L' identification de la première suppose la considération du domaine des normes et l' examen de leur structure et de leur juridicité. La caractérisation de la seconde nécessite l' observation de la précédente. Elle requiert, en outre, que les normes, inter étatiques en cause soient obligatoires. Les principes de solution issus des ordres juridiques extra-étatiques s'avèrent inapplicables car inadéquats. Il en va autrement de ceux applicables dans les ordres juridiques étatiques. Ces principes doivent être hiérarchisés. La solution des conflits de normes inter étatiques dépend de souvent de celle donnée aux conflits de normes de droit international privé.
