The neutral State enjoyed territorial inviolability to the extent that it adhered to the obligations attaching to its neutral status and thus the law of neutrality provided spatial parameters for the conduct of hostilities. Yet the basis on which the law of neutrality developed - the extra-legal character of war - no longer exists. Does the law of neutrality continue to survive in the modern era? If so, how has it been modified by the profound changes in the law on the use of force and the law of armed conflict? This book argues that neutrality endures as a key concept of the law of armed conflict. The interaction between belligerent and nonbelligerent States continues to require legal regulation, as demonstrated by a number of recent conflicts, including the Iraq War of 2003 and the Mavi Marmara incident of 2010. That the parties have chosen negotiations means that either side's failure to comply with its obligation to negotiate can result in an internationally wrongful act and, in response, countermeasures and other responses. Spanning the last quarter century,The International Struggle over Iraq examines the impact the United Nations Security Council has had on Iraq - and Iraq's impact on the Security Council. The story is a fascinating one. Beginning in 1980, in the crucible of the Iran-Iraq War, the Council found a common voice as a peacemaker after the divisions of the cold war. That peacemaking role was cemented when a UN-mandated force expelled Iraqi forces from Kuwait in 1991, offering a glimpse of a new role for the UN in the 'New World Order'. But unilateralism soon set in, as the Security Council struggled under the weight and bureaucratic demands of its changing identity. The Security Council gradually abandoned its traditional political and military tools for the legal-regulatory approach, but was unable to bridge the gap between those who believed allegations of Iraqi possession of weapons of mass destruction and those who didn't. Growing paralysis led eventually to deadlock in the Council in 2002, with the result that it was sidelined during the 2003 Coalition invasion. In addition, international and regional organizations have also performed peacekeeping functions. Since the establishment of the first UN peacekeeping mission, UNEF I, in 1956, international lawyers have raised questions about the legal aspects of these operations. Traditionally, they analyzed the constitutional basis for peacekeeping and tried to allocate the authority under the UN Charter for peacekeeping among the Security Council, the General Assembly and the Secretary General. They discussed the use of force by peacekeepers, the applicability of international humanitarian law, as well as the responsibilities and liabilities of peacekeepers. Since the end of the cold war, peacekeeping operations have become more complex. In the first forty years, peacekeepers functioned mainly as buffer zones between warring parties and monitored cease-fires. Nowadays, they are increasingly engaged in internal rather than international conflicts and perform a multitude of tasks. Among others, they act as civilian administrators, oversee elections and monitor human rights. These changes have raised new legal problems. Which human rights obligations exist for peacekeepers? Do peacekeepers have to intervene if they witness war crimes and acts of genocide? How are they protected under international law? What is the legal framework of UN administrations like in Kosovo and East Timor? In order to enhance a better understanding of these legal issues arising from peacekeeping operations, a collection of articles written by the leading experts in the field have been compiled in the volume, International Peacekeeping.
