Download or read book Environmental Protection Versus Trade Liberalization Finding the Balance written by Sandra L. Walker and published by Publications Fac St Louis. This book was released on 1993 with total page 200 pages. Available in PDF, EPUB and Kindle. Book excerpt: Recent years have witnessed a proliferation of laws regulating the environment. Such laws aim to protect the environment of the legislating country and increasingly, the environment beyond its borders. While the objectives of these rules appear to be laudable ones, environmental regulation is frequently criticized as trade-restrictive and protectionist. In addition, attempts to regulate foreign production processes are attacked as interfering with the sovereign right of foreign countries to determine their own standards of environmental management. Environmental protection goals may also hinder international trade and consequently become vulnerable to legal challenge under international trade law. The manner in which international trade law weights the competing objectives of environmental protection and trade liberalization is the subject of this book. The experience of the European Economic Community in this regard provides a useful backdrop against which the treatment of environmental regulation under the GATT can be both examined and improved. The author concludes the GATT reforms, such as the incorporation of environmental principes into GATT jurisprudence, are critical to ensuring the legality of legitimate environmental protection measures. Such efforts would serve to safeguard both the environment and a more stable international trading system. The study was financed by the Brussels Capital Region through the Visiting Scientist's Programme.

Download or read book EU Private International Law written by Michael Bogdan and published by Europa Law Publishing. This book was released on 2006 with total page 362 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book provides an easy access to, and overview of, the case law of the Court of Justice of the European Communities (ECJ) pertaining to private international law. The book contains edited extracts from all ECJ decisions of immediate private international law relevance made before October 1, 2006. Most of the cases deal with the original or amended versions of the Brussels Convention on Jurisdiction and the Enforcement of Judgments in Civil and Commercial Matters from 1968. These judgments retain their authority also with regard to the interpretation of Regulation No 44/2001 of December 22, 2000 on Jurisdiction and the Recognition and Enforcement of Judgments in Civil and Commercial Matters (the so-called Brussels I Regulation). The existing ECJ case law regarding other EC regulations and directives dealing with private international law are also included, as well as a number of relevant judgments concerning the interpretation of the EC Treaty itself.

This book was released on 2010-05-03 with total page 594 pages. Available in PDF, EPUB and Kindle. Book excerpt: 1.1 Cash Flow, Risk, Agency, Information, Investments The first volume dealt with the management of: cash flow (and the exchange of goods and services); risk; agency relationships; and information. The firm m- ages these aspects by legal tools and practices in the context of all commercial transactions. The second volume discussed investments. As voluntary contracts belong to the most important legal tools available to the firm, the second volume provided an - troduction to the general legal aspects of generic investment contracts and p- ment obligations. This volume discusses funding transactions, exit, and a particular category of decisions raising existential questions (business acquisitions). Transactions which can be regarded as funding transactions from the perspective of a firm raising the funding can be regarded as investment transactions from the perspective of an - vestor that provides the funding. Although the perspective chosen in this volume is that of a firm raising funding, this volume will simultaneously provide infor- tion about the legal aspects of many investment transactions. 1.2 Funding, Exit, Acquisitions Funding transactions are obviously an important way to manage cash flow. All - vestments will have to be funded in some way or another. The firm’s funding mix will also influence risk in many ways. Funding. The most important way to raise funding is through retained profits and by using existing assets more efficiently. The firm can also borrow money from a bank, or issue debt, equity, or mezzanine securities to a small group of - vestors.

Download or read book Commercial Realism and EU Trade Policy written by Katharina L. Meissner and published by Routledge. This book was released on 2018-06-13 with total page 222 pages. Available in PDF, EPUB and Kindle. Book excerpt: The European Union (EU) is at the forefront of engaging in external trade relations outside of the World Trade Organization (WTO) with entire regions and economic powerhouses. Understanding why and how the EU engages in one of the most active fields of external relations is crucial. This book fills a gap in the literature by analysing motives on the modes – bilateralism, inter-regionalism, or multilateralism - of EU external trade relations towards regional organizations in Asia and Latin America outside of the WTO. In particular, it examines why the EU turned from interregional to bilateral external trade relations towards these world regions – a question that is, to date, under-researched. By developing and testing an original approach rooted in realist theorizing coined ‘commercial realism’, it examines systematically the explanatory power of commercial realism against liberal-institutionalist approaches dominant in the literature on EU external relations through five in-depth case studies. This book will be of key interest to scholars and students in EU Politics/Studies, EU external relations, inter-regionalism and more broadly to International Relations and International Political Economy.

Download or read book Collective Bargaining for Self Employed Workers in Europe written by Bernd Waas and published by Kluwer Law International B.V.. This book was released on 2021-02-16 with total page 480 pages. Available in PDF, EPUB and Kindle. Book excerpt: Collective Bargaining for Self-Employed Workers in Europe Approaches to Reconcile Competition Law and Labour Rights Founding Editor: Roger Blanpain General Editor: Frank Hendrickx Edited by Bernd Waas & Christina Hießl The increase in the number of self-employed workers, partially in response to the advent of the platform economy, has raised the spectre of horizontal price-fixing by self-employed members of a profession. This perception, however, is at odds with international labour standards, under which self-employed persons should also be able to conclude collective agreements to some extent. It is now commonplace for companies to offer various forms of non-standard employment that shift risk from the labour engager to the labour provider – which may increase the likelihood of those workers to fall outside the legal concept of ‘employee’ and because of that affects their legal protection. Legal practitioners may then face a dilemma: what may be required under labour law may be prohibited under antitrust law. In the first comprehensive analysis of these intensely debated issues, the authors argue that there is an urgent need to address the current legal puzzle, including through regulatory measures. This must include, in particular, the existing regulation at the level of the European Union (EU), which dominates competition law in the Member States. The book combines an analysis of the supranational framework by experts in labour law as well as competition law with in-depth country reports from Member States of the EU in which regulations and/or practices of collective bargaining for the self-employed exist. Among the many issues discussed in this book are the following: collective bargaining and international labour rights; self-employed individuals and the concept of undertaking in EU competition law; the concept of ‘social dumping’; the importance of the case law of the European Court of Justice; the concept of ‘vulnerability’; competition authorities’ enforcement strategies and priorities; the concept of ‘false self-employed’; and the possible introduction of exemptions, presumptions, safe harbours, or smart regulation solutions in competition law. The book gives an insight into the legal situation in Austria, Belgium, France, Germany, Ireland, Italy, the Netherlands, Poland, Slovenia, Spain, and Sweden. These reports discuss the current practice of collective bargaining and how the current law is reflected in the academic discourse on the right of self-employed people to bargain collectively. This important book, in its presentation of legally sound and effective ways to shape the application of the right to bargain collectively that are attuned to the business and technological realities of the twenty-first century, promotes an understanding of the consequences for current law and practice and offers a basis for a discussion of regulatory measures addressing existing challenges. Practitioners of labour law and competition law, national competition authorities, and other interested parties will benefit from the detailed analysis and extensive findings.

Download or read book Letter Writing in Late Modern Europe written by Marina Dossena and published by John Benjamins Publishing. This book was released on 2012 with total page 263 pages. Available in PDF, EPUB and Kindle. Book excerpt: In recent years there has been a renewed interest in correspondence both as a literary genre and as cultural practice, and several studies have appeared, mainly spanning the centuries between Early and Late Modern times. However, it is between the eighteenth and nineteenth centuries that the roots of contemporary usage begin to evolve, thanks to the circulation of new educational materials and more widespread schooling practices. In this volume, chapters representing diverse but complementary methodological approaches discuss linguistic and discursive practices of correspondence in Late Modern Europe, in order to offer material for the comparative, cross-linguistic analyses of patterns occurring in different social contexts. The volume aims to provide a general and solid methodological structure for the study of largely untapped language material from a variety of comparable sources, and is expected to appeal to scholars and students interested in the linguistic history of epistolary writing practices, as well as to all those interested in the more recent history of European languages.
