Cette évolution économique a-t-elle été suivie d’une évolution juridique protectrice de ces consommateurs du transport maritime ? Ouvert sur deux façades maritimes, le Maroc s’est doté depuis 1919 d’un code de commerce maritime (DCCM du 31 mars 1919) qui était à l’époque un modèle en la matière. Depuis 1975, le législateur marocain s’est penché sur le code pour l’adopter aux nouvelles données économiques nationale et internationale. La comparaison du droit marocain avec le droit de l’autre rive communautaire et notamment française, nous permet d’évaluer notre droit par rapport aux nouveaux aspects du droit des passagers par voie maritime. L’étude de la responsabilité du transporteur consiste à déterminer son fondement et les modalités de sa mise en œuvre. La responsabilité du transporteur maritime de passagers en amont et en aval du transport maritime repose sur des règles établies tant par les législateurs internes que part le législateur international ou régional. D’abord, l’étude de la notion, la formation ou la rupture, et l'exécution du contrat de transport permettra de déterminer les conditions de responsabilité du transporteur en cas de dommages corporels, matériels ou immatériels suite au retard. Ensuite, la volonté du dédommagement actionné par le passager lésé se traduit par la mise en œuvre de la responsabilité du transporteur maritime. Se pose, enfin, la question de savoir si les législations maritimes étudiées offrent au passager maritime la même protection que son homologue aérien et terrestre ? L’évolution du droit des passagers maritimes étant inéluctable, des perspectives d’avenir sont à envisager.
