Book excerpt: The closure plan and final rehabilitation must include: (i) a summary of the main points and conclusions, including closure targets, timetables and financial guarantees; (ii) a description of the context of the closure which includes the history of the mining company and its operations; (iii) a detailed description of the mining facilities; (iv) a description of the social and environmental charac [...] In addition to taking into account the concerns of the communities in the establishment and implementation of policies and development projects, it at the same time allows for citizen participation and the sharing of local and traditional knowledge related to the physical environment and the social fabric (Lanmafankpotin et al., 2013). [...] The first is the extent of the discretion of the public authority that rejects a mining project on the basis of the findings of an ESIA. [...] The granting of such a guarantee may seem obvious from a purely financial point of view as well as from the point of view of the promotion of mining exploration projects: the company that takes the risk of investing in exploration must reap the benefits in the event of success (discovery of a deposit). [...] When these documents are required at the appropriate time, i.e., before the granting of the exploitation permit, the main issue is then the inclusion of these standards into the mining regulations of the countries, as well as into the practices of the industry.

Mozambique’s legal framework for environmental management is well developed, and recent legal reforms have strengthened key public interest safeguards. Similarly, the country has established a comprehensive framework for investment through the Investment Law and Investment Promotion Centre (CPI), and enshrined in the Land Law the right to the use and benefit of land (DUAT). The Environmental Impact Assessment (EIA) process places public consultation at the heart of effective environmental management. It extends participation to a broad spectrum of stakeholders at an early stage, allowing, in theory, substantial influence over the design and implementation of the EIA process. The National Council for Sustainable Development (CONDES) and the Ministry for Environmental Coordination (MICOA) have not managed, however, to influence high level government policy decisions and push convincingly for a sustainable development agenda.

In 1989, the Government of Nigeria issue the document "national policy on the environment", which was revised in 1999 in response to the advances in knowledge and the need of integrating development issues concerning all sectors of the economy. The new environmental policy goals followed the sustained development principles of conserving and using natural resources for the benefit of present and future generations, and ensure an adequate environmental quality for good health and well being of the population. Recognizing the sectoral potential to cause serious environmental degradation, strategies regarding the implementation of policy directives in mining development included mandatory preventive environmental impact assessment (EIA), minimization of environmental damages and risks, prescription of regulation and standards specific for mining wastes, and promotion of legal small-scale mining activities. None of them has yet been fully put into practice. Although the EIA decree has been in force since 1992, only a year ago a mining project has prepared an EIA study and applied for an environmental certificate. Development of environmental regulations, mining effluent and waste management standards have just been included as an activity of the SMMR Project, following the provisions of the Nigerian Minerals and Mining Law recently approved (February 2007).

Land tenure security Tanzanias land law framework now includes formal recognition of customary title and the reservation of land under the category of village land exclusively for Tanzanians although improvements are still needed in terms of processes of consultation and compensation. Public awareness and lack of access to information Awareness of natural resources and investment policies, legislation and regulations is generally low amongst rural communities as well as Ward executive officers, village leaders and village land committee members.
