Cindy Wittke focuses on two key issues: how international courts and tribunals deal with peace agreements; and what implications the United Nations Security Council's involvement in the negotiation and implementation of peace agreements has for the agreements' legal nature, the status of the non-state parties to agreements and the interpretation of peace agreements. Wittke argues that the processes of negotiating and implementing peace agreements between state and non-state parties create new spheres, spaces and forms of post-conflict law making and law enforcement. For example, contemporary peace agreements can simultaneously take the form and function of internationalised transitional constitutions and agreements governed by international law. The resulting characteristics of contemporary peace agreement lead to permanent ambiguities shaping their interpretation and enforcement.

In addition, international and regional organizations have also performed peacekeeping functions. Since the establishment of the first UN peacekeeping mission, UNEF I, in 1956, international lawyers have raised questions about the legal aspects of these operations. Traditionally, they analyzed the constitutional basis for peacekeeping and tried to allocate the authority under the UN Charter for peacekeeping among the Security Council, the General Assembly and the Secretary General. They discussed the use of force by peacekeepers, the applicability of international humanitarian law, as well as the responsibilities and liabilities of peacekeepers. Since the end of the cold war, peacekeeping operations have become more complex. In the first forty years, peacekeepers functioned mainly as buffer zones between warring parties and monitored cease-fires. Nowadays, they are increasingly engaged in internal rather than international conflicts and perform a multitude of tasks. Among others, they act as civilian administrators, oversee elections and monitor human rights. These changes have raised new legal problems. Which human rights obligations exist for peacekeepers? Do peacekeepers have to intervene if they witness war crimes and acts of genocide? How are they protected under international law? What is the legal framework of UN administrations like in Kosovo and East Timor? Book excerpt: The UN Security Council is entrusted under the UN Charter with primary responsibility for the maintenance and restoration of the international peace; it is the only body with the power to authorise military intervention legally and impose international sanctions where it decides. However, its decision-making process has hitherto been obscure and allegations of political bias have been made against the Security Council in its responses to potential international threats. Despite the rule of law featuring on the Security Council’s agenda for over a decade and a UN General Assembly declaration in 2012 establishing that the rule of law should apply internally to the UN, the Security Council has yet to formulate or incorporate a rule of law framework that would govern its decision-making process. This book explains the necessity of a rule of law framework for the Security Council before analysing existing literature and UN documents on the domestic and international rule of law in search of concepts suitable for transposition to the arena of the Security Council. It emerges with eight core components, which form a bespoke rule of law framework for the Security Council. Against this framework, the Security Council’s decision-making process since the end of the Cold War is meticulously evaluated, illustrating explicitly where and how the rule of law has been undermined or neglected in its behaviour. Ultimately, the book concludes that the Security Council and other bodies are unwilling or unable adequately to regulate the decision-making process against a suitable rule of law framework, and argues that there exists a need for the external regulation of Council practice and judicial review of its decisions.

Book excerpt: Climate migration, as an image of people moving due to sea-level rise and increased drought, has been presented as one of the main security risks of global warming. The rationale is that climate change will cause mass movements of climate refugees, causing tensions and even violent conflict. Through the lens of climate change politics and securitisation theory, Ingrid Boas examines how and why climate migration has been presented in terms of security and reviews the political consequences of such framing exercises. This study is done through a macro-micro analysis and concentrates on the period of the early 2000s until the end of September 2014. The macro-level analysis provides an overview of the coalitions of states that favour or oppose security framings on climate migration. It shows how European states and the Small Island States have been key actors to present climate migration as a matter of security, while the emerging developing countries have actively opposed such a framing. The book argues that much of the division between these states alliances can be traced back to climate change politics. As a next step, the book delves into UK-India interactions to provide an in-depth analysis of these security framings and their connection with climate change politics. This micro-level analysis demonstrates how the UK has strategically used security framings on climate migration to persuade India to commit to binding targets to reduce their greenhouse gas emissions. The book examines how and why such a strategy has emerged, and most importantly, to what extent it has been successful. Climate Migration and Security is the first book of its kind to examine the strategic usage of security arguments on climate migration as a political tool in climate change politics.
