Book excerpt: Dans les économies du monde et plus particulièrement dans celles des pays en voie de développement, notamment en Afrique, l’investissement est une dynamique vitale. L’investissement privé, qu’il soit domestique ou étranger, est au cœur des politiques économiques des pays ayant reconnu les vertus d’une économie de marché. Longtemps ignorée dans les politiques publiques de la majorité des pays africains, la question de l'adoption d'une stratégie d'attraction des investissements est devenue cruciale. Aussi, tous les États d'Afrique francophone vont mettre en œuvre une politique publique dédiée à la promotion de l'investissement. Les principes de liberté d'entreprendre, du respect de la propriété privée, de garantie des transferts des capitaux ont intégré l'environnement juridique africain. Ces postulats juridiques inhérents à l'épanouissement de l'investissement ont dans un premier temps été dispersés dans plusieurs textes législatifs. Ensuite, dans un deuxième temps, pour pallier les difficultés de transparence, d'accessibilité des textes et pour faire face aux recommandations des organisations internationales, plusieurs Etats se sont lancés dans la "codification" de leur arsenal juridique relatif à l'investissement. Cette démarche a donné naissance aux Codes des investissements et aux Chartes des investissements africains avec pour ambition: l'incitation à l'investissement par la mise en place de moyens juridiques et dispositifs fiscaux capables d'accroître l'attrait des marchés locaux et d'augmenter le flux de capitaux privés dans tous les secteurs écoomiques. Malgré la volonté exprimée dans les Codes des investissements et en dépit du potentiel économique dont dispose l'Afrique, la majorité des Etats africains peine à attirer les investissements privés nécessaires à leur développement. Seuls les pays riches en ressources naturelles ont connu une amélioration de leur stock d'investissement. Il importait donc de comprendre pourquoi les dispositifs établis par l'intermédiaire des Codes des investissements n'ont abouti qu'à des résultats mitigés. La première partie de l'étude propose d'appréhender le contenu, l'esprit et la "géographie" des Codes des investissements. Elle part, d' un point de vue d'histoire conceptuelle, du processus économique, juridique et social ayant favorisé l'installation des Codes des investissements dans la paradigme de gouvernance des Etats africains. Elle s'achève par l'analyse du régime juridique et le traitement du contentieux lié à l'application des Codes des investissements en Afrique. La deuxième partie propose une réflexion sur le bilan de la mise en oeuvre des Codes des investissements en Afrique. Par conséquent, elle s'intéresse à l'ensemble des facteurs qui affectent négativement les déterminants à l'investissement privé et propose en retour, différents leviers d'actions susceptibles de favoriser l'installation d'un climat d'affaires propice à l'attraction des capitaux.
