion potential of the most relevant goods for each of the twelve SADC countries, resolved to a 2 digit HS code level. These results were then put into relation to the overall macroeconomic situation in each country. There were a number of data problems that make the findings of this study less meaningful. However, to some extent this report can be seen as a best possible approximation and as a starting point for further and more detailed research. The overall findings can be summed up as follows: · South Africa is not going to be the only winner from the free trade area and especially its textile and clothing sector might suffer as a result. · There are virtually no trade creation and trade diversion effects to be expected for the BLNS countries but there is a good possibility of additional exports. Therefore, they are likely to profit the most. · Angola and Mozambique will probably experience the strongest trade creation and trade diversion effects. This will be triggered mainly by free trade with South Africa and the fact that their industrial base is very weak and has just started recovering. Book excerpt: The major problem associated with the regulation of transnational mergers, which affect several national markets, is the allocation of jurisdiction. Each country concerned may wish to exert jurisdiction and apply its national competition law to regulate the anti-competitive effects a merger may have in its territory. However, this approach may lead to risks of inconsistent decisions regarding the legality of mergers. Indeed, the national competition laws applied by the regulating authorities may diverge in several aspects, which raise the likelihood of inconsistency. Therefore it is desirable to opt for regulatory approaches which are more sensitive to the transnational nature of mergers and which allow cooperation between competition authorities. A possible solution may be bilateral cooperation agreements through which two countries coordinate the enforcement activities of their national competition authorities. However, the benefits of these agreements are enjoyed only by the signatory parties. The sole reliance upon bilateral agreements does not appear to be the optimal regulatory approach towards transnational mergers.
