Book excerpt: Employment is clearly one of those fields of political activity that reveal the manifold problems and difficulties accompanying the process of European integration and supranational institutionalization. In particular the conflict between supranationalists and intergovernmentalists and the degree to which member states show willingness to cooperate with each other become manifest. The Union is struggling for new employment policies that should, on the one hand, be compatible with the European model of the welfare state, and, on the other, adopt to new economic constraints. These debates are accompanied by many conflicts between different interest groups and lobbies. This study succeeded in looking behind closed doors within the EU organizational system. Committee meetings were tape-recorded and analysed, drafts of policy papers were examined for recontextualizations and the impact of interest groups and different economic and ideological concepts on policy-making made explicit. A comparison of decision-making processes in the European Parliament and in small networks of the Commission illustrates the different argumentation patterns and discursive practices that are involved in the formation of new employment policies. The ethnographic research is accompanied by a systemic linguistic and sociological analysis of various institutional genres and political spaces.

Bové's crusade against globalization helped provoke a debate both within France and beyond about the pros and cons of a world in which financial, commercial, human, cultural, and technology flows move faster and more extensively than ever before. As the French struggle to preserve the country's identity, heritage, and distinctiveness, they are nonetheless adapting to a new economy and an interdependent world. This book deals with France's effort to adapt to globalization and its consequences for France's economy, cultural identity, domestic politics, and foreign relations. The authors begin by analyzing the structural transformation of the French economy, driven first by liberalization within the European Union and more recently by globalization. By examining a wide variety of possible measures of globalization and liberalization, the authors conclude that the French economy's adaptation has been far reaching and largely successful, even if French leaders prefer to downplay the extent of these changes in response to political pressures and public opinion. They call this adaptation "globalization by stealth." The authors also examine the relationship between trade, culture, and identity and explain why globalization has rendered the three inseparable. They show how globalization is contributing to the restructuring of the traditional French political spectrum and blurring the traditional differences between left and right. The reasons andvalues behind this belief are perhaps evident,but I amconvincedthat they bear repeating here. To begin with, the hasty generalizations that often liebehind the cynicism—and ultimately the violence—of ethnocentrism and xe- phobia are still being aired today and still need to be fought, even in “unified and advanced” regions of the world like Europe and the United States. The historical and social sciences disciplines need to be solicited constantly in this combat, even though they themselves are terrains of controversy and contestation. I personally have not lost faith in their “progressive” potential and character. Second, my belief is that only through this process of appeal to these disciplines and their findings can we resist a dangerous contemporary slide into simplisticand sensation- ist pictures of the world—viewpoints often associated with an implicit assumption that social and economic change are linear processes, so- how unfolding according to the same neat “logic” wherever they are at work.

Most unfortunately Paul O'Higgins did not deliver the written text of his report and we regret that for that reason, we cannot include his report in this yearbook. The Conference, which got the hospitality of the Dutch Social Security Council in Zoetermeer, was very well organised and financed by the Dutch social security institutions and the Ministry of Social Affairs and Employment. The author identifies an ‘EU public-social order approach’ – a set of norms imposed by EU institutions on domestic authorities in the performance of a task with social implications. In the area of access to labour markets, this approach is characterized by the following measures and objectives: prohibition of certain forms of discrimination in access to employment, which enhances the protection of individuals; facilitation of the cross-border allocation of workforce among Member States, which requires domestic decision-makers to give equal chances to all EU citizens; and promotion of the economic competitiveness of domestic labour markets, which affects the rights of third country nationals. The presentation assesses the effectiveness of this public-social order approach – in particular as revealed in ECJ case law – as a tool to increase economic efficiency, advance distributive justice, and ensure protection of dignity. By way of detailed example, the author examines reforms of employment contract law and economic migration law in France, and for purposes of comparison illustrates parallel movements in defining the principle of equality as manifested in U.S. law. Thorough and incisive, this analysis of the constraints imposed by EU law on the exercise by domestic institutions of their competence in regulating labour markets is valuable not only to lawyers and academics in employment law, but also of great interest to jurists and policymakers in the wider field of European law as an accurate overview of the tensions between EU constraints and the tools used by national policy makers.
