This is particularly true of the relationship between international law and domestic law and the relationship between federal law and the laws of individual federation members. Moreover some organisations have created their own supranational constitutional systems: the United Nations Charter is the best known, and is often referred to as the 'World Constitution', but the European Court of Justice in Luxembourg views the European Treaties as a 'Constitutional Charter' for Europe, while the European Court of Human Rights has defined the European Convention on Human Rights as a constitutional instrument of 'European public order'. It is in the dynamic relationship between domestic constitutional laws, EU law, the ECHR and the UN Charter that the most persistent difficulties arise. In this context 'interordinal instability' not only provokes strong academic interest, but also affects what has been called 'governance' or 'global government' and undermines both legal certainty and individual fundamental rights. Different solutions - constitutionalist and pluralist - have been explored, but none of them has received global acceptance. In this book Luis Gordillo analyses the interordinal instabilities which arise at the European level, focusing on three main strands of case law and their implications: Solange, Bosphorus and Kadi. To solve the difficulties caused by this instability Gordillo proposes a form of soft constitutionalism, which he calls 'interordinal constitutionalism', as a means to bring order and stability to global legal governance. The original Spanish thesis on which this book is based was awarded the Nicolás Pérez Serrano Prize by the Centro de Estudios Políticos y Constitucionales, for the best dissertation in constitutional law 2009-2010.

Such seasonal movements have formed an important aspect of many European farming systems for several thousand years, although they have declined markedly since the nineteenth century. Ethnographers and geographers have long been involved in recording transhumant practices, and in the last two decades archaeologists have started to add a new material dimension to the subject. This volume brings together recent advances in the study of European transhumance during historical times, from Sweden to Spain, Romania to Ireland, and beyond that even Newfoundland. While the focus is on the archaeology of seasonal sites used by shepherds and cowherds, the contributions exhibit a high degree of interdisciplinarity. Documentary, cartographic, ethnographic and palaeoecological evidence all play a part in the examination of seasonal movement and settlement in medieval and post-medieval landscapes. Notwithstanding the obvious diversity across Europe in terms of livestock, distances travelled and socio-economic context, an extended introduction to the volume shows that cross-cutting themes are now emerging, including mobility, gendered herding, collective land-use, the agency of non-elite people and competition for grazing and markets. In the context of internment operations in Afghanistan, Iraq, Guantanamo Bay and the Democratic Republic of the Congo, and of increasing international military intervention in internal conflicts more generally, the legal framework for internment has been widely criticised for being at best ambiguous and full of loopholes, at worst out-dated and inadequate. In light of such criticism, this book examines the continued relevance and adequacy of the existing legal framework, identifies its shortcomings and proposes possible avenues to remedy them. It offers answers to fundamental questions such as who may be lawfully interned in armed conflict, on what legal basis, for what reasons and for how long. Starting from the premise that internment in armed conflict cannot be lawful under one branch of international law while at the same time unlawful under another, the book offers a fresh view of the interaction between the simultaneously applicable norms of international humanitarian and human rights law. Heeding calls for the clarification and modernization of the existing legal framework for internment in armed conflict, the author also puts forward concrete proposals for normative developments that seek to reconcile both the practical realities of contemporary armed conflict and significant developments in international law that affirm the right to liberty as one of the most fundamental attributes of any human being.
