Book excerpt: En ce qui concerne le régime de l'action en responsabilité du sous-acquéreur contre le vendeur - fabricant, il convient de différencier strictement l'hypothèse ou l'insécurité du produit à porter atteinte à l'intégrité physique des personnes et des biens ("dommages causés par le produit") de celle ou la non-conformité de la chose vendue a compromis l'équilibre pécuniaire existant entre les membres d'une chaîne de contrats ("dommages causés au produit"). Etant donné que la première hypothèse, qui est régie par la responsabilité délictuelle ou objective en droit interne (art. 1384 al. 1er 1386-1er, 1386-1 et ss. Du code civil), relève exclusivement de la convention de la Haye du 2 octobre 1973 sur la loi applicable à la responsabilité du fait des produits, la question du statut de l'action directe contractuelle en droit international privé ne se pose que dans la deuxième. Grâce à son caractère dérivé, l'action directe est génératrice d'une extension du contrat initial de la chaîne envers le titulaire de l'action. A l'opposé de la CJCE et de la cour de cassation, nous plaidons pour que l'action directe contractuelle, compte tenu de son mécanisme en droit interne, puisse être exercée, en application de l'article 5 nʿ1 de la convention de Bruxelles, devant le tribunal devant lequel le vendeur intermédiaire pourrait lui-même actionner le vendeur initial en tant que cocontractant. En matière de conflits de lois, ce mécanisme doit se traduire par le rattachement de l'action directe, quant à son admissibilité et son admission, au contrat initial de la chaîne dont la loi applicable sera désignée selon la convention de la Haye du 15 juin 1955. Si le contrat initial est régi par la convention de vienne du 11 avril 1980, le sous-acquéreur pourra exercer l'action directe contractuelle sur le fondement des dispositions matérielles de cette convention des lors que la Lex Causae du contrat initial admet le mécanisme de l'action directe.

Ce dynamisme s'explique par l'existence dans les deux branches d'un droit d'action reconnu à une personne privée pour engager la responsabilité internationale de l'Etat devant un juge international : le recours à l'arbitrage international en application des traités d'investissement et la saisine des cours régionales des droits de l'homme. En outre, les droits protégés dans les deux branches se rapprochent. Droits de l'homme et droit des investissements interdisent les discriminations, les expropriations non accompagnées d'indemnisations et le déni de justice. Ils garantissent l'accès au juge, l'exécution des décisions de justice et permettent à la victime d'obtenir une indemnisation. En raison de ces protections, il n'est pas étonnant de voir les investisseurs privés utiliser les deux systèmes pour protéger leurs droits face aux Etats. Il n'est également pas étonnant de voir les arbitres en matière d'investissement s'inspirer des techniques et des interprétations retenues par les juridictions des droits de l'homme. Il s'agit, dès lors, d'approfondir la réflexion sur les protections que peuvent réclamer les investisseurs privés dans les deux systèmes. Après un regard croisé porté sur la compétence, la procédure et le fond dans les deux branches, les interactions entre les deux disciplines sont examinées. Droit des investissements et droits de l'homme peuvent entretenir des rapports de complémentarité, d'inspiration mutuelle et d'emprunt ou de conflit. Principalement, il convient de s'interroger sur les problèmes que posent le cumul de la saisine des juridictions des droits de l'homme avec les tribunaux d'arbitrage, sur l'usage des mêmes techniques et méthodes par l'arbitre et le juge des droits de l'homme ainsi que sur la confrontation éventuelle des deux systèmes. Cette publication, inspirée par l'actualité, offre aux spécialistes de deux branches la possibilité de se retrouver en vue d'une réflexion transversale ayant à la fois un intérêt théorique et pratique.

Book excerpt: International law has long differentiated between international and non-international armed conflicts, traditionally regulating the former far more comprehensively than the latter. This is particularly stark in the case of detention, where the law of non-international armed conflict contains no rules on who may be detained, what processes must be provided to review their detention, and when they must be released. Given that non-international armed conflicts are now the most common form of conflict, this is especially worrying, and the consequences of this have been seen in the detention practices of states such as the US and UK in Iraq and Afghanistan. This book provides a comprehensive examination of the procedural rules that apply to detention in non-international armed conflict, with the focus on preventive security detention, or 'internment'. All relevant areas of international law, most notably international humanitarian law and international human rights law, are analysed in detail and the interaction between them explored. The book gives an original account of the relationship between the relevant rules of IHL and IHRL, which is firmly grounded in general international law scholarship, treating the issue as a matter of treaty interpretation. With that in mind, and with reference to State practice in specific non-international armed conflicts - including those in Sri Lanka, Colombia, Nepal, Afghanistan, and Iraq - it is demonstrated that the customary and treaty obligations of States under human rights law continue, absent derogation, to apply to detention in non-international armed conflicts. The practical operation of those rules is then explored in detail. The volume ends with a set of concrete proposals for developing the law in this area, in a manner that builds upon, rather than replaces, the existing obligations of States and non-State armed groups.
