Avec vingt ans de vie, il dépasse enfin les dix-huit ans de sa laborieuse gestation. S'il a pu s'émanciper de son ancêtre avec la perte de l'adjectif "nouveau", étant devenu le Code pénal, il n'en est pas moins un majeur fragile. Que de contraintes en effet n'a-t-il pas à subir ! L'implacable tutelle des contrôles de constitutionnalité et de conventionnalité, les caprices du législateur qui ne cesse d'empiler les réformes, les audaces du juge dans son pouvoir d'interprétation. Par ailleurs les grands principes du droit pénal, fièrement proclamés par le Code, ne sont-ils pas vacillants ? Et il y aurait beaucoup à dire sur les infractions qu'il contient, quelques échantillons étant à cet égard éloquents. Le Code pénal n'est-il pas de surcroît inachevé, avec cette enveloppe quasi vide qu'est son cinquième livre ? Et peut-on lui reprocher de n'appréhender qu'une partie du droit de la peine ? Pire, serait-il déconnecté de la criminologie ? Le colloque du 20 mars 2014, fruit de l'heureuse initiative de Laurent SAENKO, a apporté des analyses éclairantes sur toutes ces questions fondamentales qui révèlent pour le moins un destin agité. En tout cas, dorénavant, il ne reste plus au héros du jour qu'à tenir encore 164 ans pour atteindre la longévité de son aîné. Mission impossible ! ?
