Apparues commercialement en 2000, ces techniques, avec plus de 500 opérations industrielles, présentent après 10 ans de succès commerciaux un taux record de découverte de près de 90 %, et semblent aujourd’hui bouleverser la donne en matière de recherche pétrolière offshore. En proposant un indice de présence d’hydrocarbures sérieux, l’EFM couplée à la sismique réflexion est probablement la première méthode fiable de détection directe des hydrocarbures. Complétant les concepts structuralistes de la prospection indirecte en vigueur depuis les années 1920, l’EFM modifie aujourd’hui radicalement l’approche et les philosophies d’exploration, en particulier celles incluant en aval les activités de forages et de diagraphies de fond de trou. S’appuyant sur les lois de l’électromagnétisme (équations de Maxwell), Électrographies de fond de mer décrit et analyse en détail les principes physiques, les méthodes, les techniques et les technologies mis en œuvre ou en voie de l’être. Book excerpt: The United Nations Convention on the Law of the Sea of 10 December 1982 entered into force on 16 November 1994. Since this date a single binding instrument has regulated the rights and duties of States at sea and regarding the sea. New concepts, such as the exclusive economic zone, archipelagic waters, transit passage through straits, and the International Seabed Area, are now fully recognized. The fifteen member States of the European Union are a significant sample for analyzing the practice of States, or at least that of the Western industrialized States, as regards the law of the sea. They include major and small maritime powers, coastal and land-locked States, States with coasts on the Atlantic Ocean and States with coasts on semi-enclosed seas such as the Baltic and the Mediterranean, States with and without involvement in deep seabed mining and States with different interests as regards fisheries. The fact that they all belong to the European Union is a very important common feature, which amply justifies the choice made to study them together. The book's aim is to give, through essays prepared by well-known specialists, a detailed survey of the attitudes and practice concerning the law of the sea of the member States of the European Union and of the European Community as such. The common positions of the member States and the results of their coordinated action also emerge from these essays. The fact that the member States and the European Community are now actively engaged in the process of becoming parties to the Law of the Sea Convention is certainly a major contribution to the consolidation of the Convention as a universal instrument, or at least as an instrument widely ratified by States of all continents and economic and political interests.

Under international law, no specific regime applies to these complex and paradoxical objects of use. The Law of the Sea Convention sets a framework that is partly inadequate for this new category of resources. The Biodiversity Convention and the Nagoya Protocol only address the genetic resources of national areas. Patents allow their holder to exercise a monopoly on exploiting biotechnological creations to extensive claims, questioning the common nature of biodiversity and related knowledge. They hinder research and the objectives of biodiversity law. The legal and practical rules of physical and functional access vary in geometry. They focus on the valorization of research results, crystallizing conflicts of interest between suppliers and users. Sustainable research and development is essential to the knowledge and protection of marine biodiversity. The qualification of marine genetic resources in common, standard contractual tools, distributed research and development infrastructures, negotiation of an agreement on sustainable use and conservation of biodiversity beyond the limits of national jurisdiction, would To remove these inconsistencies.
