Does empirical evidence support the use of industrial policy for correcting market failures that plague the process of industrialization? To address these questions, the authors provide a critical survey of the analytical literature on industrial policy. They also review some recent industry successes and argue that only a limited role was played by public interventions. Moreover, the recent ascendance of international industrial networks, which dominate the sectors in which less developed countries have in the past had considerable success, implies a further limitation on the potential role of industrial policies as traditionally understood. Overall, there appears to be little empirical support for an activist government policy even though market failures exist that can, in principle, justify the use of industrial policy.

Available in PDF, EPUB and Kindle. Book excerpt: Cette méthode relative à l'application de la théorie de l'abus de droit en matière de clauses abusives est composée de deux phases distinctes. Dans un premier temps, il s'agissait de démontrer l'applicabilité de la théorie de l'abus de droit en ce domaine. A cette fin, nous avons préalablement défini les clauses abusives en droit des contrats: est abusive toute clause contractuelle qui, imposée par la partie la plus forte, entraîne un déséquilibre contractuel au seul profit de cette dernière. C'est l'analyse des clauses de nature abusive qui comporte de nos jours un vif intérêt en droit civil. Elles doivent être traitées sur le terrain de la formation du contrat, en analysant le principe même de l'autonomie de la volonté mise en cause par l'inégalité flagrante en matière contractuelle due à l'évolution sociale et technologie de ces deux derniers siècles. C'est la qu'il faut réexaminer les règles du droit des obligations pour trouver un moyen de contrôle de ce nouveau type d'abus en matière contractuelle. L'étude des diverses notions du code civil nous enseigne leur inefficacité dans cette lutte. En effet, les conditions d'élaboration du contrat pour lesquelles a été écrit le code ne correspondent pas à celles que connaissent les contractants vulnérables. Il existe cependant un principe général du droit positif français qui, œuvre jurisprudentielle, permet de mener une lutte efficace contre les clauses abusives en droit commun: la théorie de l'abus de droit. Celui dont la situation dominante lui permet d'imposer à son cocontractant des clauses qui lui sont systématiquement favorables, abuse de son droit de contracter lorsqu'il les insère dans le contrat. Une fois cette démonstration menée, la seconde phase de notre travail consistait dans la détermination du rôle joue par la théorie de l'abus de droit après l'adoption des dispositions spéciales en la matière. Nous avons constaté que, à la différence de la loi de 1978 dont la définition matérielle couvrait peu de clauses abusives, celle de 1995 régit toutes les clauses abusives dont les consommateurs demeurent les victimes ...
