Une analyse qui intègre plusieurs niveaux de production de politiques publiques peut nous offrir des clefs explicatives de ces transformations. Ce changement dans le champ du handicap a démarré au niveau de l’ONU pour se diffuser ensuite au sein de l’Union européenne. Nous analysons l’évolution de l’espace européen d’action publique dans le domaine du handicap qui connaît une institutionnalisation sous l’empreinte de l’ONU, mais qui est, également, signe de la manifestation d’un processus d’intégration européenne. En même temps les évolutions récentes des politiques publiques du handicap des Etats membres ne peuvent plus être comprises sans faire appel à des phénomènes d’ordre européen et international. Nous avons saisi la mesure des variations de l’européanisation et de l’influence internationale dans les espaces nationaux à travers une comparaison des deux cas contrastés, la France et la Roumanie. Cette comparaison nous a montré la manière dont ces deux pays opèrent le changement du modèle médical vers le modèle social du handicap dans un contexte commun d’influence internationale et d’européanisation.

L’école a beau se dire inclusive, si elle ne fournit pas à un élève non voyant les aménagements adaptés, elle ne l’est pas dans les faits. Au fil des ans et des mobilisations, une multitude de droits ont été reconnus aux personnes handicapées. En quoi ont-ils changé leur vie quotidienne ? À partir de récits biographiques recueillis auprès d’individus ayant des incapacités motrices ou visuelles, l’auteure montre que les droits associés au handicap, souvent imprécis dans les textes, souffrent de défauts majeurs de mise en oeuvre. Pourtant, face à ces droits vulnérables, les individus sont actifs, dotés d’esprit critique et porteurs d’innovations. À l’école, dans l’entreprise, auprès des administrations ou dans les transports publics, ils protestent, négocient, bricolent et aménagent leurs droits, pour rompre avec la citoyenneté de seconde zone qui leur reste assignée. Women, and not their unborn children, were the initial focus of that medical attention, but prenatal diagnosis in its present form, which couples scrutiny of the fetus with the option to terminate pregnancy, came into being in the early 1970s. Tangled Diagnoses examines the multiple consequences of the widespread diffusion of this medical innovation. Prenatal testing, Ilana Löwy argues, has become mainly a risk-management technology—the goal of which is to prevent inborn impairments, ideally through the development of efficient therapies but in practice mainly through the prevention of the birth of children with such impairments. Using scholarship, interviews, and direct observation in France and Brazil of two groups of professionals who play an especially important role in the production of knowledge about fetal development—fetopathologists and clinical geneticists—to expose the real-life dilemmas prenatal testing creates, this book will be of interest to anyone concerned with the sociopolitical conditions of biomedical innovation, the politics of women’s bodies, disability, and the ethics of modern medicine.

In the 1960s, thanks to the development of prenatal diagnosis, medicine found a new object of study: the living fetus. At first, prenatal testing was proposed only to women at a high risk of giving birth to an impaired child. But in the following decades, such testing has become routine. In Imperfect Pregnancies, Ilana Löwy argues that the generalization of prenatal diagnosis has radically changed the experience of pregnancy for tens of millions of women worldwide. Although most women are reassured that their future child is developing well, others face a stressful period of waiting for results, uncertain prognosis, and difficult decisions. Löwy follows the rise of biomedical technologies that made prenatal diagnosis possible and investigates the institutional, sociocultural, economic, legal, and political consequences of their widespread diffusion. Because prenatal diagnosis is linked to the contentious issue of selective termination of pregnancy for a fetal anomaly, debates on this topic have largely centered on the rejection of human imperfection and the notion that we are now perched on a slippery slope that will lead to new eugenics.
