Book excerpt: The Rome Statute, unlike the statutes of the International Criminal Tribunals for the former Yugoslavia and for Rwanda, creates a permanent court whose dormant jurisdiction covers the territory and includes the nationals of States Parties and is universal in cases where the Security Council makes a referral. Besides, unlike the "ad hoc" tribunals, which have jurisdiction over specific crisis situations whose personal, territorial and temporal parameters have been defined in their respective statutes by the UN Security Council, in the case of the ICC it is not possible to determine a priori in which situations the ICC will be involved. As a result, the most relevant activity of the Court is the determination of those situations regarding which the dormant jurisdiction of the Court will be triggered. The book "The Triggering Procedure of the International Criminal Court" constitutes the first comprehensive analysis of the proceedings that, prior to any criminal investigation, aim to make such a fundamental determination.

This two volume work presents the results of a study carried out by a group of European criminal law experts in 2010-2012, with the financial support of the EU Commission, whose aims were to examine in detail current public prosecution systems in the Member States and to scrutinise proposals for a new European office. Volume 1 begins with thorough descriptions of 20 different national legal systems of investigation and prosecution, addressing a range of evidential and procedural safeguards. These will serve as a point of reference for all future research on public prosecutors. Volume 1 also contains a series of cross-cutting studies of the key issues that will inform debates about the creation of a European Public Prosecutor's Office, including studies of vertical cooperation in administrative investigations in subsidy and competition cases, the accession of the EU to the ECHR, judicial control in cooperation in criminal matters, mutual recognition and decentralised enforcement of European competition law. Volume 2 (which will be published in 2013) presents a draft set of model rules for the procedure of the European Public Prosecutor's Office and continues with a set of comparative studies of the national legal systems that cover the gathering of evidence, seizure of assets, arrests, tracking and tracing, prosecution measures, procedural safeguards, the presumption of innocence and the right to silence, access to the file and victim reconciliation. Volume 2 concludes with the final report, written by Professor Ligeti, summarising the findings of the group and reporting on the prospects for the proposed reform.

También el estudio del derecho penal se debe desarrollar, pues, sobre este binomio: delito y pena. Así aparece, después de aquel entre el derecho penal y el derecho civil, el límite entre dos partes o mejor entre dos aspectos del derecho penal. ¿Cómo se llamarán? El nombre más obvio sería el de derecho criminal para el uno y penal para el otro. Pero esta fórmula no responde a nuestra tradición; y la tradición, como ocurre a menudo, tiene una cierta responsabilidad del reducido desarrollo de nuestros estudios. La verdad es que la distinción no se ha hecho, primeramente, y que incluso no se acostumbra a hacer tampoco hoy en día según la antítesis entre el delito y la pena; por eso derecho penal se ha llamado, en general, tanto a la parte que se refiere al delito, como a la que se refiere a la pena. Lo que no sería, después de todo, un gran mal, pudiéndose todavía entre las dos partes del derecho penal distinguir mediante los dos atributos, material y procesal, de los cuales, si no el primero, el segundo al menos es correcto y expresivo: la pena, verdaderamente, procede del delito y, a su vez, se desarrolla mediante un proceso, el cual no es otro, pues, que el proceso penal. Según el plan legislativo, lo mismo que según el plan de la enseñanza universitaria, y, por lo demás, según el uso común, nosotros los italianos decimos desde luego, al estilo francés, procedimiento penal en lugar de derecho procesal penal; aun cuando actualmente esta segunda fórmula deba preferirse a la primera por las mismas razones que han determinado su preferencia en cuanto al proceso civil, cuyo estudio está considerablemente más adelantado, no es necesario dar, sin embargo, a tal cuestión de nombres una importancia extraordinaria. Pero el mal comienza cuando entre los dos sectores, del derecho penal material y procesal, la materia es distribuida injustamente. El criterio de la división debería ser, decía, la diferencia entre el delito y la pena; esta última es asunto del juez, aquél es asunto del reo. En cambio, se ha considerado hasta ahora que todo cuanto se refiere, decimos, a la estatuición de la pena pertenezca al derecho penal material y al derecho procesal solamente lo que concierne a su aplicación". Nevertheless, the EU, while developing instruments for smooth gathering of evidence in criminal matters, is not taking much effort to enhance its admissibility. Due to the lack of common rules in this matter, gathering and use of evidence in the EU cross-border context is still governed by the domestic law of the member states concerned. This may lead to situations where, given the differences between legal systems across the EU, evidence collected in one member state will not be admissible in other member states. Due to the fact that the Lisbon Treaty opened the possibility to adopt minimum rules concerning, among other things, the mutual admissibility of evidence, this research investigates the concept of minimum standards designed to enhance mutual admissibility of evidence in the EU. Through a study of two investigative measures, telephone tapping and house search, the author examines whether coming to various common minimum standards is feasible and whether compliance with these standards would finally shape the as yet nonexistent concept of the free movement and mutual recognition of evidence in criminal matters in the EU. Essential reading for both national and EU policy makers, scholars and practitioners involved in cross-border gathering of evidence in the EU.
